<title><![CDATA[Samsung wins ITC ban of AT&amp;T compatible iPhones and iPads due to patent infringement]]></title>

<p>Samsung got a big win in the International Trade Commission today, as the ITC handed down a final ruling finding that several models of AT&amp;T-compatible iPhones and iPads infringe a Samsung patent, and issued an exclusion order preventing them from being imported, sold or distributed in the US. This final ruling comes months after an <a href="http://www.engadget.com/2012/09/14/itc-says-apple-didnt-violate-four-samsung-patents/?utm_source=Feed_Classic&amp;utm_medium=feed&amp;utm_campaign=Engadget">ALJ determined</a> that Apple did not infringe any of Samsung's IP, but clearly, the commission felt differently upon its review. This final determination holds that AT&amp;T models of the iPhone 4, 3GS and 3G, plus AT&amp;T iPad 3G and iPad 2 3G models infringe four claims of Samsung's patent number 7,706,348 for encoding mobile communications.</p>

<p>The ITC reversed the ALJ's ruling in part based upon modified construction of several key terms in the claims at issue, but upheld the prior decision regarding the other three patents Samsung asserted in the action. So, what does this mean for Apple? Not a tremendous amount, truthfully, as the newly banned devices are no longer Cupertino's standard bearers and account for little of <a href="http://www.engadget.com/2013/04/23/apple-posts-q2-2013-earnings/?utm_source=Feed_Classic&amp;utm_medium=feed&amp;utm_campaign=Engadget">massive profits</a>. Plus, Apple will, no doubt appeal the decision in court. Still, Samsung's bound to feel pretty good about the victory, and every little bit helps in its quest to remain <a href="http://www.engadget.com/2013/05/14/gartner-android-samsung-q1-2013/?utm_source=Feed_Classic&amp;utm_medium=feed&amp;utm_campaign=Engadget">atop the smartphone heap</a>, right?</p>

According to <em>O Globo</em>, if you're willing to pay upfront in full (and by phone) you can even snatch an extra 10 percent off both. Otherwise, Brazilians will need to visit the online store to lay claim to the heavily-discounted handsets.</p>

It looks like today's the day we finally get more information. (<em><strong>Update: </strong>see our hands-on <a href="http://www.engadget.com/2013/03/26/t-mobile-iphone-5-hands-on/?utm_source=Feed_Classic&amp;utm_medium=feed&amp;utm_campaign=Engadget">here</a>!</em>) The iPhone 5 will be available in retail stores and online starting April 12th, but you'll be able to <a href="https://explore.t-mobile.com/iphone-5">pre-order</a> one beginning April 5th. Additionally, the <a href="http://www.engadget.com/2011/10/14/iphone-4s-review/?utm_source=Feed_Classic&amp;utm_medium=feed&amp;utm_campaign=Engadget">iPhone 4S</a> and 4 will be coming to "select markets," though we haven't seen details on which markets or when they'll be offered.</p><p> What about pricing? You can grab the iPhone 5 for $100 down and pay the rest in $20 monthly installments for the next two years; the 4S will be $70 down (with the same $20 installments) and the 4 will be $15 down with $15 monthly payments. No doubt, this move will make its forthcoming LTE launch even more enticing, but that's not all: T-Mobile CEO John Legere stated on stage that his company's version of the iPhone 5 will support AWS HSPA+ in addition to LTE. A dispute regarding flight / airplane mode also went in <st1:city w:st="on">Cupertino</st1:city>'s favor on October 11th, because the technology in question was regarded by the court as incremental. In tandem with a native app, the service allows paying for goods at British shops by tapping the phone at a Visa-capable <a href="http://www.engadget.com/tag/NFC/?utm_source=Feed_Classic&amp;utm_medium=feed&amp;utm_campaign=Engadget">NFC</a> terminal without needing the short-range wireless built-in. Any purchases under <span>&pound;20 ($32) can even skip the PIN code, if you're just in that much of a hurry to get a Pret </span>&Agrave;<span> Manger sandwich. </span>Only 1,000 of the 9,000 who pre-registered for TouchPay are getting into Visa's wallet-free initiative at this stage, although all NatWest and RBS customers with one of Apple's semi-recent smartphones can participate once a trial run is over. It probably won't be his last. Despite the obvious knee-jerk reaction regarding the <a href="http://www.engadget.com/2012/09/18/ios-6-review/?utm_source=Feed_Classic&amp;utm_medium=feed&amp;utm_campaign=Engadget">Maps debacle</a>, it's actually interesting that this particular scenario is yet another example of humans having extraordinarily short-term memories. It's the same reason that whatever game we most recently saw is the "best or worst ever." (<a href="http://espn.go.com/blog/nfcnorth/post/_/id/46855/full-nfl-statement-on-packers-seahawks" target="_blank">Packers v. Seahawks 09.24.2012</a>, I'm looking at you.) In truth, Apple has a fairly solid history of ingesting pride in the iPhone era, when it surged headfirst into the realm of serving <i>consumers</i> in a way that it never had before. And moreover, hearing Cook apologize isn't something that should be mocked or berated; one can only hope that more companies of all shapes and sizes develop a policy of listening and reacting. Allow me to explain.</p>

But now it looks like the party is over -- at least according to the chip maker itself. Citing events "in the normal course of business" the firm believes that its technology won't be making it into Apple's next handset -- unsurprisingly a big blow for its shareholders. While it remains unconfirmed, Audience suggested in a conference call that Apple has built its own audio team. Something that is possible already <a href="http://www.engadget.com/2012/07/09/noise-free-wireless-alleges-apple-is-tone-deaf-over-patent/?utm_source=Feed_Classic&amp;utm_medium=feed&amp;utm_campaign=Engadget">creating a hubbub</a> with other industry players. Though all things going well, we'll only have to <a href="http://www.engadget.com/2012/09/04/apple-announces-presumed-iphone-5-launch-event-for-september-12t/?utm_source=Feed_Classic&amp;utm_medium=feed&amp;utm_campaign=Engadget">wait a week until</a> the new iPhone hits the <a href="http://www.engadget.com/tag/ifixit?utm_source=Feed_Classic&amp;utm_medium=feed&amp;utm_campaign=Engadget">surgeon's bench</a> anyway.</p>

That first version is still undergoing testing, according to Mophie reps, so we don't know just how far it can dunk with letting down its guard to condensation, but we do know that it will retail for $149. A land-only version will also be available for $129, and unlike the sealed model, your iPhone's display will still be exposed, giving you full access to the device. Both cases include a dedicated shutter release, which works in camera mode, letting you snap away under the sea. They also ship with a trio of mounts for your helmet, handle bars or a flat surface. As it stands, the case involves seven patents that mostly touch on staple technologies of the modern mobile world, such as syncing messages between devices and bookmarking media playback on one device to resume on another. Does that last technique sound familiar? You might recall it being a cornerstone of the movie and podcast support that Apple has implemented <a href="http://www.engadget.com/2005/05/23/itunes-4-9-adding-support-for-podcasts/?utm_source=Feed_Classic&amp;utm_medium=feed&amp;utm_campaign=Engadget">since 2005</a>. Despite reaching that far back into history, Motorola is just as eager to modernize the targeted hardware list to keep its complaints relevant -- the <a href="http://www.engadget.com/2012/03/16/apple-ipad-review-2012/?utm_source=Feed_Classic&amp;utm_medium=feed&amp;utm_campaign=Engadget">current iPad</a>, the <a href="http://www.engadget.com/2011/10/14/iphone-4s-review/?utm_source=Feed_Classic&amp;utm_medium=feed&amp;utm_campaign=Engadget">iPhone 4S</a> and other devices are at risk of a trade ban, posing more of a threat to Apple's bottom line than the dust-covered (and <a href="http://www.engadget.com/2012/04/24/itc-judge-finds-apple-in-violation-of-motorola-wifi-patent/?utm_source=Feed_Classic&amp;utm_medium=feed&amp;utm_campaign=Engadget">near-finished</a>) <a href="http://www.engadget.com/2010/10/06/motorola-suing-apple-for-patent-infringement/?utm_source=Feed_Classic&amp;utm_medium=feed&amp;utm_campaign=Engadget">initial legal challenge</a> from October 2010. Before coming to any conclusions, though, remember that the newer complaint isn't likely to have any speedy resolution of its own. Past <a href="http://www.engadget.com/tag/ITC/?utm_source=Feed_Classic&amp;utm_medium=feed&amp;utm_campaign=Engadget">ITC</a> cases have usually taken a year and a half to complete, which could leave most or all of today's technology as another distant memory.</p>

Specifically, the note informs employees that prices from Best Buy, "carriers," <a href="http://www.engadget.com/2011/07/30/iphone-price-cuts-hitting-radio-shack-target-tomorrow/?utm_source=Feed_Classic&amp;utm_medium=feed&amp;utm_campaign=Engadget">Radio Shack and Target</a> can be matched, with $49.01 seeming to be the savings across the board. Curiously, places like Wirefly, Amazon, Negri Electronics and even Walmart aren't mentioned, so we wouldn't recommend trying to work the price down based on ads seen from any of those. The note also mentions the iPhone 4 and 4S exclusively, and we're fairly sure this sort of goodwill won't ever been applied to iPad, Mac hardware or pretty much any other Apple kit. Of course, <a href="http://www.engadget.com/2011/12/09/apple-just-arrived-at-grand-central-station-we-hop-aboard-vide/?utm_source=Feed_Classic&amp;utm_medium=feed&amp;utm_campaign=Engadget">crazier things</a> have happened. The update is available to download now and adds several mobile-centric features, including offline reading. <a href="http://www.engadget.com/2012/07/12/sinking-social-news-site-digg-bought-for-500k-by-nyc-firm-betaw/?utm_source=Feed_Classic&amp;utm_medium=feed&amp;utm_campaign=Engadget">Under new ownership</a>, Digg's renovated app plays nice with both <a href="http://www.engadget.com/tag/facebook/?utm_source=Feed_Classic&amp;utm_medium=feed&amp;utm_campaign=Engadget">Facebook</a> and <a href="http://www.engadget.com/tag/twitter?utm_source=Feed_Classic&amp;utm_medium=feed&amp;utm_campaign=Engadget">Twitter</a>, while a new 'Paperboy' feature will detect when you're at home (once calibrated) and help ensure you never leave the front door with old news. However, you'll have to be willing to hook up your Facebook account to bookmark and share between your phone and the standalone homepage. There's also no sign of a corresponding Android version just yet, but you can take the iOS app (and the refreshed site) for a spin at the sources below.</p>

Here's where <a href="http://www.engadget.com/tag/mophie/?utm_source=Feed_Classic&amp;utm_medium=feed&amp;utm_campaign=Engadget">Mophie's</a> newly introduced Outride comes in, which clearly -- and as the company's quick to point out -- takes a heavy cue from <a href="http://www.engadget.com/2011/10/14/iphone-4s-review/?utm_source=Feed_Classic&amp;utm_medium=feed&amp;utm_campaign=Engadget">GoPro's action shooters</a>. All inspirations aside, though, the Outride iPhone companion's pretty well-stacked on its own, with Mophie offering an integrated polycarbonate case / mounting system that features waterproof and high-impact protection to help the daring folk during those intense, rush-filled adventures. Additionally, Mophie's taking things beyond the hardware and also announced a free application to pair alongside the Outride unit; this will give people a place where they can create a profile and share their video recordings with other riders. The outfit's pricing the <a href="http://www.engadget.com/2010/06/22/iphone-4-review/?utm_source=Feed_Classic&amp;utm_medium=feed&amp;utm_campaign=Engadget">iPhone 4</a> / <a href="http://www.engadget.com/2011/10/14/iphone-4s-review/?utm_source=Feed_Classic&amp;utm_medium=feed&amp;utm_campaign=Engadget">4S</a> accessory starting at a peaceable $130, and it should be up for grabs around "mid-September." The Sony-styled prototypes came later, and were apparently just an "enjoyable side project." <em>AllThingsD</em> has also drawn together around 100 prototypes from Apple's deposition, which offers some interesting insights into what the iPhone <em>could</em> have looked like.</p>
