They probably didn't add software/driver/what ever support so they wouldn't get sued by Apple. When Apple takes them to court they can say, "Oh, it has multi-touch? Particularly since it isn't limited to a phone, but rather to any "computing device."  Since the earliest possible priority date of the patent is Sept. 6, 2006, any computing devices demonstrated or sold before Sept. 2006 would likely invalidate, or render obvious, this patent. From what I've heard, Bell Labs was doing computers with multi-touch in the 1980s, which is well before Apple's priority date.  Moreover, none of the prior art references cited in Apple's patents appear to be to Bell Labs 1980s work, so it looks like the patent office didn't even know about it.  That not only strengthens the argument that the patent is invalid based on Bell Labs work, but it opens up the argument that Apple knew about it but failed to disclose it to the patent office, a big no-no that can make the patent unenforceable.<br><br>Apple's is also limited to multi-touch scrolling, not the pinch zoom or other multi-touch gestures (which I assume are in other Apple patent applications). They've just been given a lifeline by Elevation Partners, but their last 10k wasn't exactly glowing and Sprint, the exclusive provider for the Pre, is laying off workers and losing customers left and right.<br><br>That said, I don't see why Apple wouldn't just license the technology to companies.<br><br>]]></description><dc:creator><![CDATA[Paul A. The US has a "first to invent" policy, whereas many other countries have a "first to file" policy with regards to patents.  <br><br>All they would have to do is prove the technology existed and is a novel idea before Apple filed for this patent. Now personally I am not saying this is invalid, or unenforceable, because I don't know enough about multi-touch technology... but I know enough about patent law.  <br><br>It would probably cost millions of dollars to try and invalidate the patent, but my guess is Apple would end up suing HTC (or Palm or anyone who tried to use multi-touch) for tens of millions of dollars.  So expect a knock down drag out fight... hell, a re-examination of a patent alone could take years... which would probably be one of the first steps a potential infringer would make.<br><br>But then there is the whole issue of multi-touch being introduced to the G1 by a third party programmer... sounds complicated. It doesn't matter if Bell Labs has a prior patent or not.  What matters is that they developed and demonstrated a product that practices Apple's "invention."  Invalidating prior art can be any prior product, printed publication, patent or use.<br><br>Can Palm survive a lawsuit against Apple?  Absolutely.  While it is true that litigation, especially patent litigation, is expensive, it isn't so expensive that a company as large as Palm can't or won't wage a war that could decide whether it exists or not next year.  Plus, Palm will start selling Pres soon, and that will provide a nice little revenue stream (I am assuming that Apple will be unable to win a preliminary injunction based on the weakness of its case).<br><br>As for licensing, there is no way Apple will license their multi-touch patents. I keep hearing about Bell Labs from people, who no doubt just did a quick "multi-touch" search on Wikipedia, but no one can tell me about any (1) product or (2) patent that exists for it. I'm not trying to argue, as I would like to know as much as anyone.<br><br>Even when I do a basic Google search, I get pointed back to Wikipedia or someone who wrote an article claiming to have seen multi-touch in Bell Labs. I don't think that will be enough to make a prior art claim, but we'll see. Someone tried to sue Apple for the iPod idea and the people at Apple were able to find a British guy who applied for a patent for something that resembled the iPod way back in the eighties or nineties.<br><br>So it's not impossible, but I just keep hearing a lot of vague references, but no evidence.<br><br>]]></description><dc:creator><![CDATA[Paul A. I'm sure all companies do a lot of interesting projects which they never show to the public.<br><br>You know, I bet there are some scientists out there who would like to say that Leonardo Da Vinci created the first flying machine, based on the fact that he did some pretty realistic sketches for it, but the Wright Brothers will no doubt go down in history as the guys who actually invented flying machines since they actually created a WORKING DEVICE with the technology.<br><br>I'm not saying that Bell Labs didn't experiment with the technology, but it feels like some people just don't want to give Apple credit because they're either (1) fanboys of other companies or (2) obsessed patent reformer geeks.<br><br>]]></description><dc:creator><![CDATA[Paul A. But do you really think that is all that Palm would do?  They can subpoena Bell Labs for its records on its multi-touch designs.  It can subpoena the people who worked at Bell Labs at the time and get testimony about the multi-touch functionality.<br><br>There is also the fact that Apple's patent covers more than just multi-touch.  It also covers single touch.  (The claims refer to "one or more finger contacts" which literally reads on single touch and multi-touch).  Therefore, prior art single touch products (of which I am sure you can admit there were plenty) could invalidate this patent.<br><br>Finally, you have to come up with the argument as to how multi-touch is not obvious in light of prior single touch. Sure Steele can do it for the browser, but with the systemwide virtual keyboard, all I need is the auto rotate.  Though Steeles new gesture based method of switching between windows is freaking sweet! Is it fair that I could walk into a lab, look at a technology, make a product and then patent it so no others can use it? From a moral point of view I couldn't. I have no experience in the legal side.<br><br>On the other hand, without reading the patent (I have better things to do!), if it's regarding the implementation of multi-touch in conjunction with capacitive touch screen technology which was previously unachievable then yes, I can see a claim to the IP referencing that particular part.<br><br>Personally, I'd rather people could be innovative with the technology rather than worrying about who came to market first. At the end of the day, Apple had a big head start and reaped the benefits. Holding back competition artificially because you haven't innovated enough during that period IMO is detrimental to the consumer and preventing things moving forward. Hell, Apple may have something in the wings that'll surprise us all but until it finishes it, I feel that the rest of the market should be allowed to compete using that input method. It's not the legal view, but I have it all the same.<br><br>If it was ripping the actual software user interface, that's a different story. The G1 is like a Customer preview program, a fully working version, just missing a few features. I hope google encourage the hacking community, as they already have made developments I deem to be crucial to cupcake. I'm currently running a custom firmware with Autorotate (Systemwide save a few market applications), autorotating browser and multitouch integrated into that browser, I presume that another update will be released along with cupcake, adding all the features of that, plus maybe multitouch maps and pictures. I think android was developed with the modding/hacking community in mind, allowing it to be open source so that companies can develop their own versions too, but also allowing more advanced users to develop a custom version. Although from what I hear, they havn't released the widget API (Which makes no sense, it has a huge use IMO).
