In a lot of cases they are bought by investment/hedge funds with the sole purpose of using it to expoilt what is already there (Aka hire a lawyer and sue). Apple doesn't want ot spend more on lawyer fees than on the settlement so Apple hopefully looses.<br><br>Then they go after MSFT and sue them on the same basis for $200mm. The patent system was meant encourage original ideas by those who would otherwise not be able to compete with large corporations with more marketing dollars.  But the idea of the patent system is that patents are awarded to those who actually *produce* stuff.<br><br>I hope that with patent reform, which is now moving its way through congress, there will be an end to "patent holding firms". Given that the computer industry 'ages' at about 10* normal speed, software patents should expire in 1/10 the time. 5 years is an awful long time in the computer industry, and should give the patent recipient plenty of time to commercialize a product. It just takes a lot of time to develop the software. If something is 4-5 years under development chances are the patent holder wont know they are being walked over for at least the 4 years if not more.<br>Pattent trolls are a sidefect of a broken system, dot defending this case or anything like it. But they've waited how long to act on it ? One tiny little federal law and it's all taken care of.  If you win the case, OK, Apple pays you a few million bucks.  If you lose, your entire board of directors are drug out of their homes in the middle of the night and shot.
