<generator>Blogsmith http://www.blogsmith.com/</generator><item><title><![CDATA[Aereo gets unfair competition claim dismissed, still faces two claims of copyright infringement]]></title><link>http://www.engadget.com/2012/05/21/aereo-gets-unfair-competition-claim-dismissed/</link><guid isPermaLink="true">http://www.engadget.com/2012/05/21/aereo-gets-unfair-competition-claim-dismissed/</guid><comments>http://www.engadget.com/2012/05/21/aereo-gets-unfair-competition-claim-dismissed/#comments</comments><description><![CDATA[<p style="text-align: center;"> <a href="http://www.engadget.com/2012/05/21/aereo-gets-unfair-competition-claim-dismissed/"><img alt="Aereo gets broadcasters unfair competition claim dismissed, still faces federal wrath for copyright infringement" src="http://www.blogcdn.com/www.engadget.com/media/2012/05/aereoantennaarray2.jpg" style="margin: 4px; width: 450px; height: 299px;" /></a></p><p> Aereo's mini-antenna arrays started streaming OTA television broadcasts <a href="http://www.engadget.com/2012/03/14/aereo-tv-broadcast-streaming-service-nyc-launch/">in Gotham</a> a couple months ago in spite of the <a href="http://www.engadget.com/2012/03/01/aereo-antenna-tv-lawsuit/">lawsuit</a> filed by a few of New York's local stations to stop them from doing so. Today, it was able to dismiss its opponents' state law unfair competition claim under the theory of federal preemption. Essentially, Aereo argued (and the judge agreed) that the anti-competition claim was actually an attempt to vindicate the broadcasters' rights to control the performance of their copyrighted materials. Because those rights are granted under federal law, the state law claim was preempted and dismissed from the lawsuit pursuant to the Copyright Act. Despite this courtroom victory, Aereo still has a lot of legal legwork to do, as it still faces two copyright claims that could still shut down the OTA streaming party. New York City and the Tri-State area, Los Angeles, Tampa, Orlando and Philadelphia will be among the first to get the service, with growth to more cities pledged for the future. On this occasion, Mayor Bloomberg &amp; Co. have introduced a novel way for citizens of <a href="http://www.engadget.com/tag/NYC/">The Big Apple</a> -- and others who plan on making the move -- to find jobs in the technology sector. Dubbed "Made in New York Digital Map," the service aims to make it easier for folks to see which tech companies are seeking engineers, designers, developers, etc. At the moment there's more than 325 outfits looking for new hires, with over "thousands of jobs" being up for grabs. <a href="http://www.engadget.com/tag/MayorBloomberg/">Mayor Bloomberg</a> says this is only the beginning and he's encouraging startups to set up shop here in the City, as he believes this "is the place to be if you're a growing tech startup." Xcom's calling its new venue a "satellite customer service center," enabling flyers to swing by before they depart JFK (or LGA, we guess) and pick up a global MiFi. Rather than being positioned within an airport, this one's located near <a href="http://www.engadget.com/2011/12/09/apple-just-arrived-at-grand-central-station-we-hop-aboard-vide/">Grand Central Station</a> at the offices of Amnet New York on Madison Avenue, and in case you've forgotten, $12.95 per day (and up) can snag you a wireless data device capable of connecting in some 195 countries. Imagine his surprise when he <a href="http://www.engadget.com/2012/03/18/new-yorks-chinatown-fair-re-opening/">ran into Lonnie Sobel</a>, the famous amusement hall's new owner, stocking it with new game cabinets. It's been a few months since Vincent's discovery, but Chinatown Fair finally reopened its doors over the weekend. Old regulars may want to brace themselves, however, Sobel's playing a <em>different </em>game.</p><p> "We're kind of a cross between a Dave &amp; Busters and a Chuck E. Cheese," the new owner told <em>Gothamist</em>, "We're trying to do the best of both worlds." Sobel's hoping to merge the old Chinatown Fair's culture of fighting games with an assortment of family friendly amusements: skee-ball, air hockey, <a href="http://www.engadget.com/tag/guitar+hero/">Guitar Hero</a>, hoop basketball and a counter for redeeming tickets for prizes. The new Fair will also sell game time for use on a Xbox 360 and games like Call of Duty, played on one of two flat screen televisions. Not all of the old arcade's former regulars are happy with the changes, but, as Vincent noted, they "say they're just happy it exists." One-click access will be available to those with a Boingo subscription as well as through the outfit's roaming partners: Skype, Sprint, T-Mobile and Verizon. Right now, the plan is to roll out the new service to subway stations over the next five years. No, not the <a href="http://www.engadget.com/2012/04/03/nokia-lumia-900-review/">Nokia Lumia 900</a>, which made an appearance in several forms at the <a href="http://www.engadget.com/tag/WindowsPhone/">Windows Phone</a> event in New York City's Bryant Park today, but Kourtney Kardashian, who drew crowds to the Free-Time Machine -- that fled just as quickly as they arrived. The reality TV star far overshadowed the Windows Phone experience, which is on display in several cities across the US today. New Yorkers can visit Bryant or Madison Square Parks for a chance to flick through some Metro tiles on a Lumia 900, and play to win gift certificates and other prizes -- and in the case of one ecstatic youngster, a day with the above-mentioned celebrity and a $5,000 gift certificate. There were also a few smartphone giveaways on order, along with some "free time" prizes, like a dog walker gift certificate or a chance to skip the line (saving "60 minutes") at the city's Shake Shack burger joint. This isn't the first time we've seen an oversized Windows Phone <a href="http://www.engadget.com/2011/11/07/microsoft-installs-biggest-windows-phone-ever-in-nycs-herald/">drop by Manhattan</a>, and it's probably not the last. Obviously, in the age of the ubiquitous smartphone, most of them go untouched -- though, usually that has more to do with some mysterious substance covering the handset. The city is preparing to update this urban staple by replacing the touch tone quarter eaters with 32-inch touchscreens. The giant slates will offer a quick connection to 311 for requesting info and filing complaints, as well as interactive guides to the neighborhood. Instead of being a place to prank call 1-800 numbers, the phone booth will now become your one stop shop for restaurant suggestions and local landmark locations. 250 of the devices are being provided free of charge by City24x7 for a pilot program and, if all goes well, the company and the city will split revenue generate from ad sales following an expanded roll out. Your fist impression of the <a href="http://www.engadget.com/tag/terrafugia">Terrafugia Transition</a> is much the same as standing next to a 1959 Coupe de Ville -- it's huge, and the giant vertical stabilizers on the back have a distinctly Cadillac feel. This, however, is different. Sure, it too is made in the US, but it's crafted of carbon fiber, titanium and aluminum, costs $279,000 and seats only two. Oh, and did we mention <em>it can fly</em>? It's making its major auto show debut this week and we got a chance to check it out. The "flying car" has journeyed far beyond the concept phase, achieving its <a href="http://www.engadget.com/2011/07/05/terrafugia-transition-aircraft-gets-dot-roadworthiness-sign-off/">compulsory nod from the DOT</a> last summer, and now reaching production prototype status. On March 23rd, the latest Transition flew past one more hurdle, completing its first airborne trial. The hybrid vehicle rolled down the runway at Plattsburgh International Airport in New York before ascending to 1400 feet -- the entire flight lasted a mere eight minutes, and marks the first of six planned phases of flight testing during the aircraft's voyage past experimental stage. There's still no word on when the Light Sport Aircraft will be making its way to soon-to-be Transition owners, but those hankering for a preview can catch a glimpse of the craft at the New York Auto Show from April 6th through the 15th. Apparently following in the steps of the White House's <a href="http://www.engadget.com/2011/12/06/white-house-releases-early-test-code-for-data-gov-platform-move/">Data.Gov</a> initiative, the legislation lays out three ways the city will be <em>"</em>jumpstarting a comprehensive citywide open data policy." The Department of Information Technology Telecommunications will be in charge of of creating a technical standards manual and posting it online to begin, serving as guide for the city's agencies on how to handle and list any data that's considered public domain. Bloomberg also has his eyes on developers, as part two involves getting any info stored online in "locked formats" released over the next year so that it can be used for creating applications. As <em>InformationWeek </em>points out, this is something the city has been fond of, as showcased by its ongoing BigApps program. The third task will require the DoITT to make compliance plans with all of the city's agencies to help them list all of their public data, with the end goal of listing it to "a single web portal by 2018." As <em>The New York Times</em> reports, the company will soon begin rolling out the first phase of its new mobile payment system for taxis, which will see 30 cabs equipped with an iPad encased in a metal housing that also includes a credit card reader. Apparently sources close to the news network have revealed that the iPad 3 will be unveiled in New York rather than the traditional West Coast unveiling of previous products. It's interesting to note that the recent <a href="http://www.engadget.com/2012/02/16/apple-os-x-mountain-lion-10-8-in-depth-preview/">Mountain Lion</a> briefings and <a href="http://www.engadget.com/2012/01/19/live-from-apples-education-event/">Education event</a> were both based in the Big Apple, lending <em>some</em> weight to the claim. Although company expert Jim Dalrymple has already rebutted the broadcaster's claim about the location. The rest? Well, it certainly tallies with the most recent crop of <a href="http://www.engadget.com/2012/02/27/ipad-3-rumor-roundup/">rumors</a>, but when it's Apple-silly season we won't believe anything until we see it.<br /><br /><strong>Update:</strong> Here it comes. It'll stream all the major networks, and also offers a cloud-based DVR service on the internet-connected device of your choosing, whether it's a <a href="http://www.engadget.com/2011/07/19/roku-2-hd-xd-and-xs-officially-launch-same-price-smaller-siz/">media streamer</a>, <a href="http://www.engadget.com/2011/10/14/iphone-4s-review/">phone</a>, <a href="http://www.engadget.com/2012/02/07/samsung-galaxy-tab-7-7-review-international-edition/">tablet</a> or <a href="http://www.engadget.com/2012/02/09/2012-hdtv-pricing-leaks-out-for-panasonic-sony-sharp-and-samsu/">TV</a>. Under the arrangement, Intel will have to shell out a mere $6.5 million to resolve a <a href="http://www.engadget.com/2009/11/04/new-york-attorney-general-files-antitrust-lawsuit-against-intel/">2009 antitrust lawsuit</a> filed by then-attorney general Andrew Cuomo. Cuomo, who has since ascended to the seat of governor, had accused the chipmaker of intimidating PC manufacturers and handing out billion-dollar kickbacks, as part of what he called a "systematic worldwide campaign" to assert its market dominance. The case has since been helmed by Cuomo's successor, current attorney general Eric Schneiderman, but its sails lost a lot of wind when U.S. District Judge Leonard Stark barred the state from seeking triple damages, limiting its claims to a three-year period, rather than the four-to-six that the state had been pursuing. As a result, Intel suffered only the slightest of financial blows.<br /><br />According to <em>Reuters</em>, the $6.5 million sum represents just five hours worth of profit for the company, which reported a net income of nearly $13 billion last year. Intel was pleased with the news, pointing out that the agreement doesn't require it to admit any wrongdoing. It's all part of the museum's "Cosmic Cocktails and Space Arcade" evening -- an event that seems tailor made for anyone interested in cosmology, humans, and/or hallucinogens. The showcase of the soiree is the Space Cruiser game, which promises to turn the ceiling of the Rose Center for Earth and Space into a "living, breathing, space ship where participants navigate around a beautiful fictitious universe." With the Magnetic Fields' Stephin Merritt assuming the tripartite role of ship captain-navigator-narrator, the game apparently begins with the birth of the universe, before transporting visitors across new galaxies and through time-bending wormholes. The ship launches at 6:30 PM tonight, but unfortunately, tickets are already sold out. The intent is really for teachers and other educators to produce educational materials, but Apple says the format can apply to any genre. Aside from the free part, the real story here is ease of use, with the ability to drag and drop photos, videos and even Microsoft Word files into various templates. If you use Apple's own suite of office apps, in particular, you can drag and drop a Keynote presentation into the doc, and it'll live on as an interactive widget. (You can whip up other widgets, too, though you'll need to know Javascript or HTML.)<br /> <br /> Moving beyond the main text, authors can also arrange glossaries by highlighting and clicking words, and clicking again to add a definition. In a surprise move, Apple also said authors can publish straight to the store, though we're waiting for clarification that textbook writers and other scribes are actually exempt from Cupertino's notorious approval process. In any case, the app is available now in the App Store (for OS X Lion only, sadly) so you can cracking on that definitive Kurt Vonnegut glossary you never knew you had in you.<br /> <br /> <strong>Update</strong>: We've got our <a href="http://www.engadget.com/2012/01/19/apples-ibooks-author-hands-on/">hands-on up</a>!<br /> <br /> <strong>Update 2</strong>: Apple has confirmed some key approval and revenue-sharing details. First, authors will be subject to the same App Store approval process as developers. Writers can offer their books for free, or for as much as $14.99 -- the same price cap for textbooks sold in the store. Phil Schiller has just taken to the stage and announced the first half of Apple's platform that's going to "reinvent the textbook:" <a href="http://www.engadget.com/2010/01/27/apple-reveals-ibooks-store-and-app-for-the-ipad/">iBooks</a> 2. Saying that there were 1.5 million iPads currently in use in Education (using 20,000 specific apps), the revamped book-stand now includes education-specific features to help the budding students of the world.<br /> <br /> You'll be able to paw through content, stopping to flick through detailed 3D animated models of elements within, access video and definitions without leaving the page. VP of Productivity Applications, Roger Rosner said that "Clearly, no printed book can compete with this:" given the constantly-updated data available, that's kinda obvious. Still, you'll be able to read in a text-heavy portrait or picture-biased landscape mode and there's also the option to have random pop-quizzes appear to keep you on your toes. Annotations is an integral part of the system: you can add stickies to individual pages and aggregate them into virtual 3 x 5-inch note-cards for revision during finals. You'll also get the same purchase, download and re-download rights you enjoy in the company's other stores.<br /> <br /> <br /> The company's partnered (initially) with textbook makers Pearson, McGraw Hill and Houghton Mifflin Harcourt, as the trio are responsible for 90 percent of all textbooks sold -- as well as DK and the E.O. Wilson Foundation. Phil was gushing, saying that he couldn't "overemphasize the importance of these partners working with us." Pearson's <em>High School Science, Biology</em>, DK's <em>Dinosaurs and Prehistoric Life, Natural History Insects, Animals</em> and <em>My First ABC</em> as well as the first two chapters of E.O. Wilson's <em>Life on Earth</em> will be available at launch -- the latter is free. We'd <a href="http://www.engadget.com/2012/01/02/apple-media-related-announcement-this-month-rumor/">heard</a> it was coming, and for the second year in a row, Apple has disrupted the natural flow of <a href="http://www.engadget.com/ces">CES</a> by announcing an event <a href="http://www.engadget.com/2011/01/07/verizon-holding-event-tuesday-in-nyc-but-for-what/">of its own</a>. Granted, this one -- slated to be held January 19th at the Guggenheim Museum -- is packing far fewer implications than the <a href="http://www.engadget.com/2011/01/11/live-from-verizons-iphone-event/">Verizon iPhone event</a> of 2011, but suffice it to say, anyone who enjoys "learning" should be tuning in later this month. If you'll recall, it was reported by <a href="http://techcrunch.com/2012/01/02/this-months-apple-event-to-focus-on-publishing-and-ibooks/" target="_blank"><em>TechCrunch</em></a> that the event would be entirely related to publishing, with no new hardware on tap; Fox's own Clayton Morris <a href="http://claytonmorris.com/blog/2012/1/3/apples-january-event.html" target="_blank">followed up</a> to say that it'd have something to do with iTunes. 	When the MSG Network was founded in 1969, the New York Knicks were just a few months away from their first NBA championship. The franchise would go on to win a second crown in 1973, after which it embarked on a gut wrenchingly long title drought that persists to this very day. The MSG Network, on the other hand, has been busy employing Mike Breen and <a href="http://www.engadget.com/2010/06/28/atandt-directv-verizon-push-comcast-and-cablevision-for-access-to/">expanding its Ewing-esque regional media reach</a> to new platforms, including (rather begrudgingly) <a href="http://www.engadget.com/tag/verizon+fios/">Verizon's FiOS TV</a>. Last week, the carrier announced that both MSG HD and MSG+ HD would be coming to its FiOS TV lineup, with select markets receiving the channels as early as Thursday. The move doesn't come without some grumbling, though, especially on MSG's part. As Verizon puts it, the network had previously "refused" to provide its HD channels, but was ultimately forced to do so when the FCC ruled in Big Red's favor. MSG's ownership tried to stay the decision, but a federal court this week denied its request. As a result, New York subscribers can now spend their evenings watching the Knicks in HD, and trying to remember the <em>good ol' times</em>.</div>

AT&amp;T's <a href="http://www.engadget.com/2011/06/10/atandt-bringing-wifi-to-20-nyc-parks-weiner-envisions-all-new-pla/">public WiFi rollout</a> seems to be moving along rather splendidly, now that four <a href="http://www.engadget.com/2011/11/04/atandt-brings-free-wifi-to-eleven-nyc-parks-untold-pigeon-ladies/">additional New York City parks</a> have been bathed in the golden rays of the internet. The carrier confirmed the expansion yesterday, announcing that its free WiFi service is now available at Mineral Springs and Tavern on the Green in Central Park, as well as Pier 6 in Brooklyn Bridge Park and Devoe Park, up in the Bronx. That brings AT&amp;T closer to its goal of 26 WiFi-enabled city locations, and inches New Yorkers ever closer to networked nirvana. 	Google has teamed up with the Palo Alto Library to offer its <a href="http://www.engadget.com/tag/chromebook/">Chromebooks</a> on loan, as part of a pilot program slated to kick off in January. As <em>Wired</em> explains, the Silicon Valley library has long offered laptops for visitors to use, though these devices were only available for two-hour windows, and were forbidden from leaving the premises. A few months ago, however, Google approached the library about offering Chromebooks for longer periods, in the hopes of bringing the device's cloud-based "shareability" to a wider audience. Palo Alto's librarians tried out 21 Chromebooks over the course of one month before deciding to loan them out for one-week periods, beginning next year. The notebooks have been available for on-grounds use for the past month, though according to Senior Librarian Jessica Goodman, the institution's Windows-based laptops are still more popular among patrons. "People would try it and say, 'That was pretty cool. I wish I could do word processing with that,'" Goodman told <em>Wired</em>, adding that the forthcoming one-week loans should give users more time to familiarize themselves with the device, and "spark a little bit of interest." East Coasters, meanwhile, can reap similar benefits at the Samsung Experience store in New York, where Chromebooks are now available on loan from the Chrome Zone. For many New Yorkers, Grand Central <strike>Station</strike> Terminal is where you go to escape the island -- not to leisurely browse aisles of iPhone accessories, or pop in for a Genius Bar appointment. But apparently <a href="http://www.engadget.com/tag/Apple/">Apple</a> has a slightly different vision for the city's transportation hub, opening its fifth NYC store along the main hall's 23,000 square foot east balcony. We dropped by for the grand opening this morning, which came complete with the standard <a href="http://www.engadget.com/tag/AppleStore/">Apple Store</a> t-shirt giveaway and what seemed like hundreds of red shirt-clad retail employees.<br />

As NYC's gateway to Connecticut, Grand Central is typically incredibly crowded during rush hour, but the enormous sunlight-filled main hall was packed to the brim today with spectators -- eager customers queued up in a hallway out of view, beginning early this morning. The store itself is huge, occupying the entire east balcony and several side rooms, with a large genius bar, training area and accessory alcove at either side. Eager to pop in for a visit? 	It's been a <a href="http://www.engadget.com/2011/07/23/apple-store-coming-to-grand-central-terminal-travel-disruptions/">long time coming</a>, but it looks like Apple's finally ready to take the wraps off its latest store. The company's latest New York City outpost is set to get its grand opening in landmark Grand Central Terminal on December 9th, leaving only a few weeks for some combative holiday shopping amidst tourists, fellow commuters and kids from the suburbs. According to an email sent to customers, the store will open its doors for the first time on Friday at 10AM, so you should probably start lining up in an hour or two -- after all, nothing beats claustrophobia, a little elbowing and that new Apple Store smell, <em>right</em>?<br />

Thousands of smartphones pass through New York City's Herald Square each day, but few tower higher than a few inches, or run <a href="http://www.engadget.com/2011/09/27/windows-phone-7-5-mango-review/">Windows Phone 7.5</a>. In celebration of three new Windows Phones hitting stores -- the <a href="http://www.engadget.com/2011/11/04/samsung-focus-s-hands-on/">Samsung Focus S</a>, <a href="http://www.engadget.com/2011/11/05/samsung-focus-flash-review/">Focus Flash</a> and <a href="http://www.engadget.com/2011/11/02/t-mobile-unleashes-htc-radar-4g-samsung-galaxy-tab-10-1-mytouc/">HTC Radar 4G</a> -- Microsoft has constructed a monstrous six-story "Windows Phone" just a few feet away from the world's largest Macy's store, right in the middle of one of the city's more popular outdoor picnic areas. The gadget sure is huge, but it's not a phone in the traditional sense -- enormous tiles display video feeds transmitted from a control room, and move out of place to accommodate live stage performances. We dropped by for a midday calisthenics session, which surprisingly appeared to be a hit with locals and tourists. There were functioning devices on hand as well, in a makeshift showroom, though those were far less popular than the 55-foot behemoth front and center. How do you like them acronyms? If you had any doubt that AT&amp;T would bring LTE to NYC in the near future, it's time to put that doubt aside -- sort of. Speaking at the Mashable Media Summit Friday, Senior VP of corporate communications Larry Solomon said that New York City would be sheathed in Ma Bell-branded high speed "soon." Sure it's vague, but it's something. Here's what he had to say:

		We're investing about $20 billion this year in our network, adding cell sites in New York City alone, rolling out 4G LTE. We'll have about 70 million consumers covered across the US by the end of this year, and it's going to be coming to New York City soon.</p>

There's no telling when the big city will get it's taste of the AT&amp;T LTE pie, but it will be in good company when it does. According to the provider's latest earnings report, profits declined by a full 65 percent over the year, with net income plunging to $39.3 million this quarter, compared with the $112.1 million it raked in during the third quarter of 2010. The company also reported a loss of 19,000 video subscribers during Q3, though it added 17,000 broadband customers and 38,000 telephone subscribers. Total customers, however, declined by 15,000 over the past three months. Revenue, meanwhile, increased by eight percent to $1.7 billion, though the New York-area operator lost about $16 million to Hurricane Irene -- not to mention all those <a href="http://www.engadget.com/2011/08/10/cablevision-and-viacom-settle-lawsuit-over-live-tv-on-ipad/">legal</a> <a href="http://www.engadget.com/2011/06/23/viacom-sues-cablevision-over-its-tv-streaming-optimum-for-ipad-a/">fees</a>. As <em>TechCrunch</em> recently revealed, the forthcoming pop-up store is slated to open its doors on November 1st, as part of a campaign designed to promote PayPal's new slate of <a href="http://www.engadget.com/2011/09/15/paypal-to-add-mobile-payment-features-hopes-to-redefine-how-we/">in-store technologies</a>. Located at 174 Hudson Street in Tribeca, the outlet will also sport a large QR code on its exterior, which passers-by can scan with their smartphones to find more information on the company's new mobile payment services. Inside, merchants will be able to better familiarize themselves with PayPal's commercial offerings, which include location-based promotions, cross-device payment services and real-time inventory checks, among others. The store will be open for about three and a half months, and PayPal's new features should be making their way to physical retailers in the near future. It's hardly a natural disaster, but the landscape of Manhattan is about to change <a href="http://www.engadget.com/2011/09/17/engadget-takes-over-times-square-courtesy-of-ts2-video/">once again</a> with the arrival of cellular signal to a handful of the borough's subway platforms. Both AT&amp;T and T-Mobile are taking part in the <a href="http://www.engadget.com/2010/10/02/atandt-and-t-mobile-will-have-cell-coverage-in-nyc-subway-stations/">pilot program</a>, and the Metropolitan Transit Authority expects the service to begin rolling on Tuesday at several stations along the 14th Street corridor, including A, C, E, F, L and M, along with stops 1, 2 and 3. The 23rd Street line will also see part of the action, as coverage is expected for the C and E stations. Of course, straphangers are unlikely to receive signal once on-board the trains, as the tunnels themselves aren't included in this rollout. Currently, the MTA expects all 277 underground platforms to be equipped for mobile chatter by 2016. Transit Wireless, the company responsible for the expansion, is said to be in talks with Sprint and Verizon for a similar introduction, although its customers must be content to listen in on the conversations other commuters for the time being.<br />

Remember when we <a href="http://www.engadget.com/2011/08/09/near-times-square-come-see-engadget-on-a-really-big-screen/">took over</a> Times Square last month? Contrary to comments-based speculation, we didn't drop several years' salary to see our names and faces (and pets) up in lights. We were actually shooting a segment for the <a href="http://www.engadget.com/2011/08/23/the-engadget-show-024-we-visit-ferrari-take-over-times-squar/">Engadget Show</a> about a new service from Times Square2 (TS2). The NASDAQ / Thomson Reuters alliance is working to increase engagement on the giant electronic billboards it controls in one of the most heavily trafficked spots in the US. Remember that <a href="http://www.engadget.com/2011/08/19/apple-cracks-down-on-counterfeit-products-sold-in-nyc-files-law/">lawsuit</a> Apple filed against a pair of Queens stores accused of selling fake iDevice accessories? Well, it looks like it's coming to a close. According to <em>Reuters</em>, Cupertino has reached a settlement with the two Chinatown-area retailers, both of which have agreed to hand over all products emblazoned with the Apple name or logo. If the settlement is approved, the two vendors, Fun Zone and Apple Story, will have five days to clear all counterfeit iPod and iPhone accessories from their inventories, along with any allegedly trademark-infringing promotional materials. The defendants, who maintain their innocence, would also be barred from destroying any records of sales, manufacturing or distribution of the unauthorized cases and headphones -- presumably as part of Apple's ongoing <a href="http://www.engadget.com/2011/07/25/two-more-fake-apple-stores-spotted-by-officials-in-china-two-ge/">crusade</a> against counterfeiters. Apple Story, meanwhile, would have to change its name, which bears an obvious similarity to another <a href="http://www.engadget.com/2011/07/20/the-ultimate-kirf-fake-apple-store-spotted-in-china/">well-known outlet</a>. The proposed settlement was filed with a Brooklyn District Court on Thursday and now awaits the approval of US District Judge Kiyo Matsumoto. There may be more than <a href="http://www.engadget.com/2011/07/25/two-more-fake-apple-stores-spotted-by-officials-in-china-two-ge/">a few</a> <a href="http://www.engadget.com/2011/07/20/the-ultimate-kirf-fake-apple-store-spotted-in-china/">fake Apple Stores</a> in China, but for the moment, Cupertino's anti-KIRF crusade seems focused squarely on New York City. According to <em>Reuters</em>, Apple has filed a trademark infringement lawsuit against two stores in Queens, alleging that they sold unauthorized <span id="articleText">cases, headphones and other</span> accessories for the iPhone, iPad and iPod. In the complaint, the company claims that the products in question were all emblazoned with its familiar fruit logo, along with the phrase, <span id="articleText">"Designed by Apple in California. Assembled in China."</span> The suit also demands that one of the stores, called Apple Story (seriously), change its name to avoid confusion with the real retail outlet and that both vendors disclose full lists of people who both supplied and purchased the goods.<br />

It all began when company representatives visited the Chinatown-area stores on <span id="articleText">"multiple occasions over several weeks," where they bought and examined the items, described in court records as "exact duplicates" of their authentic counterparts. On July 27th, Apple executed a </span><span id="articleText">few ex parte seizure warrants</span><span id="articleText">, which allowed authorities to seize any goods bearing its logo. </span><span id="articleText">US District Judge Kiyo Matsumoto has </span><span id="articleText">already granted an injunction to stop the stores from selling the alleged knockoffs, but hasn't yet decided whether Apple Story will have to change its name. The complaint also seeks undisclosed monetary damages and asks that all existing counterfeit goods be destroyed, though court documents suggest that both sides are close to reaching a deal. </span>Neither Apple nor the defendants have commented on the accusations, but we'll let you know as soon as we learn more.<br />

	Tired of burning your hard earned cash on parking fines? You might wanna move to New York City, where the Department of Transportation will soon begin testing a "pay by phone" parking system. The <a href="http://www.engadget.com/tag/mobile+payments/">mobile payment</a> technology, which has already been introduced in cities like Washington, DC and Atlanta, essentially allows drivers to pay for their parking spots without ever having to interact with those menacing, metallic meters. After registering online, users would be able to pay for curbside real estate by entering the number of the nearest meter and the amount of time they'd like to purchase into a customized app, or by texting it to the city's Department of Transportation. The system would also alert users whenever their allotted time is about to expire, allowing them to add more money directly from their handsets, rather than trudge back their cars. At this point, the plan is to roll out the pilot program to some 300 parking spots over the next few months, most likely in outer borough neighborhoods with plenty of commercial outlets and, presumably, automobiles.</div>
