The majority of HTC phones that have been around are mainly Windows Mobile, and Apple isn't even going to dare go after Microsoft. Not to mention, stock prices do not equate as to whether patents are actually valid or not. Apple has a lot of very questionable patents in their portfolio, and if you need proof, google it. It's a similar situation to IBM, and Apple doesn't even have the real muscle IBM ever had. I found it interesting that HTC is being proxied like this at first. But, I have a theory that it's because HTC headlined the start of Android, with the Dream G1. Even though many if not all the patents are totally frivolous nonsense, the laypeople on the jury won't understand just how ridiculous most of these patents are after the tarting up by the legal team that filed the patents. I mean half the things listed were done elsewhere but it appears that Apple added a sentence about doing it on a phone and patented it.
Which is why companies have to build massive IP portfolios, since the best legal defense in this case isn't to try and argue that 20 patents are invalid since the amount of work that would require is insane and the likelihood of you actually getting all 20 invalidated is pretty much zero. You basically have to do what every company dose in this sort of case-sue Apple back by digging through your giant patent chest for a bunch of similarly ridiculous patents. Then everyone signs a cross-licensing agreement and the lawyers win.
I just hope that HTC has large enough of an IP portfolio to win this one, although since it looks like they're really trying to go after all of Android, Google will have to do something to help back HTC up here since a loss for HTC is an even bigger loss for Android.

tekdemon

Comments on

@Flasher T

I lol'd...

James DiBernardo

Comments on

@jonnythan either I'm tired, or you've got something backwards.
