Noah's point is valid: what Apple does is called 'conditional sale' and at least here in the EU that's not an open and shut right. It's not so sure that Apple's in the clear here (especially if you consider they don't give away the OS, but sell it)

There's not so much that's new in v.5 – especially things that SHOULD've been present in v.4 already. $50 is steep. I'm not doing it again. I'm spending more on Parallels than on OS X.

MobileMe is overpriced and it sucks. And when you complain they tell you to read the EULA saying they don't guarantee the service.
Apple needs to shape up.
