Think about it!<br><br>Apple beats down Psystar, which has a set of "hotshot" lawyers making dumb claims against Apple that are shot down in court. Isn't every boxed version sold an upgrade since it's Mac only, and all Macs ship with Mac OS?  So isn't the fact that Psystar is selling OS X as a new OS a big license violation on that count? I can go from 10.3 to 10.5 just like I can upgrade to Windows Vista from Windows 2K as easily as I can from XP. No, by buying OSX retail disk you are buying full version. Furthermore it is yet unclear how legally Apple may try to stop user from running the software unpaired on other hardware. Thus if I use some kind of EFI emulator that mimics behavior of the mac, without modifying the the OSX leopard I am not braking any laws. <br><br>The problem with Psystar that they advertise and sell computers with OSX claims that Apple has not granted to give. If I would make a clone of Mac. I would just say that computer hardware is similar to Mac OsX.... You are buying a physical copy.  Second, you do not agree to the license when you purchase it, they are trying to enforce the license AFTER you have already purchased it.  That is where this whole thing comes into play. As much as people who love OSX bash Microsoft, the fact is Apple still is a small fish in the OS landscape. So naturally Apple is going to fight hard to protect their OS rights. <br><br>I wouldn't call Apple a dragon, more like an angry badger. Regardless of market share, the company is incredibly profitable. Not to mention that it has nearly half of Microsoft's market capitalization despite this 9% share. Of course, the two companies do have their own unique businesses (with Apple being more into hardware and Microsoft more into enterprise software). My the rubber on my bluetooth headset started to disintegrate after 10 months.  I took it to the Apple store with no receipt and walked out with a brand new one in the box, new cables and all, no questions asked. And their response is to give it back to me and say it needs to be sent to Apple... seriously, just a stuck CD drive, something that usually is just a case of: find paper clip - bend paper clip and stick it in the manual eject hole and done ( I still can't believe macs don't include such a basic thing). Takes a lot of time and effort and dealing with people who probably couldn't even locate the screen.<br><br>I do however realize that everyone's experience of CS is different, and just anecdotal evidence. As on the reverse, dealing with Dells CS who are infamously bad, was actually pretty good. I had a the same issue (similarly bad service as well) with my first MacBook when I was in Costa Rica and since they don't have Apple Stores there, that was my only option.<br><br>A couple weeks ago, I had a faulty optical drive (different ailment) and took it to the Apple Store in the Eaton Centre here in Toronto. If Microsoft did lock Windows onto MS branded hardware and unjustifiably increased prices they would be sued into the ground by every major corporation, many millions of individuals and probably have many world trade bodies hassling them. But Apple is allowed because of their minority share, and are (probably) technically doing nothing wrong. They don't have a monopoly on operating systems or computers. They just don't. Now if you want to talk about the music store. That's something else, but then again, they aren't the ones demanding DRM, so if they were forced to sell all their music without DRM then I'm not sure what would happen. Probably would have to cave to any music label demands to get them onboard. So any much as the guy above me hates apple. Though what would have happened in the end is that IBM's inevitable failure to innovate would have led to a non-IBM-clone-based architecture turning into what is today the personal computer.<br><br>A closed architecture can only survive as long as one of two things remains true:<br><br>1. The owner of the closed architecture continues to innovate, and/or <br>2. Competition is weak.  <br><br>So far Apple has been pretty innovative, but business history tells us that will not last forever.  As for competition, well, the OS market is very hard to break into, as Apple has spend decades finding out.  Microsoft could compete with Apple if they weren't an aging dinosaur.  But look how hard it has been for outsiders to compete against MS and their 95% market share.  It makes even less sense for a non-Microsoft company to try to "dethrone" Apple from their 5-7% share.  It's not worth the effort to compete because the payoff is too small. First Sale Doctrine traditionally says that once you buy something, you own it and can do what you want with it, and the courts have upheld the idea that this applies to software as well.
