They are just a program developer with an application that works on a certain type of software. What next, you want a BitTorrent site eliminated because it makes movie sharing "too attractive?" Want all file sharing programs eliminated because they make music sharing "too attractive?"<br><br>Actually, this isn't even quite the same as those. This is more like blaming a popular file on a BitTorrent site for making the program too attractive to people, and then trying to sue.<br><br>Come on, dude. You would most likely be violating your contract if you jailbreak your iPhone, but I'm not sure what law is being broken.  DMCA?  That is a nonsense law anyway and deserves to be challenged.<br><br>I think these carriers are going to have a hard time defending these policies.  It would be one thing if you are tampering with the part of the software which interfaces with the network, i.e. if the change could be considered a danger to the network.  But a change in the type of data traffic is a bit more far fetched.  I'm not sure how ISPs have done so far in keeping their TOS restrictions on certain types of traffic (e.g. bittorrent) in cases where the ISP cancelled a contract with a user because of a claimed breach on the usage terms. This is just protectionism that is contrary to what Apple has publicly stated, although I can't say that I'm surprised.  You've got to wonder what the cellular network CEOs were saying when Steve Jobs said that VoIP was OK over WiFi. T-Mobile's iPhone plans (except the basic one) include free WiFi over T-Mobile's hotspots<br>2. Although the plans include free minutes, T-Mobile will want to sell per-minute fees once the free minutes are used up<br>3. Like, Windows Mobile phones ROMS are always being reflashed on devices and modified. All that was done to stop this by M$ was that the ROMS could no longer be stored at XDA-Dev FTP site.
