I think Arrington did nothing but offer is persona as a selling means, and now he wants a ridiculous amount of profit on the device 50%.  I bet Fusion Garage would of offered Arrington a reasonable amount of money (10% or less).  Now Arrington is throwing together some bogus and expensive law suit cause he knows Fusion Garage cant afford it, will loose investors and may be forced to Arrington's terms or be forced to go Bankrupt. Bluray players have a much lower spec'ed processors then any Atom, but they use realtime OSes. Its possible that Fusion Garage is using realtime Linux (RT Linux).
