Happy New Year! Now let's sue Apple...

lawsuit storage size

Apple is no stranger to storage complaints over its mobile devices, and while the company successfully dodged a 2007 lawsuit over the advertised storage size of its iPod line, that's not stopping a new group of plaintiffs from attempting to spawn a class action lawsuit (PDF) over the amount of unusable storage space on current iDevices such as the iPhone and iPad. The suit hinges its argument on the fact that iOS 8 takes up more space on each device than previous iOS updates, and therefore renders more internal memory unusable than is advertised.

"Plaintiff upgraded to iOS 8 with the belief that the upgrade would not substantially inhibit his available storage capacity," the suit reads. "Defendant did not disclose in conjunction with upgrades to iOS 8 the additional storage capacity that would be consumed by the upgrade." The complaint goes on to accuse Apple of "deceptive and misleading" omissions regarding the size of the iOS 8 update and the eventual effect on the user.

The suit was filed as a class action complaint, which means plenty of additional plaintiffs can pile on if the case manages to avoid being dismissed.
