It is the EXACT same service, only more expensive. Only way around this is to say the device was lost or stolen and that you do not want to replace it or transfer service etcetera. My guess is that it became so common for people to sign contracts only to terminate them and go jailbreak/unlock their iPhone's that AT&T have added safeguards. AT&T will claim it is a Apple requirement that the device must be returned on contract termination but I found that Apple in reality couldn't care less. AT&T only requires that you return the phone if you cancel within the first 30 days.  There is nowhere in the contract that tells you AT&T wants the phone back if you cancel the phone after 30 days.  Thus, if someone at AT&T told you that you must return your phone (when you have cancelled after the first 30 days), you can tell them to kiss the hairiest part of your ass.  They have no legal right - especially if you have already shelled out the $175-200 ETF.  If what you said was the case, there would be a huge backlash against the company - and AT&T knows this. <br><br>AT&T's ETF is now set at $200.  Most companies have it set at that now.  That being said, AT&T has a prorated ETF - so if you wait a couple of months you could save a whopping $10.  It does make a hell of a lot more sense at first, to buy the phone for $199, cancel, and end up only paying about $399... unfortunately, it's not as simple as that.  You will owe them at least $36 for the activation fee, and another $60+ for the first month of service. I buy unlocked phones so I could continue with good value contract. <br><br>Phone companies are evil. I mean really, they are just a bunch of crooks. That's because the 3G bands are incompatible with those used by T-Mobile USA (the iPhone supports 850 and 1900 MHz for AT&T, 2100 MHz for the rest of the world, while T-Mobile USA uses 1700 MHz).<br><br>The original iPhone is probably cheaper, slimmer, and can easily be jailbroken.<br><br>One fine point that most people here seem to miss: "Contract free" does not mean "unlocked".
