  • Apple sued for renting HD videos to older iPhones

    When it comes to digital up-selling in the iTunes store Apple's default of suggesting HD video when buying video content has landed the company in hot water. When you go to purchase a video in iTunes, the first option presented is the more expensive HD content, US$1 extra, even if you're using an iOS device that doesn't support HD. A Florida lawyer has filed a class action lawsuit against the company after he rented the more expensive HD copy of Adam Sandler's Big Daddy from the iTunes store in 2010, only to find the standard-definition version delivered to his non-HD device. To a degree, you can say "buyer beware" as users with older devices deal with the digital landscape moving to higher-resolution defaults. However when iTunes 8.0 was released in 2010, HD became the default option in the iTunes store, leading customers like the plaintiff in this suit to pay extra for a feature they couldn't use and weren't aware of. The complaint states: Despite the fact that Apple makes the HD version of the content offerings the default rental option, Apple failed to disclose to customers using SD Apple mobile devices that the device could not play the HD content being rented, and that the customer was needlessly paying the premium for the HD option. Apple has since added a disclaimer to the download process, but the case is seeking restitution for what is sees as unjust charges applied to devices Apple knew couldn't play the files. Given the popularity of the iPhone 3G, it's plausable to imagine large numbers of people accidentally downloaded HD content they couldn't get the most out of before Apple added the disclaimer.     There's an interesting easter egg in the new Borderlands 2 DLC, Captain Scarlett and Her Pirate's Booty. The iconic Big Daddy (AKA Mr. Bubbles) from the BioShock series makes an appearance at some point in the add-on adventure and – well, we don't want to ruin it for you. In the interest of spoilers, we've embedded the video showing off the Pandora version of everyone's favorite child social worker past the break.

    2K Games is currently holding a contest to see who can capture the "craziest" occurrences while playing BioShock 2. Mind you, the contest's definition of "crazy" isn't referring to that time you found a hilarious bug, or that time you got a 20-kill streak while playing online. Rather, the contest is looking for "I froze a Big Daddy, levitated him into the air, stuck a rocket on him, and sent him flying into a group of unaware Splicers." For a hint as to what your entries should look like, watch the video posted after the jump. The prize for the craziest video is a crisp, presumably novelty-sized check for $5,000, as well as a life-sized Big Daddy suit. Yes, the suit from this video. Yes, it's probably covered in the blood of 2K Marin's programmers. No, they probably won't clean that off for you.

    It would be cool enough to see a ten-minute-long video showing a man carving an intricate statue of BioShock 2's Big Daddy out of a tree using a chainsaw. That coolness factor is multiplied by ten when the person doing the carving is dressed up like known overnight camp murderer, Jason Voorhees. A video like that would finally prove that the prolific butcher has a sensitive side, capable of creating lovely, intricate works of art with his manslaughter instruments.   • 2K unboxes the extremely rare $15,000 version of Bioshock 2

    The $99 special edition for Bioshock 2 is a stylish little bundle, replete with art deco flyers and a record containing the game's atmospheric soundtrack. The video after the jump features an all-inclusive unboxing of the package, courtesy of 2K -- however, it also includes the world-exclusive reveal of the game's "Uber Edition," which costs $14,999, and only includes a copy of the undersea action title, and a real life Big Daddy. We're still trying to make sense of this whole thing. Why would 2K expect anyone to pay 15 grand for a single game? Is it even legal to sell an actual sentient being in this manner? What are the ramifica ... what's that? It's a joke? Oh, yeah, that makes a lot more sense. Thank goodness.

  • BioShock 2 Cult of Rapture site hangs its 'Subject Delta'

    Bringing to a close the BioShock 2 "Artist Series" over at the Cult of Rapture website is the image seen above, dubbed "Subject Delta." Painted by Julie Bell and Boris Vallejo, the piece epitomizes the little we know about the upcoming game, with Splicers looking more gruesome than ever and a flood of ocean water just moments from washing everything away.     Sometimes an idea is just so good, you can hardly believe you came up with it. That must be how Harrison Krix felt after creating the elaborate and awesome Big Daddy costume you see above -- not since BioShock released have we been so eager to heap praise on something. Well, Mr. Krix, we hope you suffocate on our affection, because taking your costume to the Georgia Aquarium for some underwater snapshots has to be the best idea ever. If you're scratching your head, wondering just where you've seen these two before, let us help you: right here on our website. Krix's girlfriend (holding another of his creations in the pic above, the ADAM syringe) is quite the cosplayer, which initially got Krix into the game of making things from games. Take notes, gents!   • How to build a Big Daddy costume, in many complicated steps

    Eager to spend a few hundred hours toiling away on some heavy clothes that'll probably hurt like crazy when you wear them, and will definitely make you look like a grotesque monster? Yeah, okay, we are too. This BioShock Big Daddy costume built by master game prop fabricator Harrison Krix is just that great. Krix thoughtfully provided step-by-step instructions so you can attempt to fabricate your own Big Daddy. It's mostly made from an insulation-foam and cardboard skeleton, covered with expanding foam, with one of those domes from a ceiling-mounted security camera for the head and custom-molded resin details. And then there's ... the articulated cardboard-and-PVC animatronic hand. Okay, maybe the fact that he's shown how he did this doesn't necessarily mean we can do it. [Via Sidequesting; Thanks, Dali!]

    GamePro is promising that its upcoming July issue will blow the doors off of the sequel to 2K's undersea shooter, BioShock. Of course, by the time it hits newsstands, you'll probably be full to the gills with all the the BioShock 2 details you can handle -- we're sure to hear a ton about the game during E3.Fortunately, GamePro recently offered a delicious morsel to its potential readers, uploading the Big Daddy-infused cover of the upcoming issue to the mag's online edition.   • BioShock movie gets budget cut, 'in a holding pattern'

    The bad economy just won't stop showing up in our news posts these days. First we get predictions of months of down sales, and now we get news that the Gore Verbinski directed BioShock film adaptation is stuck "in a holding pattern." Variety is reporting that Verbinski and production company Universal are looking at possibly moving the currently in pre-production film to outside the US to "take advantage of a tax credit," allegedly looking at moving production to London from its current Los Angeles locale. Additionally, according to Variety's sources, some of the pre-production staff has been let go while the budget restructuring takes place. The studio (and Verbinski himself) have vowed to not allow the BioShock movie to succumb to the same fate as the perpetually on-again, off-again Halo film. As BioShock is one of the few games we could actually see making a really interesting film, we're hoping they're not just pulling our chain. [Thanks, Aaron!]

Players take control of the very first Big Daddy, and will be able to use plasmids while still donning its iconic drill.     Thanks entirely to this recent second Christmas of a deal I finally picked up Bioshock and am giving it a play through. Now you, Inconstant Reader, probably expect me to launch into some pseudo-thought-provoking analysis of the moral conundrum involving the Little Sisters, or to give the reigns to my inner philosopher who wants to debate the pros and cons of a Randian worldview. Though it may take all the will I can muster, I shall refrain from doing so. You can find a plethora of views on these subjects out there on the interwebs without my adding to the cacophony. Instead I'm going to discuss what's interesting about coming to the game having already navigated said cacophony. No real spoilers, but some talk about what spoilers - like honey - don't spoil. Wrap your head around that one.

  • Rumor: Bioshock headed to the Mac

    Is there anyone out there who doesn't have a PC, or a console, or a Windows partition on their Mac, or was just somehow able to avoid the critical, cultural, and widespread success of 2007's amazing Bioshock? If so, you're in luck -- while console gamers are breathlessly waiting for Bioshock 2 updates, Mac gamers are still waiting for the first one, and the wait might finally be over. Macworld is reporting that a little birdie (read: back of a t-shirt) at last week's show told them that Bioshock was finally headed to the Mac, courtesy of Feral Interactive.Too little, too late? Don't get us wrong: Bioshock, the spiritual successor to System Shock and its sequel, is a terrific game, combining FPS gameplay with RPG elements and one of the best videogame stories of 2007. If you haven't played it and you're willing to pick it up for the Mac, you're in for a treat. But these kind of releases just perpetuate the issues with Mac gaming: games come out years late, no one buys them (because everyone who cares has already played them elsewhere), and then developers complain that games don't sell on the Mac. A Bioshock announcement is all well and good, but next time, devs, would you kindly aim for release a little closer to everyone else?

  • BioShock PC install limits removed, DRM remains

    Big Daddy is now free to roam on as many PCs as possible. According to 2K Community Manager Elizabeth (via 2K Forums), BioShock for PC can now be installed on as many computers as you want. The SecuROM protection still remains, however, and you still need to both activate the game upon installation and keep the disc in the tray.Elizabeth does provide some assurance to those who worry about the DRM. "I believe, as you seem to, that BioShock will be the kind of game we will want to revisit 5, 10, 15 or more years from now. I want my copy to be playable, just as you do, and so does 2K," she said. We know Mr. Bubbles would be happy, and we'd hate to see him feeling otherwise.

    As PC gamers patiently wait to play Will Wright's latest creation, Spore, they've recently had a chance to tinker with the Spore Creature Creator to test the customization options of the game. As expected the first monsters created were intentionally NSFW but some gamers took the opportunity to get creative. Using the PC tool gamers have recreated the Big Daddy from 2007's critically and commercially acclaimed BioShock.
