Apple's hook for this device is eBook reading. Apple needs content, and they cannot rely on people making stuff to read at home like they do for apps, nor could they rely on the music industry jumping on-board in order to save their profits from piracy.

So the Big Publishing can pretty much write their own ticket. If Apple plays hardball, then they can easily have their stuff available for Apple's competitors like THAT.

That's what everybody said about music too, but Apple finally won and DRM on music died.

The two situations seem pretty similar to me: A troubled industry that has resisted new technology tooth and nail while independent artists have been taking advantage of it to do an end run around the publishers. The only difference is that book piracy, outside of textbooks, is not as ubiquitous as music piracy was. Uh, do you realize how tiny the ebook files are? It's not a matter of torrenting Catcher in the Rye, it's a matter of kids downloading a single torrent that has Catcher in the Rye along with every other bestseller that's come out in the last 100 years.

That's just it though, I know plenty of people who have illegal epub and pdf copies of books. I'm one of them. I own a huge collection of tabletop RPG books from years ago. I torrented them, and people whom I play with who don't own the books have torrented them. These are spendy books, and the publishers are missing out on profits, and I do think that's wrong. I don't mind drm for my books, as long as that drm is going to be far reaching. Kindle books can go to ipod, PC, probably the ipad and soon macs and blackberry too. So is it drm? yes, does that limit my use of the book? As long as amazon makes decent software for these devices, not really.

When Fairplay was introduced it was by far the most liberal rights management in the industry. Unlimited CD burning, use on 5 computers.

Obviously Apple cares about having the books on the device and publishers want the ability to choose to use DRM or not. What use is a bookstore without any books? How else do you think the big publishers would go along? Just let their books sit there unprotected for everyone to swap for free?

The way iBookstore will work is going to be similar to the early iTunes model - ePub = mp3, m4a; ePub DRM = m4b.

Amazon use Mobipocket DRM for Kindle ebooks, and don't sell any other kind of ebooks, but *most everyone else* uses Adobe's DRM or gives you a choice of which DRM you want.

What this means is, on day one of iPad's release, any ebooks you may have, can't be used on the device.

So anyone who's had any interest in ebooks at all, who's most probably bought at least one, now has to re-buy their books via Apple -- if and when they get published there, at whatever new price publishers choose.

Unlike with the app store, where no apps existed previously so Apple's total dominance was accepted, trying to enter the ebook market by releasing a one-device-compatible DRM format and having to force people to discard their other ebooks, seems to me to be a definitively losing strategy.
