Yes you can. Thats pretty much how it works for everyone. When you purchase from the Apple store, you are not asked to sign a contract as all that is done via iTunes. Only if you purchase from the AT&T store, can they push you around and ask you to sign a contract.

Do bear in mind that the next update Apple releases is supposed to break all the hacking done till now. You've been warned ;) That said, enjoy your new iPhone :)
