    There's a longstanding legal tradition in tech: a small company gets patents on a nice idea, finds only modest success selling the idea and finally sues the living daylights out of its bigger rivals. And unfortunately, that's carrying on in the wearable era. Valencell is suing both Apple and Fitbit over claims that they both infringe on four patents for accurate health monitoring, including "light-guided" devices like heart rate monitors.

    Back at CES, LG was talking up the Lifeband fitness wearable and a pair of heart rate-sensing earphones, but neglected to mention when we'd actually see them in stores. Thanks to the FCC, however, we can get a reasonable idea that the latter device will arrive shortly. Now that the Bluetooth earphones, packed with Valencell's optical heart rate-monitoring technology, have been deemed fit for human consumption, it shouldn't be too long before this gear is available to buy -- and we can get back to wondering when the Nike-troubling Lifeband will make an appearance.

    iRiver has snagged Valencell's PeformTek bio-sensing technology for its freshly-announced ON active earbuds. Plug them into your head and the built-in hardware can relay vital statistics like your heart rate and fitness level to your smartphone. The company won't be pinned to a price or a release date, as it's still working on the companion app necessary for the gear to run, but expects to have it ready by March.
