However, using a custom firmware, of a hacked bios replacement that is only a modified version of the original is. When most people mod their systems, they go the easiest route and choose to install a firmware/bios capable of running pirated Iso's or ROM images. This does not always mean they intend on software piracy. I am a gamer that has never been satisfied with the capabilities of my equipment at time of purchase, and therefore I mod every system I buy. For example, when I had my original Xbox it remained in it's original state for only a few days. I soon replaced the BIOS, not by modifying the original, but by soldering on a DuoX2 modchip flashed with the legal, open-source Cromwell BIOS. It was not capable of running pirated games, it simply allowed me to run a special Debian Linux installation from a 160GB HDD I had put in as well. My point is, not all console mods are illegal. The data on a disk, the firmware on a console, etc. You could "modify" the console by painting it or whatever. However, modifying the SOFTWARE violates the EULA. That license specifically prohibits you from extracting, reverse-engineering and modifying the software. Licenses are part of contract law. It is not legal to break contract conditions.<br><br>So please don't pull out the old "I bought it therefore I can do whatever I want with it" line - you did not buy the software, and therefore you are not allowed to do whatever you want with it.<br><br>Apart from everything else, the DMCA says - if you do anything (anything at all) that circumvents a protection system (DRM included) then you have committed a crime IRRESPECTIVE of a) how you broke the system, b) whether the system was any good, c) whether the system involves DRM or not, d) whether you own the hardware parts or not, and e) your intentions in circumventing the protection system (with some exceptions ... that this guy most definitely cannot claim).<br><br>If people were applying mods that achieved certain effects WITHOUT breaking the DRM system, then I'd have a different view. But no-one does! All modding is done to break the DRM. If you disagree with that, then tell me - how many mods are you aware of that do something, yet don't break the DRM? Yeah, exactly - none. And one wonders how hard the authorities would crack down on modding that didn't involve DRM-breaking and piracy ... I've broken the DRM on my DVD player.  I didn't do it so I could play pirated disks, but because I'm living in a different country now to the one I was in four years ago.  I want to be able to play the DVDs I brought back home in this country, so I broke the DRM on the player. The likely or common usage of an item should never dictate whether it is legal to own because it sets precedent for many applications of that same logical process that are seriously flawed.  Unfortunately, the DMCA is precisely this kind of flawed legislation and there are many other examples of it.<br><br>Consider for instance, the fact that the vast majority of licensed car drivers will drive above the federal speed limit at some point in their lifetimes.  This is clearly breaking the letter of the law (with the exception of fuzzy speed limits in Montana).  Should all cars sold in the United States be required to have speed limitors?  No, because cars can be used on private property.  Also, the ability to drive above the posted speed limit when necessary could save someone's life and would then be a much more important consideration than the minor infraction of speeding.  The likelihood that someone who owns that model of car will (at some unknown time) speed on a public road cannot influence laws pertaining to the design of that vehicle's maximum speed without infringing on personal freedom (and personal responsibility which is inseparable from freedom regardless of what the liberal propaganda machine wants you to believe!).<br><br>Chip modding has other legitimate purposes; the simplest example would be the educational experience from successfully modifying an electronic system ('learn by doing'!).  This 'tinkering' has always been a very valuable process of learning for engineers, scientists, and inventors of all disciplines.  With a continued increase in the complexity of systems, and continued (asinine) increase of laws that prevent us from learning from tearing those things apart... we will face an increase in college dropouts and reducing number of engineer and technical major enrollment. Nothing illegal in obtaining grey imports or playing them. The act is not illegal, but it violates the usage policy.<br><br>@Monkey with Glasses - You don't have to say he copied games, the fact that you have modded the system (an act that you typically only do to avert copyright mechanisms) is enough to draw that conclusion.
