Things are not as cut and dry as the Joystiq writer and their legal adviser claim, and a lot more complex than the American readers believe it is.

The situation outside of America is a little more pro consumer. Many countries have consumer laws that state that "the goods must be suitable for the intended use". The only place the consumer laws were tested in a court battle was in Australia (though MANY countries have the same basic law), and Sony who took the case lost spectacularly in court when they tried to sue the "pirates".

There may be little reason to Mod a unit in USA, but outside USA, things get a lot more messy. If you purchase a region locked DVD, a region locked Game from an online store, more often than not that store is based in USA, and the wrong region. The DVD/game will not work unless you mod your hardware. You also have many advertised games taking up to six months to be released for the "European Market". The Europeans need a lot of translations, so it supposedly takes a lot of time. Unfortunately, most of the rest of the world falls under "Europe" for distribution even if they are literally on the other side of the world and ONLY speak English. Finally, there are a number of games every year that NEVER and will NEVER be released for the "European Market". The decision is made never to release these games for all sorts of reasons. The only way to play these games in many cases (I do not know about XBox 360 because I will never again purchase anything made by Microsoft) is to mod your console.

This does not cover the many other reasons you may want to play a pirated game. Such as you have young children who destroy game disks, so keeping the original locked away while the children are destroying a copy is a good idea. Microsoft does nothing at all to protect your investment in the software. They d not have anti scratch coatings on DVDs, they use DVD, one of the most vulnerable formats to child abuse in existence, they only license software to you so if the format is damaged by children you should still own your license, but Microsoft do not offer free media swaps or any other way for you to continue to use the software you licensed.

Simply Joystiq, to claim this is cut and dry is CHILDISH! How much is Microsoft paying Joystiq for this hatchet job today?

I would have to disagree with you on the timing. Apple used to be an evil company in the '80s that loved closed systems, lockout and high prices.

Apple became an open company in the '90s allowing easier access for programmers, licensing Mac compatibles and engineering some of the more revolutionary Apple products.

In the late '90s Apple killed off Mac compatibles, and locked down much of the system again. During this time they also engineered the iPod which was a completely closed system and worked on tying it to iTunes.

If you know your Apple history, you will know that the evil periods of Apples history coincide with Steve Jobs position as top dog. The non evil period is when Steve had been given the boot.

Simply stated Microsoft NEVER invented new UI. They spent the first 15 years copying UI from the Amiga, BBC Micro Risc OS, Suns Solaris, HP-UX, SGI UNIX System V, IBM OS2 and BeOS.

For the past decade, Apple has been blatantly ripping off UI and tools from the Amiga for use in OSX. Apple have been doing a very poor job of this. So by copying Apple, Microsoft are still copying the Amiga by default.

Strange how all the Microsoft fanatics of the early 90's who claimed that no one could ever use multitasking, a colour WIMP interface, games, and 50 other advanced features (that WERE NOT invented by Apple), all seem to find those features essential today.
Haha. I have been attacked by Linux freaks repeatedly every time I have tried to explain that Microsoft has not really started the FUD campaign before. The Linux freaks also wholeheartedly believe the Microsoft FUD of 1990 about the far far superior (still superior to every current OS in existence, even after 20 years have passed) Amiga and its Workbench OS.

Everything Linux freaks "BELIEVE" they know about the Amiga comes straight from the Microsoft playbook. The Amiga had to take this Best Buy tactic, but across the board. Every computer consultant, every distributor, every salesman. They were all coached to repeat the same lies.

And Linux fanatics today refuse to look at the way the Amiga did things t help the UI and functionality of Linux, because the Amiga was "Just a Games Machine" or "Was just a toy" or "Was not Lotus 123 compatible", or "Graphical UIs are for children" or "Multitasking is of no use, computer users can only do one thing at a time".

Just wait until Microsoft really get their negative PR machine running.

It is strange that mac people seem to be everywhere. In my experience as an ex mac user, they are people with no lives. The same people keep hanging around the same high profile places because they actually have nothing better to do.

The Pre for me was going to be a no brainer, then I saw there was no Micro SD slot. That is a deal breaker. I am a mac hater (for many very good reasons) and I will never buy an iPhone because I am sick of the traps Apple build into their equipment. The lock in totalitarianism is the main reason. So I am in the market for an "Apple Hater phone". Why no expandability? That is Apples territory... "Haha insignificant mortal. There is no way to add your own software!", and "Upgrade when we tell you to upgrade, or die!".

Though I doubt that the Pre has those "annoying to the point of wanting to cave their faces in with a mallet" fanatics. Quite possibly the best reason to avoid everything Apple like the plague it is.
