MS and Apple have similar interfaces (to some extent).
There is a little comething called precedent in the Judicial system whereas a Judge will have to follow any judgement made before in a similar case.
So these leechers go after Apple which has money and sues them for a ridiculously small amount of money. Apple doesn't want ot spend more on lawyer fees than on the settlement so Apple hopefully looses.

Then they go after MSFT and sue them on the same basis for $200mm. Precedent takes over and MSFT looses.

I'm pretty sure that such a thing is not what the patent system was meant to encourage. The patent system was meant encourage original ideas by those who would otherwise not be able to compete with large corporations with more marketing dollars. But the idea of the patent system is that patents are awarded to those who actually *produce* stuff.

I hope that with patent reform, which is now moving its way through congress, there will be an end to "patent holding firms". There should be a requirement that if you're granted a patent, you actually produce something within a certain time frame or you lose that patent.

Just think the notion of a 10x shorter lifespan on software pattents isnt all thought out all the way through.

There is legislation either being drafted or pending that will impute a requirement that the infringement actually occur in Texas or that the Plaintiff/Defendant meet some other jurisdictional requirement before filing a case. It is bad policy to allow the Plaintiff to forum shop.
