Today, it was able to dismiss its opponents' state law unfair competition claim under the theory of federal preemption. Essentially, Aereo argued (and the judge agreed) that the anti-competition claim was actually an attempt to vindicate the broadcasters' rights to control the performance of their copyrighted materials. Because those rights are granted under federal law, the state law claim was preempted and dismissed from the lawsuit pursuant to the Copyright Act. Despite this courtroom victory, Aereo still has a lot of legal legwork to do, as it still faces two copyright claims that could still shut down the OTA streaming party. On this occasion, Mayor Bloomberg &amp; Co. have introduced a novel way for citizens of <a href="http://www.engadget.com/tag/NYC/">The Big Apple</a> -- and others who plan on making the move -- to find jobs in the technology sector. Dubbed "Made in New York Digital Map," the service aims to make it easier for folks to see which tech companies are seeking engineers, designers, developers, etc. At the moment there's more than 325 outfits looking for new hires, with over "thousands of jobs" being up for grabs. <a href="http://www.engadget.com/tag/MayorBloomberg/">Mayor Bloomberg</a> says this is only the beginning and he's encouraging startups to set up shop here in the City, as he believes this "is the place to be if you're a growing tech startup." NASA has confirmed that today's 747-100 ferry flight across Manhattan is a "Go" and that the duo will "fly at a relatively low altitude over various parts of the New York City metropolitan area on Friday" before landing at JFK. The Shuttle will then, in the coming weeks, be put on a ferry of a floating variety and brought to the Intrepid Sea, Air and Space Museum. Today's flying tour is scheduled to take place between 9:30 and 11:30 am and... oh look, at the time, we must be going.</p><p style="text-align: left; "> <strong>Update</strong>: NASA has <a href="https://twitter.com/#!/NASA/statuses/195867451236421635">confirmed takeoff</a> from Dulles! Speaking of, Clearwire's making no bones about the fact that "high demand hot zones" will be the ones targeted initially, and in a bid to outshine those LTE networks already live, President and CEO Erik Prusch is suggesting that his firm's 4G network "will show that not all LTE networks are created equal." No, not the <a href="http://www.engadget.com/2012/04/03/nokia-lumia-900-review/">Nokia Lumia 900</a>, which made an appearance in several forms at the <a href="http://www.engadget.com/tag/WindowsPhone/">Windows Phone</a> event in New York City's Bryant Park today, but Kourtney Kardashian, who drew crowds to the Free-Time Machine -- that fled just as quickly as they arrived. The reality TV star far overshadowed the Windows Phone experience, which is on display in several cities across the US today. New Yorkers can visit Bryant or Madison Square Parks for a chance to flick through some Metro tiles on a Lumia 900, and play to win gift certificates and other prizes -- and in the case of one ecstatic youngster, a day with the above-mentioned celebrity and a $5,000 gift certificate. There were also a few smartphone giveaways on order, along with some "free time" prizes, like a dog walker gift certificate or a chance to skip the line (saving "60 minutes") at the city's Shake Shack burger joint. This isn't the first time we've seen an oversized Windows Phone <a href="http://www.engadget.com/2011/11/07/microsoft-installs-biggest-windows-phone-ever-in-nycs-herald/">drop by Manhattan</a>, and it's probably not the last. Obviously, in the age of the ubiquitous smartphone, most of them go untouched -- though, usually that has more to do with some mysterious substance covering the handset. The city is preparing to update this urban staple by replacing the touch tone quarter eaters with 32-inch touchscreens. The giant slates will offer a quick connection to 311 for requesting info and filing complaints, as well as interactive guides to the neighborhood. Instead of being a place to prank call 1-800 numbers, the phone booth will now become your one stop shop for restaurant suggestions and local landmark locations. 250 of the devices are being provided free of charge by City24x7 for a pilot program and, if all goes well, the company and the city will split revenue generate from ad sales following an expanded roll out. Unveiled today at the <a href="http://www.engadget.com/tag/nyias+2012/">New York International Auto Show</a>, the in-vehicle computer represents a collaboration between Intel and Nissan and was showcased within the Infiniti LE concept vehicle. On the inside lurks an <a href="http://www.engadget.com/tag/atom,intel">Atom CPU</a>, which bucks the general trend toward ARM architecture in these systems. Both companies put their collective heads together to create cloud-based services for smartphone users such as video surveillance, vehicle control and monitoring. As another nice refinement, users will also be able to use their phone's NFC capabilities for keyless entry to the carriage -- no word on whether it can similarly activate the ignition. A call to the retailer confirmed that there are just three kits available, each with a 24-105mm f/4 L IS USM lens in the box for $4,299. It's already filed another suit against Disney, CBS, NBCUniversal and Telemundo, as they wrangle over whether or not its scheme -- using an individual "microantenna" for each subscriber and streaming to that person over the internet, as long as they're in the broadcasting area -- violates their copyright. According to Aereo, it's merely relocating the equipment from the customer's home to its remote facility. This time, we've been given permission to take a lucky few of you along for the ride.<br /><br />The event takes place next Tuesday, March 27th in New York City at 7:00pm. Well, consider the request granted by a little bill dubbed as Introductory Number 29-A, which <a href="http://www.engadget.com/tag/MayorBloomberg/">Mayor Bloomberg</a> signed into law this past week. Apparently following in the steps of the White House's <a href="http://www.engadget.com/2011/12/06/white-house-releases-early-test-code-for-data-gov-platform-move/">Data.Gov</a> initiative, the legislation lays out three ways the city will be <em>"</em>jumpstarting a comprehensive citywide open data policy." The Department of Information Technology Telecommunications will be in charge of of creating a technical standards manual and posting it online to begin, serving as guide for the city's agencies on how to handle and list any data that's considered public domain. Bloomberg also has his eyes on developers, as part two involves getting any info stored online in "locked formats" released over the next year so that it can be used for creating applications. As <em>InformationWeek </em>points out, this is something the city has been fond of, as showcased by its ongoing BigApps program. The third task will require the DoITT to make compliance plans with all of the city's agencies to help them list all of their public data, with the end goal of listing it to "a single web portal by 2018." As <em>The New York Times</em> reports, the company will soon begin rolling out the first phase of its new mobile payment system for taxis, which will see 30 cabs equipped with an iPad encased in a metal housing that also includes a credit card reader. The service costs $12 dollars a month and will launch March 14th, but is only available to folks in New York City through Aereo's HTML5-powered website. It'll stream all the major networks, and also offers a cloud-based DVR service on the internet-connected device of your choosing, whether it's a <a href="http://www.engadget.com/2011/07/19/roku-2-hd-xd-and-xs-officially-launch-same-price-smaller-siz/">media streamer</a>, <a href="http://www.engadget.com/2011/10/14/iphone-4s-review/">phone</a>, <a href="http://www.engadget.com/2012/02/07/samsung-galaxy-tab-7-7-review-international-edition/">tablet</a> or <a href="http://www.engadget.com/2012/02/09/2012-hdtv-pricing-leaks-out-for-panasonic-sony-sharp-and-samsu/">TV</a>. Aereo's powered by large devices containing tons of tiny, dime-sized TV antennas connected to the cloud, with individual antennas corresponding to individual users -- giving each the ability to tune into one channel at a time. It's all part of the museum's "Cosmic Cocktails and Space Arcade" evening -- an event that seems tailor made for anyone interested in cosmology, humans, and/or hallucinogens. The showcase of the soiree is the Space Cruiser game, which promises to turn the ceiling of the Rose Center for Earth and Space into a "living, breathing, space ship where participants navigate around a beautiful fictitious universe." With the Magnetic Fields' Stephin Merritt assuming the tripartite role of ship captain-navigator-narrator, the game apparently begins with the birth of the universe, before transporting visitors across new galaxies and through time-bending wormholes. The ship launches at 6:30 PM tonight, but unfortunately, tickets are already sold out. Developed in conjunction with the Department of Defense, the technology uses terahertz imaging detection to measure the radiation that humans naturally emit, and determine whether the flow of this radiation is impeded by a foreign object -- in this case, a gun. During a speech Tuesday, Police Commissioner Ray Kelly said the device shows "a great deal of promise as a way of detecting weapons without a physical search." Kelly went on to say that the technology would only be deployed under "reasonably suspicious circumstances," though some civil liberties activists are already expressing concerns. "We find this proposal both intriguing and worrisome," New York Civil Liberties Union executive director Donna Lieberman said in a statement, adding that the scanner could all too easily infringe upon civilian privacy. "If the NYPD is moving forward with this, the public needs more information about this technology, how it works and the dangers it presents." The school will greet its first class of incoming freshman at the beginning of the next school year and become the first NYC public school dedicated to pumping out programers. Beyond filling our desperate need for more engineers the school will be special in several respects. For one, it will be a "limited, unscreened" institution, which means grades and attendance records are not considered for admission -- only interest. Secondly, this isn't a vocational school that simply teaches kids to live and breathe in C++ and <a href="http://www.engadget.com/tag/javascript">JavaScript</a>. While the focus will be on software engineering, it will be accompanied by traditional college preparation academic classes. We'd <a href="http://www.engadget.com/2012/01/02/apple-media-related-announcement-this-month-rumor/">heard</a> it was coming, and for the second year in a row, Apple has disrupted the natural flow of <a href="http://www.engadget.com/ces">CES</a> by announcing an event <a href="http://www.engadget.com/2011/01/07/verizon-holding-event-tuesday-in-nyc-but-for-what/">of its own</a>. Granted, this one -- slated to be held January 19th at the Guggenheim Museum -- is packing far fewer implications than the <a href="http://www.engadget.com/2011/01/11/live-from-verizons-iphone-event/">Verizon iPhone event</a> of 2011, but suffice it to say, anyone who enjoys "learning" should be tuning in later this month. If you'll recall, it was reported by <a href="http://techcrunch.com/2012/01/02/this-months-apple-event-to-focus-on-publishing-and-ibooks/" target="_blank"><em>TechCrunch</em></a> that the event would be entirely related to publishing, with no new hardware on tap; Fox's own Clayton Morris <a href="http://claytonmorris.com/blog/2012/1/3/apples-january-event.html" target="_blank">followed up</a> to say that it'd have something to do with iTunes. 	When the MSG Network was founded in 1969, the New York Knicks were just a few months away from their first NBA championship. The franchise would go on to win a second crown in 1973, after which it embarked on a gut wrenchingly long title drought that persists to this very day. The MSG Network, on the other hand, has been busy employing Mike Breen and <a href="http://www.engadget.com/2010/06/28/atandt-directv-verizon-push-comcast-and-cablevision-for-access-to/">expanding its Ewing-esque regional media reach</a> to new platforms, including (rather begrudgingly) <a href="http://www.engadget.com/tag/verizon+fios/">Verizon's FiOS TV</a>. Last week, the carrier announced that both MSG HD and MSG+ HD would be coming to its FiOS TV lineup, with select markets receiving the channels as early as Thursday. The move doesn't come without some grumbling, though, especially on MSG's part. As Verizon puts it, the network had previously "refused" to provide its HD channels, but was ultimately forced to do so when the FCC ruled in Big Red's favor. MSG's ownership tried to stay the decision, but a federal court this week denied its request. As a result, New York subscribers can now spend their evenings watching the Knicks in HD, and trying to remember the <em>good ol' times</em>.</div>

AT&amp;T's <a href="http://www.engadget.com/2011/06/10/atandt-bringing-wifi-to-20-nyc-parks-weiner-envisions-all-new-pla/">public WiFi rollout</a> seems to be moving along rather splendidly, now that four <a href="http://www.engadget.com/2011/11/04/atandt-brings-free-wifi-to-eleven-nyc-parks-untold-pigeon-ladies/">additional New York City parks</a> have been bathed in the golden rays of the internet. The carrier confirmed the expansion yesterday, announcing that its free WiFi service is now available at Mineral Springs and Tavern on the Green in Central Park, as well as Pier 6 in Brooklyn Bridge Park and Devoe Park, up in the Bronx. That brings AT&amp;T closer to its goal of 26 WiFi-enabled city locations, and inches New Yorkers ever closer to networked nirvana. The masterpieces range in size from a single wall to entire rooms, consisting of parts procured from sources like individual homes, small businesses, government offices and Fortune 500 companies. For many New Yorkers, Grand Central <strike>Station</strike> Terminal is where you go to escape the island -- not to leisurely browse aisles of iPhone accessories, or pop in for a Genius Bar appointment. But apparently <a href="http://www.engadget.com/tag/Apple/">Apple</a> has a slightly different vision for the city's transportation hub, opening its fifth NYC store along the main hall's 23,000 square foot east balcony. We dropped by for the grand opening this morning, which came complete with the standard <a href="http://www.engadget.com/tag/AppleStore/">Apple Store</a> t-shirt giveaway and what seemed like hundreds of red shirt-clad retail employees.<br />

As NYC's gateway to Connecticut, Grand Central is typically incredibly crowded during rush hour, but the enormous sunlight-filled main hall was packed to the brim today with spectators -- eager customers queued up in a hallway out of view, beginning early this morning. The store itself is huge, occupying the entire east balcony and several side rooms, with a large genius bar, training area and accessory alcove at either side. Eager to pop in for a visit? Looks like AT&amp;T is on track to hit that year-end <a href="http://www.engadget.com/2011/11/14/atandt-expanding-lte-to-15-markets-on-november-20th/">15 market LTE goal</a>, after all. John Stephens, the operator's CFO / SVP, just went public with plans to <em>officially</em> launch that 700MHz service in New York City sometime this month, according to a statement made at the UBS 39th Annual Global Media and Communications Conference. The network's <a href="http://www.engadget.com/2011/12/02/atandt-rolls-out-4g-lte-in-parts-of-new-york-city/">currently undergoing testing</a> in the Big Apple, as we reported in our Nitro HD <a href="http://www.engadget.com/2011/12/01/lg-nitro-hd-hands-on/">hands-on</a> and <a href="http://www.engadget.com/2011/12/06/lg-nitro-hd-review/">review</a>, but the time seems nigh for eager subs to partake of the blazing radio waves. There's certainly no lack of handset options either, with the <a href="http://www.engadget.com/2011/11/09/htc-vivid-review/">HTC Vivid</a>, <a href="http://www.engadget.com/2011/11/11/samsung-galaxy-s-ii-skyrocket-review/">Samsung Galaxy S II Skyrocket</a> and the aforementioned LG phone all poised to lead you into "true" 4G territory. 	It's been a <a href="http://www.engadget.com/2011/07/23/apple-store-coming-to-grand-central-terminal-travel-disruptions/">long time coming</a>, but it looks like Apple's finally ready to take the wraps off its latest store. The company's latest New York City outpost is set to get its grand opening in landmark Grand Central Terminal on December 9th, leaving only a few weeks for some combative holiday shopping amidst tourists, fellow commuters and kids from the suburbs. According to an email sent to customers, the store will open its doors for the first time on Friday at 10AM, so you should probably start lining up in an hour or two -- after all, nothing beats claustrophobia, a little elbowing and that new Apple Store smell, <em>right</em>?<br />

Thousands of smartphones pass through New York City's Herald Square each day, but few tower higher than a few inches, or run <a href="http://www.engadget.com/2011/09/27/windows-phone-7-5-mango-review/">Windows Phone 7.5</a>. In celebration of three new Windows Phones hitting stores -- the <a href="http://www.engadget.com/2011/11/04/samsung-focus-s-hands-on/">Samsung Focus S</a>, <a href="http://www.engadget.com/2011/11/05/samsung-focus-flash-review/">Focus Flash</a> and <a href="http://www.engadget.com/2011/11/02/t-mobile-unleashes-htc-radar-4g-samsung-galaxy-tab-10-1-mytouc/">HTC Radar 4G</a> -- Microsoft has constructed a monstrous six-story "Windows Phone" just a few feet away from the world's largest Macy's store, right in the middle of one of the city's more popular outdoor picnic areas. The gadget sure is huge, but it's not a phone in the traditional sense -- enormous tiles display video feeds transmitted from a control room, and move out of place to accommodate live stage performances. We dropped by for a midday calisthenics session, which surprisingly appeared to be a hit with locals and tourists. There were functioning devices on hand as well, in a makeshift showroom, though those were far less popular than the 55-foot behemoth front and center. How do you like them acronyms? If you had any doubt that AT&amp;T would bring LTE to NYC in the near future, it's time to put that doubt aside -- sort of. Speaking at the Mashable Media Summit Friday, Senior VP of corporate communications Larry Solomon said that New York City would be sheathed in Ma Bell-branded high speed "soon." Sure it's vague, but it's something. Here's what he had to say:

		We're investing about $20 billion this year in our network, adding cell sites in New York City alone, rolling out 4G LTE. We'll have about 70 million consumers covered across the US by the end of this year, and it's going to be coming to New York City soon.</p>

There's no telling when the big city will get it's taste of the AT&amp;T LTE pie, but it will be in good company when it does. The <a href="http://www.engadget.com/2011/10/31/atandt-brings-its-first-lte-smartphones-to-life-htc-vivid-and-sam/">carrier announced</a> just this week that it would add Boston, Washington DC, Baltimore and Athens, GA to its <a href="http://www.engadget.com/2011/09/18/atandt-flips-lte-live-nearly-97-percent-of-america-wonders-where/">4G lineup</a>. 	There was once a time, believe it or not, when New Yorkers would go to public parks to engage in long strolls, unfettered cigarette smoking, and neurotic conversations with Diane Keaton. Recent years, however, have seen a sudden change in this behavior due to a variety of factors -- including AT&amp;T. Yesterday, the provider announced an expansion of its ongoing <a href="http://www.engadget.com/2011/06/10/atandt-bringing-wifi-to-20-nyc-parks-weiner-envisions-all-new-pla/">New York City WiFi initiative</a>, bringing free connectivity to eleven new sites across the five boroughs, including Prospect Park, Tompkins Square Park and Marcus Garvey Park, among others. With these new additions, AT&amp;T inches closer to its stated goal of bathing 26 park locations in WiFi, though the Grand Poobah, Central Park, remains in the dark. As with its earlier rollout, visitors won't need an AT&amp;T account to get online. In fact, they won't need any contract at all -- just a WiFi-enabled device, a cozy bench and bountiful downtime. Need to take a walk through the park, but hate all of the fresh air, foliage and sunshine that comes with it? Good news: Google has added a number of parks to <a href="http://www.engadget.com/tag/StreetView/">Street View</a>, including New York City's High Line, elevated train tracks that have been converted into a 1.5 mile plant-filled walkway. Also on the list are the statue-filled Kensington Gardens in London and Tokyo's cherry blossom-lined Koganei Park. 	We've come a long way since Crown Vics crowded the streets of the Big Apple, opting instead for a fleet of <a href="http://www.engadget.com/2005/11/11/ford-hails-hybrid-taxis-in-nyc/">hybrid taxis</a> -- but today the New York City Taxi &amp; Limousine Commission is taking its green approach one step further with the introduction of six electric <a href="http://www.engadget.com/2011/08/30/nissan-leaf-mod-offers-more-accurate-battery-status/">Nissan Leaf</a> cabs. Starting next spring, the electric cars will join the procession of mustard-colored whips as part of the Electric Taxi Pilot Program. The new additions are part of Bloomberg's plans for an <a href="http://www.engadget.com/2007/05/23/all-new-york-taxis-to-be-hybrids-by-2012/">all electric cab system</a> by 2012. It's unsure yet whether the five-door electrics will have a distance or duty limitation and exactly what type of charging stations will be used. First <a href="http://www.engadget.com/2011/09/06/amazons-7-eleven-lockers-are-very-real-very-gray/">Seattle</a>, then London, now the Big Apple -- Amazon's <a href="http://www.engadget.com/2011/09/04/amazon-7-eleven-team-up-to-bring-delivery-convenience-to-your-c/">delivery lockers</a> are starting to pop up all over. As we've explained before, the lockers are basically giant, automated PO boxes, designated exclusively for Amazon purchases. If you choose to add a locker location to your address book (go check your account settings to see if the option is available to you yet), your package will be crammed into one of these kiosks and you'll be given a code to unlock a particular slot at the location of your choice. So far there are eight scattered around Manhattan in Rite Aides, D'Agostinos and Gristedes. We haven't wandered out of our secret lair to get photographic evidence of the drop off locations yet (we prefer to have our Amazon purchases left at the gate under the watchful eye of a <a href="http://www.engadget.com/2011/05/10/portal-turret-replica-has-real-laser-insatiable-bloodlust/">turret</a>), but we think the screen shot we took is proof enough that we're not pulling your leg. As <em>TechCrunch</em> recently revealed, the forthcoming pop-up store is slated to open its doors on November 1st, as part of a campaign designed to promote PayPal's new slate of <a href="http://www.engadget.com/2011/09/15/paypal-to-add-mobile-payment-features-hopes-to-redefine-how-we/">in-store technologies</a>. Located at 174 Hudson Street in Tribeca, the outlet will also sport a large QR code on its exterior, which passers-by can scan with their smartphones to find more information on the company's new mobile payment services. Inside, merchants will be able to better familiarize themselves with PayPal's commercial offerings, which include location-based promotions, cross-device payment services and real-time inventory checks, among others. The store will be open for about three and a half months, and PayPal's new features should be making their way to physical retailers in the near future. Leaving the confines of a Manhattan apartment, Lincoln Center has the uncanny ability to make one feel dwarfed. Home to the performing arts and haunt to New York City's glitterati, the landmark received the IBM makeover as part of the company's THINK exhibit -- an interactive installation designed to weave the story of technology as it applies to the fabric of life, achievement and change.<br />

The first thing that catches the eye is IBM's sparkling 123-foot long, 12-foot high LCD wall lining a tunnel leading into the bowels of the NYC landmark. The "living" wall thrives off the surrounding environment, visualizing traffic patterns and analyzing corresponding air quality from nearby Broadway. It also shows the solar potential of every rooftop in the city, financial transactions and the amount of water leaking from the main aqueduct. As the event's producer Lee Green simply put it, the idea behind the set up is to "delegate understanding" to "intrigue and inspire" even the least technologically-inclined.<br />
