If apple wanted the system to be OSX only they could have crippled the BIOS in some way (I'm sure refalshing with a standard intel version would work fine).



As to running OSX on a non-apple hardware is not the same, I guess apple have soem encryption / verification logic or code in the BIOS or some chip hanging off the PCI bus for OSX to verify against. Windows won't be looking to do that.
