No matter what Microsoft tells you, no court has ever conclusively found that you cannot backup your own content. That's why they don't really go after you. They aren't pursuing legal action here, just banning the console even though they have more than enough info to go after you.

And yes, count me among the people who buy and copy games. I don't do it this gen because of online play, but I did a lot last gen. Ever heard of XBMC? I still use Xboxes solely for that purpose.

Microsoft is fully within their rights to moderate xbox live. Just as the console owners are free to modify their own consoles. It's all just a cat and mouse game. The only people doing anything wrong are the people who distribute pirated games.
There's an unspoken agreement that says you just tell them it red rings after an hour or so of gameplay. They don't test it that long and just replace it with a refurb.
I'm growing more and more concerned each week that this show just isn't going to get any better. There's detergent running all through this thing.
