    Curt Schilling to repay a fraction of $75 million game loan

    The saga of former Boston Red Sox pitcher Curt Schilling's 38 Studios, the state of Rhode Island and an awful lot of money might finally be over. At the end of July, it was announced that 38 Studios wouldn't face criminal charges for a failed $75 million loan for Project Copernicus, a massively multiplayer online game set in the Kingdoms of Amalur universe. Now, Schilling and his compatriots only have to pay $2.5 million to settle the lawsuit out of court, according to the Associated Press.

    Were you surprised that Project Copernicus didn't manage to sell at auction? Rhode Island governor Lincoln Chafee wasn't. In recent statements to the associated press, Chafee stated that the property was "a lot of junk" and decried every step of the loan process for 38 Studios. In the governor's own words: "People just panicked and gave a retired baseball player a huge amount of taxpayer money with no experience in this industry or any other businesses." Curt Schilling (the second key player in this ongoing drama, with the other being the state of Rhode Island) responded to the governor's statements on Twitter, claiming that a failure is obvious in hindsight. He also cited Chafee's current job approval numbers, suggesting that the state as a whole would like the opportunity to re-do its gubernatorial election. Richard Land, the man in charge of auctioning Project Copernicus and other 38 Studios assets, is allegedly still looking for private buyers for the IP.

    Out of the many tragedies that emerged from the 38 Studios fiasco was the fact that so much artistry was ultimately abandoned, unseen, and unheard by players. I can't imagine what it would be like to be a composer who spent months working on a full MMO score only to have the studio tank and the music silenced. Well, I can't bring back 38 Studios or Project Copernicus, but today we can at least hear a little of the music that went into the game. As a helpful commenter noted in the Sound Cloud column a couple of weeks ago, Composer Gene Rozenberg of The Witcher 3 fame posted a heap of the (then upcoming) Project Copernicus score on his page. Since it's still there, although not downloadable, I wanted to highlight a few of the best tracks before this too gets erased.

    We first got word of an auction to sell off 38 Studios' assets for Project Copernicus earlier this month, but now we have an actual date for the auction: November 14 and 15. This sale will include the Amalur universe IP and all merchandise and sequel rights to the single-player Kingdoms of Amalur: Reckoning, as well as IP rights to the properties of Big Huge Games.     Rhode Island is preparing to sell the Kingdoms of Amalur IP, with a website offering its assets going live this month, 38 Studios' court-appointed receiver Richard Land tells WPRI. 38 Studios collapsed in 2012 after launching Kingdoms of Amalur: Reckoning, taking $90 million of Rhode Island taxpayer money down with it. The main piece of Amalur up for auction will be Project Copernicus, the studio's MMO-in-progress. "If someone is thinking that Rhode Island is going to sell this for millions and millions of dollars, I would have a very difficult time believing that," Joystiq News Editor Alexander Sliwinski told WPRI in a Skype interview. Land is optimistic about the sale: "The bulk of the game and intellectual property I don't believe is stale because the artwork is current, the tech used to develop the artwork is current, the concept is a current concept." Sliwinski warns that the fantastical world of Copernicus may be outdated as the industry shifts into the next generation. The US Securities and Exchange Commission is investigating the $75 million loan that Rhode Island provided to 38 Studios. Rhode Island taxpayers have already begun paying back the loan.

    We'll never see Project Copernicus come to light, and for some people that's the last that needs to be said about 38 Studios. For the state of Rhode Island, however, there's quite a bit more at stake, with the state alleging that 38 Studios tried to hide its financial condition and essentially defrauded the taxpayers of Rhode Island. Opening arguments have been heard today for the case, with the 14 individual defendants seeking to have the case dismissed as completely spurious. When 38 Studios folded, that left Rhode Island in the hole for a $75 million loan. The lawsuit is seeking restitution from Curt Schilling and 13 other individuals, including former members of the Rhode Island Economic Development Corp that originally supported the loan. According to the EDC's lawyers, substantial evidence exists that this loan was based upon intentional misdirection on the part of upper management, although the defense claims these allegations are ridiculous. At this point, it's up to the courts who's in the right.

    Do you have a few million on you and a desire to preserve some gaming history? Then pick up the phone and call Rhode Island, as the state is getting ready to sell 38 Studios' assets, including its games. The state is looking to recoup some of it $130 million debt that it fell into once 38 Studios went belly-up. One of Rhode Island's lawyers says there "is interest" in the studio's assets, including concept art, design documents, and computer software. The sale of 38 Studios' IP includes the Amalur franchise, which encompassed the Project Copernicus MMO. The state is also set to begin a lawsuit this week against former 38 Studios execs, including founder Curt Schilling. The suit claims that the executives did not inform the state when they knew that the studio would have a hard time keeping afloat financially. Schilling has asked the judge to dismiss the suit.

    Just when you thought the world might let the wound where 38 Studios and Kingdoms of Amalur were ripped from your heart heal over, along comes some new drama. Max Wistow, the lawyer for the Rhode Island Economic Development Corporation, filed documents on behalf of the state claiming that 38 Studios needed more than $75 million in loan guarantees before the company ever moved to Rhode Island. He argues that folks at 38 Studios knew that the funds they were receiving from the state would be insufficient. The company netted about $50 million from an EDC bond sale, and Wistow is claiming "crushing evidence" that 38 Studios actively masked its financial shortfall.

    "To be or not to be" is not a question asked in most MMOs. Characters don't die permanently, after all. But Project Copernicus wouldn't have waved that fact off as an irrelevant necessity of game mechanics. No, according to R.A. Salvatore, the game world would have explored the meaning behind a world wherein no one truly dies and everyone is functionally immortal. Players who enjoyed Kingdoms of Amalur: Reckoning will recall that the game opens with the player character returning from death thanks to the Well of Souls. In Project Copernicus, the Well of Souls would have been active not just for one individual but for everyone in the world. Returning from death would be something that happens not just to players but to every part of the world. It's not hard to imagine the ways in which a world would seem different if death was no longer something to be feared or avoided. Salvatore laments that the concept is unlikely to see execution now, even with buyers looking to purchase the 38 Studios assets from the state of Rhode Island.

    38 Studios declared bankruptcy earlier this afternoon and Rhode Island Governor Lincoln Chafee held a press conference this afternoon to discuss the company's assets, which now belong in part to Rhode Island taxpayers. "We have had in recent days discussions with investors that were and, to my knowledge, are discussing substational numbers, which indicate that there could be significant value to the assets," said Jonathan Savage, council to the Rhode Island Economic Development Corporation. "I can say that discussions we've had have been in the tens of millions of dollars." "We are going to do everything possible to maximize return on our investment," declared Governor Chafee. "Taxpayers in Rhode Island can have full confidence that if there's a penny that we can get, or a nickle or a dime, we'll get it." Earlier this year, Wedbush Securities analyst Michael Pachter told us that he expected 38 Studios' IP to be worth approximately $20 million.

    While 38 Studios remains in dire straits, fans are getting a bittersweet treat of Project Copernicus reveals. It's sweet because we've been dying to see more information on this game, but bitter because its fate is still up in the air. Today fan site 38 Watch posted a trio of official-looking screens straight from Copernicus' world. In the screens, three races are revealed: the human-looking Almain, the dwarven Dverga, and the orcish Jottun. The game's art style and lush color palette are on full display, opting for more of a stylized than realistic approach. We recently heard that Project Copernicus has a possible June 2013 launch window and got our first look at the game in a flyby video.     The value of 38 Studios' Amalur intellectual property is estimated to be in the range of $20 million. We asked Wedbush Securities analyst Michael Pachter for his valuation following confirmation of layoffs at the studio and coverage of 38 Studios employees flocking to Turbine's recruitment drive in Providence last night."Nobody is buying MMOs after Star Wars fizzled. I think value is low, probably $20 million or so," Pachter said. "There is just no demand for game assets right now, as THQ proved when it tried to sell the Warhammer MMO. I think [Electronic Arts] could step in, since they are the publisher, so you might see some alternative way to get 38 some bridge financing."Electronic Arts had been the publisher on the Big Huge Games developed Kingdoms of Amalur: Reckoning, but has yet to confirm it would publish 38 Studios' "Project Copernicus.""Nope – never been an announcement on that," Jeff Brown of EA corporate communications told Joystiq. "We don't have any new announcements to make regarding 38 Studios. We enjoyed working with Curt and his team on their first game, Kingdoms of Amalur: Reckoning. Like game fans all over the world, we look forward to what 38 Studios creates next."With reports out of Providence delivering an uncertain near future for the studio, it wouldn't be surprising if publishers tried to pick up the Amalur IP for pennies on the dollar. However, with documents showing that 38 Studios put up the IP as collateral against the $75 million loan, anybody trying to pick up the IP will be negotiating with the state of Rhode Island for control of Amalur.

    38 Studios is one of many developers whose first big game (Kingdoms of Amalur: Reckoning) was rumored to lead into an MMO further on down the line. It looks like there may be storm clouds on the horizon before that project even gets moving, however, as the company may be facing financial issues. Rhode Island Governor Lincoln Chafee has apparently been meeting with owner Curt Schilling to work on "different issues," with Chafee noting that his administration has always tried to ensure that Rhode Island companies remain financially solvent. If you consider that Rhode Island invested about $75 million in the company, it's obvious that the government has an interest in making the company remain viable over the long term. Kingdoms of Amalur: Reckoning was a moderate hit, but that might not be enough for the company as it develops. We'll have more on this story as it develops, hopefully with better news.

    Now that Kingdoms of Amalur: Reckoning is out and available, 38 Studios may be in a position to return to its storied "Project Copernicus." A few recent hires at Curt Schilling's studio make it seem that way. 38 has picked up both John Blakely, who worked on DCUO and Everquest 2, and Mark Hanson, who was involved with the now-extinct Lego Universe Online. Blakely will serve as 38's senior VP of development, while Hanson will be senior VP of operations and business.Of course, both of those positions are fairly high up on the management chain, so they don't necessarily mean that 38 is right in the midst of Copernicus' main development just yet. But given that Kingdoms is out with solid sales numbers to back it up, it wouldn't be too surprising to see 38 Studios itching to get rolling on its MMO title set in the land we now know as Amalur.

    With Kingdoms of Amalur: Reckoning just around the corner and Project Copernicus waiting in the wings, 38 Studios is fattening its golden website for the upcoming feast. The studio has expanded the site devoted to the world that both of these games inhabit, and those looking for hints and portents of the studio's upcoming MMO would do well to seek lore within its pages. Describing the website expansion as a "treasure trove" of new info, 38 Studios has added new landing pages, navigation features, and information about one of the game's races: the Gnomes. The Gnomes are described as "an enigmatic people. They bestow wondrous gifts of knowledge, medicine, and magic to befriend the other kingdoms, yet seldom reveal their plans or intentions to outsiders." It's interesting to note that the Gnomes are divided up into three casts, which does tempt the mind into thinking the word "classes." Kingdoms of Amalur: Reckoning is the single-player RPG that's meant to fill the role of a prologue -- in both real-world and in-game time -- to the much larger Copernicus MMO.     While 38 Studios' top-secret Project Copernicus MMO lacks a proper title or most of its details, at least we can now visit the world that it and its single-player RPG brother, Kingdoms of Amalur: Reckoning, inhabits. The studio launched a pair of websites devoted to the game world and its first game today. Over on Amalur, 38 Studios has unleashed its loremasters to share with you the stories, features, histories, and settings of this fantasy landscape. And while Reckoning is just a prequel to the eventual MMO, its website contains quite a few lore snippets as well as a world map to pour over while you're planning your future conquests. As part of the twin projects, R.A. Salvatore has created over 10,000 years of fictional history for the world of Amalur, stretching from The Deep Gloam to the Age of Heroes. Reckoning takes place during the Age of Arcana, with Copernicus happening some time thereafter.

    Forum lurkers rejoice! There's a brand-new board for you to haunt, and it's kinda sorta related to an upcoming fantasy MMORPG. Curt Schilling's 38 Studios has just published its community portal for Kingdoms of Amalur: Reckoning, and while the title isn't massively (or particularly multiplayer), it is affiliated with 38's secretive Copernicus MMO. When we say affiliated, we mean that the two titles share the same fictional world, so lore junkies will want to bookmark the new boards and set about discussing histories, race lore, and anything else pertaining to the realm of Amalur. There's also the requisite community chat section in case you feel like a bit of the ol' ultraviolence with your fellow Amalurian forumites, so head to the official Reckoning site and register right away!

    38 Studios has been in the news quite a bit over the last year despite not having a released game under its belt. While the upstart company still lacks a finished product, it's one step closer with today's release of the first gameplay trailer for Kingdoms of Amalur: Reckoning. The footage from the upcoming single-player RPG gives fans a first look at the world of Amalur, which 38 Studios will revisit in the Copernicus MMO to follow. In addition to featuring company president (and former World Series MVP) Curt Schilling, Reckoning boasts an impressive array of talent from both 38 Studios and Big Huge Games including lore-master R.A. Salvatore, former Morrowind and Oblivion lead designer Ken Rolston, and Spawn creator Todd McFarlane. The video clip showcases a good look at Amalur's fantasy trappings, glimpses of combat with several creatures (including a big bad), and a 2012 release date. Check out all the details after the cut.

    One thing is for certain: When you are sitting in the crosshairs of Curt Schilling and R.A. Salvatore during an interview, it's easy to become bowled over by their collective intensity and passion, especially when it comes to their interest in games and fantasy worlds. While GenCon Indy lacked its usual MMORPG presence this year, Massively was able to grab a few minutes of face time with 38 Studios' founder and lead writer as they passed through the convention. It was a bit of an odd interview, however, as two of the biggest topics -- 38 Studios' move to Rhode Island and any solid details about their top-secret MMO -- were off the table for discussion. Do not fret, as that certainly didn't stop us from trying to pry for a few hints along the way. Schilling and Salvatore were obviously eager to spill the beans about Copernicus, but they are still biding their time until the right moment. Happily, the duo didn't mind us fencing with them for facts, and were quite open about their single-player RPG lead-up to Copernicus, their general philosophy of designing the MMO, and why they've waited so long to unveil it to the public. Read on, gentle gamers, for a few ripostes, parries and lunges with two of the biggest figures in the industry right now.
