We say was because CEO <a href="http://www.engadget.com/2005/02/14/the-engadget-interview-michael-malcolm-ceo-and-founder-of/">Michael Malcolm</a> is now saying the California 6th District Court of Appeal has issued a temporary stay of that injunction. The court is still deciding whether or not to stay the injunction during the entire process, a decision Malcolm says could affect whether or not the company survives or has to lay people off. While the current case does not affect Kaleidescape's tethered <a href="http://www.engadget.com/2010/12/13/kaleidescape-launches-100-disc-blu-ray-movie-server/">Blu-ray servers</a>, it's tiring to hear about all this from the DVD CCA over a DRM scheme that was cracked wide open so long ago, and a <a href="http://www.engadget.com/2004/12/08/dvd-copy-control-association-sues-kaleidescape-for-selling-dvd/">case</a> that had <a href="http://www.engadget.com/2007/03/30/kaleidescape-escapes-dvd-ccas-wrath-in-court/">appeared</a> to be over.<p style="padding:5px;background:#ddd;border:1px solid #ccc;clear:both;"><a href="http://www.engadget.com/2012/04/02/kaleidescape-dvd-servers-granted-a-temporary-stay/">Kaleidescape DVD servers granted a temporary stay</a> originally appeared on <a href="http://www.engadget.com">Engadget</a> on Mon, 02 Apr 2012 01:36:00 EST. Things get appealed and what was a favorable ruling can become your worst nightmare five years later. That's what the folks at <a href="http://www.engadget.com/tag/Kaleidescape/">Kaleidescape</a> are facing if the latest tentative judgement in its case vs the DVD Copy Control Association, which licenses DVD's defunct copy protection, CSS. <a href="http://www.engadget.com/2007/03/30/kaleidescape-escapes-dvd-ccas-wrath-in-court/">Last time around Kaleidescape was on the other side of the ruling</a> with the Judge agreeing that there was no violation of any terms of service. This time around? Not so much. It would mean a shift in legal DVD servers, but we'd imagine Blu-ray takes up most of the market by now anyway. Currently Kaleidescape's Blu-ray products authenticate the disc <a href="http://www.engadget.com/2010/12/13/kaleidescape-launches-100-disc-blu-ray-movie-server/">is in the vault</a> before playing, and its CEO has testified modifications could be made to the DVD products within a few months. Two years after launching its <a href="http://www.engadget.com/2009/09/10/kaleidescape-joins-the-iphone-as-a-remote-party/">iPhone remote</a>, <a href="http://www.engadget.com/tag/kaleidescape">Kaleidescape</a> has brought a new iPad app to CEDIA 2011 that gives owners of its <a href="http://www.engadget.com/2010/12/13/kaleidescape-launches-100-disc-blu-ray-movie-server/">media servers</a> full control of their media from anywhere in the house. Users can browse their collections based on various metadata, jump directly to favorite scenes of stored movies, or control displays and audio in other rooms of the house. Also new for 2011 is support for <a href="http://www.engadget.com/tag/ultrawidescreen">2.35 widescreen viewing</a> with its CinemaScape feature, a software upgrade that can automatically process the video internally and reformats the UI as well. Check after the break for a quick demo of the iPad app which will launch later this year as a free add-on -- assuming you can afford the hardware of course.<br />

Kaleidescape has fulfilled its promise of launching the industry's first Blu-ray server by releasing its new 100-disc Blu-ray disc vault we <a href="http://hd.engadget.com/2010/09/26/kaleidescape-shows-off-a-new-kid-friendly-remote-menu-system-bl/">saw at CEDIA</a> that, when paired with its <a href="http://www.engadget.com/2010/05/11/kaleidescape-outs-m300-and-m500-blu-ray-players-copiers/">M300 or M500 players</a>, can rip, store, and stream copies of Blu-ray movies throughout the home. However, despite its pricetag of $1,495 (plus $2,500+ for the player) there's still  some serious restrictions -- each disc vault has to be connected to an individual player, and the discs have to remain in the vault for the player to stream their ripped copies over the network. <a href="http://www.engadget.com/2010/05/11/kaleidescape-outs-m300-and-m500-blu-ray-players-copiers/">Sony's 400 disc changer</a> can store more movies, but this should load them faster and offer easy browsing with cover art and title info. Despite the <a href="http://www.engadget.com/2009/08/13/kaleidescape-gets-in-line-behind-realdvd-for-rough-treatment/">legal hoopla</a> related to its DVD ripping practices, Kaleidescape is still releasing high-end media servers designed to save the rich (and now their spawn) from the hassle of opening a movie box. The Cinema One is its latest and most affordable creation to date, but still costs a hefty $4,999. For the most part, the server is just a cheaper replacement to 2009's <a href="http://hd.engadget.com/2009/03/03/kaleidescape-intros-whole-home-mini-system-cuts-prices-on-oth/">Mini System</a>, that can store up to 225 DVDs or 2,500 CDs for instant access. It also sports the same hassle-free setup, but adds a new wrinkle in the form of kid-friendly features. Specifically, a junior remote is included in addition to the standard version, which triggers a simplified system UI anytime it's used. While we're all for toddlers being able to watch their favorite content too, at this price we'd have rather seen support for Blu-rays and dare we say Netflix streaming. Then again, we aren't in the best position to judge the value of a digital babysitter. Besides being a thorn in the side of the MPAA, <a href="http://www.engadget.com/tag/Kaleidescape/">Kaleidescape</a> is all about letting its owners play back their movies as quickly and easily as possible, and showed off a couple of new products to that end this week at <a href="http://www.engadget.com/tag/cedia2010">CEDIA</a>. As <a href="http://www.engadget.com/2010/05/11/kaleidescape-outs-m300-and-m500-blu-ray-players-copiers/">promised</a>, it showed off a disc loader due later this year designed to rip and hold on to your Blu-ray discs while it actually plays them back not from the disc, but as images. Convoluted, but necessary to work around the rules in place. Enjoy copying DVDs onto $5,000 boutique home servers? If you've got the dough, <a href="http://hd.engadget.com/tag/ReQuest/">ReQuest</a> has got you covered -- CEO Peter Cholnoky says that even if California courts make the practice illegal, his firm isn't afraid to push back. When <em>CE Pro</em> asked whether he was concerned about the fallout from the <a href="http://www.engadget.com/2009/08/13/kaleidescape-gets-in-line-behind-realdvd-for-rough-treatment/">Kaleidescape lawsuit</a>, he said, "Nope, should I be?" adding that ReQuest could convert <a href="http://hd.engadget.com/2008/08/29/request-intros-media-servin-intelligent-media-client/">existing equipment</a> to use third-party DVD-copying software "in two seconds" should the courts try to shut him down. Given that the company's new $1,200 MediaPlayer (above) doesn't have the requisite DVD drive for ripping discs anyhow, that sounds an awful lot like braggadocio, but we have to say we love Peter's stick-it-to-the-man tone. <a href="http://www.engadget.com/tag/Kaleidescape/">Kaleidescape</a>'s just announced another line of high end home entertainment products -- this time it's the M300 and M500 Blu-ray players. The M500 also boasts Blu-ray copying abilities, too -- allowing you to import Blu-rays, DVDs and CDs onto your server at home. In an interesting decision, Kaleidescape will require that the physical Blu-ray disc be present for playback from the server -- which, you may be thinking, rather defeats the purpose, doesn't it? Pretty much. Thankfully, Kaleidescape's got a disc loader in the works which will allow you to keep a "large number" of discs ready in the system for faster loading. The loader itself isn't expected to be ready for retail until the first half of next year, but you can grab the M300 and the M500 beginning May 18th, with the M300 running $2,495 and the M500 at $3,995. You just know that the DVD CCA (Copy Control Association) appealed the <a href="http://www.engadgethd.com/2007/03/30/kaleidescape-escapes-dvd-ccas-wrath-in-court/">2007 ruling</a> that allowed Kaleidescape owners to rip DVDs to their media servers, and yesterday a California Appeals Court overturned that ruling. Next stop -- the Santa Clara Superior Court, which could place an injunction on Kaleidescape if the appeal is upheld. It's not over yet, but we're prepping the soundboard with ominous music, boos and noisy hand-wringing. Our hearts were aflutter at the sight of a new <a href="http://www.engadget.com/tag/Kaleidescape/">Kaleidescape</a> product today, but alas, it wasn't the fabled <a href="http://www.engadget.com/2009/03/02/kaleidescape-still-on-track-to-deliver-a-pricey-blu-ray-player-t/">Blu-ray player</a> we were hoping for. Instead, we're getting the cutely named Mini System, which bills itself as a complete multi-zone entertainment server for those with oodles of cash and a thing for ease-of-use. The device is the company's first to combine the player <em>and</em> server functionality into one unit, and it's also the firm's first product to ship with a remote control. With installation "as ease as an ordinary DVD player," the system contains space for DVD and CD storage as well as a main "Player" zone and two music zones; those wishing to expand things can tack on more Mini Systems or additional Players / Servers. Apparently unfazed by the fact that its target demographic openly <a href="http://www.engadget.com/2009/02/28/even-the-nbas-shawn-marion-thinks-blu-ray-discs-are-too-expensi/">disses</a> the Blu-ray format, Kaleidescape is moving ahead with <a href="http://www.engadget.com/2008/02/05/kaleidescape-to-gain-blu-ray-support/">plans</a> to deliver a Blu-ray player by the end of 2009, says the company CEO. We always suspected claims that the Mini Player's DVD upscaling "<a href="http://www.engadget.com/2008/06/18/kaleidescape-claims-new-1080p-upscaling-dvd-players-rival-blu/">rivals Blu-ray</a>" was a bit of a reach, even given the $3,000 price. Sadly, when the "doesn't have to rival Blu-ray, because it is Blu-ray" deck comes out, though, the ripped-for-whole-home-use joy you might expect from <a href="http://www.engadget.com/tag/Kaleidescape/">Kaleidescape</a> will have to wait -- on deck for initial delivery is CD and DVD importing, but Blu-ray discs will be playback only for now (with Kaleidescape remaining "optimistic" that Blu-ray import gets support somewhere down the road). For as ludicrous as we think the prices are on Kaleidescape's latest <a href="http://www.engadget.com/2008/09/05/kaleidescapes-1080p-player-mini-player-hands-on/">upscaling DVD players</a>, the company is clearly doing something right. A recent release from the California-based outfit asserts that it achieved a three-year sales growth of 747% from 2004 to 2007 and ranks 415th on the 2008 <em>Inc. 500</em> list of America's fastest-growing private companies. And we're not surprised. The company's <a href="http://www.engadget.com/2008/09/05/kaleidescapes-1080p-player-mini-player-hands-on/">kiosk was buzzing</a> with prospective buyers at this year's CEDIA, and while only the affluent can afford to even sniff the wares this company is slinging, there's no denying <a href="http://www.engadget.com/2008/06/18/kaleidescapes-overpriced-upscaling-dvd-players-gets-reviewed/">the quality</a>. <a href="http://www.engadget.com/tag/realnetworks">RealNetworks</a>, the company you love to hate, is back with a new product sure to capture the attention of Hollywood and its MPAA thugs. For $30, RealDVD plans to do what <a href="http://www.engadget.com/search/?q=dvd%20jon">DVD Jon</a> enabled years ago -- namely, making digital copies of your DVDs. All angst aside, we did stop by the outfit's CEDIA booth to see just what was crackin' and to snap a few photographs all the while. That being said, the folks over at <em>Sound &amp; Vision</em> put the <a href="http://www.engadget.com/2008/06/18/kaleidescape-claims-new-1080p-upscaling-dvd-players-rival-blu/">pricey pair</a> through the paces, and they were actually quite pleased with the results. In a nutshell, it seems that reviewers found the best upscaling DVD players this planet has to offer, and while all the fawning over their pristine reproduction of colors was fine and dandy, it's the value proposition here that's absurdly out of whack. And you thought Toshiba's <a href="http://www.engadgethd.com/2008/05/30/toshiba-knows-no-shame-plans-to-release-super-resolution-dvd-pl/">super-resolution DVD player</a> taking on Blu-ray was comical. <a href="http://www.engadgethd.com/tag/Kaleidescape/">Kaleidescape</a> -- the company famous for selling grossly overpriced (albeit fanciful) DVD / BD <a href="http://www.engadgethd.com/2008/02/05/kaleidescape-to-gain-blu-ray-support/">archiving systems</a> for wealthy home theater junkies -- has just announced two new standalone DVD players that "provide a viewing experience that rivals Blu-ray." The argument goes something like this: there are 170,000 titles on DVD, and "just 6,000" (wait, for real?) on BD -- why support the next-gen format when these two upscaling DVD players display content that is utterly indiscernible from Blu-ray. For starters, the outfit is launching the 1080p Player (pictured), which earns the "ultimate DVD player" label by featuring a Sigma Designs Gennum VXP chip, 10-bit processing and full support for Dolby Digital, DTS, MPEG and PCM audio formats. The 1080p Mini Player offers the same, but in a tinier package meant for inconspicuous installations. Granted, both units <em>do</em> have exclusive access to Kaleidescape's Movie Guide database, but that hardly justifies the $4,295 / $2,995 price tags (in addition to the required $10,000 Kaleidescape System). And you thought Toshiba's <a href="http://www.engadget.com/2008/05/30/toshiba-knows-no-shame-plans-to-release-super-resolution-dvd-pl/">super-resolution DVD player</a> taking on Blu-ray was comical. <a href="http://www.engadget.com/tag/Kaleidescape/">Kaleidescape</a> -- the company famous for selling grossly overpriced (albeit fanciful) DVD / BD <a href="http://www.engadget.com/2008/02/05/kaleidescape-to-gain-blu-ray-support/">archiving systems</a> for wealthy home theater junkies -- has just announced two new standalone DVD players that "provide a viewing experience that rivals Blu-ray." The argument goes something like this: there are 170,000 titles on DVD, and "just 6,000" (wait, for real?) on BD -- why support the next-gen format when these two upscaling DVD players display content that is utterly indiscernible from Blu-ray. For starters, the outfit is launching the 1080p Player (pictured), which earns the "ultimate DVD player" label by featuring a Sigma Designs Gennum VXP chip, 10-bit processing and full support for Dolby Digital, DTS, MPEG and PCM audio formats. The 1080p Mini Player offers the same, but in a tinier package meant for inconspicuous installations. Granted, both units <em>do</em> have exclusive access to Kaleidescape's Movie Guide database, but that hardly justifies the $4,295 / $2,995 price tags (in addition to the required $10,000 Kaleidescape System). The high-end world of <a href="http://www.engadget.com/2008/02/05/kaleidescape-to-gain-blu-ray-support/">multi-terabyte media servers</a> is usually well beyond our interests as some of them cost more than we make in a year, but we do like to dream. The upgrade costs for HD fans that're making the transition from DVD to Blu-ray might be a hard $400 pill to swallow for some, but if you want to store all your movies on a disk so they're available on demand, you'll have to be willing to spend much, much more. On a post on Automated Home, a masked installer confesses that "Right now I'm selling next to no servers at all....and the reason is that everyone wants a "High Definition" server." We can't say we blame 'em, seriously, once you take a look at Blu-ray on a nice display, it's hard to go back to DVD -- even if it means you'll have instant access to your entire library. When we spoke with Kaleidescape representatives at CEDIA last year, they had absolutely no idea when HD DVD or Blu-ray would be supported in their systems. Fast forward a few months, and we may have an answer. An anonymous tipster from <a href="http://www.kscapeowners.com/"><em>Kscapeowners</em></a> has informed us that <a href="http://www.engadget.com/2007/03/30/kaleidescape-escapes-dvd-ccas-wrath-in-court/">Kaleidescape</a> will be announcing to dealers in the not-too-distant future that Blu-ray support will be added. Of course, it's also noted that some studios may charge more for the right to copy Blu-ray Discs to a Kaleidescape system, but it's not like that was unexpected. As if you weren't scootin' around the <a href="http://www.engadget.com/search/?q=aacs">AACS</a> protection on your high definition films already, the finalized spec for the Advanced Access Content System could be delayed even further thanks to the somewhat <a href="http://www.engadget.com/2007/03/30/kaleidescape-escapes-dvd-ccas-wrath-in-court/">surprising ruling</a> given in Kaleidescape's recent ruling. According to Michael Ayers, a senior attorney with Toshiba America Information Systems who also manages the group that licenses AACS, there will "absolutely be increased scrutiny of the AACS documents after this <a href="http://www.engadget.com/2004/12/08/dvd-copy-control-association-sues-kaleidescape-for-selling-dvd/">court decision</a>," meaning that managed copy decisions could continue on the perpertual delay path its already on. The firm's DVD ripping / streaming jukebox was under fire for obvious reasons, as it not only encouraged the ripping of "protected content," but it helped users rip and transmit the data around their network. The DVD CCA whined that the machine "breached a contract" when it crafted a product that enabled users to copy its locked-down material onto hard-drive based servers -- the judge, however, felt otherwise. In fact, it was ruled that "nothing in the DVD CCA licensing agreement prohibits the development of products that allow users to copy their DVDs," thus, no contract was breached at all. Not a lot of companies have the brass to call a $10,000 media server their "entry-level" product, but the <a href="http://www.engadget.com/search/?q=Kaleidescape">Kaleidescape</a> peeps practically pity the weak-sauce consumers who can't pony up the $30k for their flagship server. According to COO Cheena Srinivasan, their new 1U server is "catering to the several hundreds of prospective customers that have witnessed a Kaleidescape demo, and the $30,000 configuration was a little too steep." Can't you just hear the derision drip? For the piddling sum of $10,000 you can now get the rack-mountable server with dual 250GB HDDs, which connects to your TV for flashy media browsing. Oddly, you have to choose between movie or music server functionality, or "upgrade" to both for $2,735. Another configuration is available for $17k that includes three 750GB discs and plays back both formats. The introduction of 750GB drives also means that if you make the <em>right</em> choice and spring for the full-fledged server, you can manage 8.25TB of storage.
