Returned DAP gets resold with loads of porn
We've seen returned / resold DAPs (among other things) ruin celebrations before, but we're inclined to say that this episode is a tad more disheartening than receiving a couple of rock-filled iPod boxes. Reportedly, an unspecified MP3 player purchased in a Tennessee Wal-Mart was wrapped and given as a Christmas present to a 10-year old daughter, but upon connecting said player to a computer, heaps of pornographic material and explicit songs were discovered. According to a Wally World spokesperson, stores aren't supposed to "return opened packages to the sales floor," but given that it already happened, the matter will purportedly be "investigated."[Via TGDaily]

Like heck Wally World does not put things back on the shelf. I at one time had a really sick kid, so I picked up a cheap DVD player, switchbox & cable at a local Walmart so he could watch movies in his room. The DVD player was in parts and missing the remote, the switchbox had reglued packaging, and the only thing that worked was the cables. I was displeased and phoned in a complaint to the corporate office. My understanding was that the store manager was not happy - wether it had been because they leaned on her or that she got caught and was told to use more stealth.

There is a video on CNN and honestly I don't think this guy could figure out how to do load it full of porn let alone install the batteries.
From the report on the kind of stuff on the player it could make a 10 year old upset. Especially if she was raised as a God fearing child. That isn't an underhanded comment mind you, just trying to let you guys understand how someone might not be "Oh thats neat!"
As for them going after Walmart for money, as I said I don't think they are that smart to try a scam like this, and if they were the bigger legal team from Walmart would chew them up and spit them out. If I was a father, that puts the emotional spin into it of being pissed off that you let your daughter down on the holidays and handed her a device full of things you'd ideally hope she'd never see/do/whatever. As a consumer I'd be even more pissed off that they sold me an open item as new. I'm typically very much against lawsuits, especially stupid ones, but if this brings out into the open another bad practice from Walmart than I'm all for it to hopefully get that stopped.
I'm guessing this was either an employee thinking it would be funny or a kid that bought some of them and returned them "unopened" later as a joke.

I'm surprised the girl told her parents before inviting all her friends over to see it.... guess it wasn't as interesting as the stuff she's already seen on the net or downloaded to her mobile to think it was worth inviting the girls over for a viewing.
In this day and age a 10 year old girl is unlikely to freak out over porn.
Only parent freak about girls seeing porn these days.
Plus, the only reason it made CNN was that a girl was the "victim". If it was a 10 year old buy we wouldn't even be talking about this because no one would have found it news worthy because he'd be viewed as having received a 'lucky bonus' with his MP3 player.

I was watching the news yesterday (Sweden) and there was a man that had bought a new Cellphone from "Telia Sonera" new package and discovered loads of videos and pictures on it with Animal Sex. In looking at the story In noticed that the Wal Mart was located in Sparta, in White County, TN. That is a very conservative rural area and it would not suprise me one bit that the little girl was upset, particularly if the family is fundementalist Christian. Ed, I would have agreed with you about 10 years ago, but now not so much. Particularly in rural areas, the idea of boys being "done a favor" does not get traction like it used to. I do not disagree that the fact it was a little girl is giving the story more legs that it might otherwise, but I think its going too far to say there would be no story at all.

I mean to say there would be no story AT ALL since the boy would have never revealed the existence of the porn. EVER.
At my age, I remember a life before internet where there was only BBS and a PMP would have seemed magical to possess by any age group.
I also remember that if you got a hold of a playboy, or dare I say it.. a Hustler you were instantly vaulted into legendary status in the neighborhood among the other boys.
No other human behavior is more ubiquitous on this planet then a young man's search for porn :)
P.S - If I received a portable device in my youth with that much porn on it.... dear god :) Youth today takes for granted that you can carry around 100 gigs + of data with you.
