It's just a matter of principle.  Think how many lives were completely ruined when user's Sidekicks stopped functioning for a week.  I'd say anguish and suffering should be worth about $10,000 per user.  Down with evil Microsoft.  Boo.  Hiss. If they claim that your data will be safe, they are at fault.  Also, and I don't understand why this needs to be repeatedly said, the average user does know, nor does not think it is necessary when they are told it will be safe, to back up data on a phone; most don't even know how a cloud network works. This does not mean the information holders are allowed to be reckless with it (e.g., not having a RAID set up).  If they claimed in the product labeling (this includes labeling on the device packaging, in the manual, or marketing literature) or in advertising that the data are suppose to be safe, this will be a slam dunk case and settled out of court for an undisclosed sum (most likely). If they provided themselves an escape clause at any time, this case might get interesting.  I bet the case T-Mobile will probably bring against Microsoft will be even better than these. They will still win in the end, because the monetary value of the data is nil.  <br><br>The inconvenience of having to recover all my lost addresses and phone numbers, passport numbers, and etc (all of that stuff that I keep in one spot one my ohone to make identity theft easier)? What happens if this ball was needed for a big game that guy 2 said he'd provide? Guy 2 therefore looks like an ass and loses money (and respect). If guy 1 has said he'd keep the ball safe, and guy 2 trusted him, he is well within his rights to break balls.<br><br>If you left your mums ashes with your friend, asked for them back as you had a family event where they wanted to see them, and your friend said they were definitely lost, you'd kill him. If 5 days later he said he had them, its regardless; when you needed the item, it wasn't there.<br><br>Or need to pay a bill, so you go to the bank and the ATM says, 'Sorry, your account is lost', no chance of any recompence. You go back to the land lord and you can't pay the rent so you're out on the streets. You go back to the ATM 5 days later and you get your cash, yes you have your money, but its the time that matters.<br><br>These examples are over the top, but thats not the point. While I realize the vast majority of Sidekick users are probably 13 year olds with too much time on their hands, I'm sure there are some legitimate Sidekick owners out there that depend heavily on it working as advertised. If those same people can demonstrate that they reasonably relied on T-Mobile, Microsoft, etc., to manage their data, and missed out on some business transaction/investment opportunity/any other thing of value, because their data was lost, they have a completely legitimate claim. <br><br>Again, I realize that's probably not the case for most Sidekick users, but what if this had happened to all Blackberry/iPhone/Pre users, for example. Prior to this incident I had a serious issue with them...here's the letter I typed up-<br><br>I’ve been a customer of T-Mobile since, 2006 and have been pretty satisfied until now. August 15, 2009, about 11am, my Sidekick3 decided not to pick up a signal. I called customer support AT LEAST 8 times between the 15th and the 17th.  Each time I was told to do a hard reset on my phone, take the battery out, remove my sim card, etc. NONE of those things worked. I eventually went to my menu options…on my own-Menu-settings-network status, and noticed under my network status it said-NOT SIGNED IN. On my 4th call back I SPECIFICALLY asked to be signed into my network. In fact, every call I made after that, I only made that one request (to be signed into my network) and, NO ONE even knew what I was talking about!!! Eventually I was told I needed a new sim card. I walked into a T-Mobile store around 1pm on the 17th and swapped out my sim…that did no good. Long story short, I went thru all the motions, and until about 4pm on the 17th, someone in technical support FINALLY signed me into my network, like I had requested all those times before. Now, I’m PISSED! Not only was I out of a phone for 3 days, missing god only knows how many phone calls, emails, and txt messages, but my phone was put through a series of hard resets which, can’t possibly be good for my device, and resulted in me losing info that I can NOT get back! Had ONE competent rep done what I requested, or actually knew anything other than to B***S*** your customers through phone calls, this issue could’ve been resolved on the 15th!! To make matters even worse, I’m then told “there isn’t much that can be done because, this is a prepaid account”. EXCUSE ME??? NO! I’m going to require something be done! The fact that I’m being pushed aside because my phone is prepaid IS total B***S***! If anything, I should get the SAME IF NOT BETTER treatment because, I technically spend MORE every month than, a contract phone would! I’m more than sure there is a record of how many calls I made to technical support between those dates, as well as, how often I refill my account, and the recorded phone calls where, I CLEARLY  request to be signed into my network….Please take a listen. I honestly can’t believe your technical support team is, so damn clueless, and have the NERVE to be so damn lax on their jobs because, they are dealing with “prepaid” accounts, pppfft! Had I known I’d be treated like a SECOND CLASS CITIZEN, I would have never….NEVER been a T-Mobile customer for, so many years. If this is the type of service I’m to get use to, I will gladly take my money to, AT&T!
