The game's back on. Palm just announced the availability of its 1.2.1 update to WebOS for the Palm Pre and, well, that's it <a href="http://www.engadget.com/tag/pixi">for the time being</a>. It fixes Exchange mail syncing issues experienced by some users, which is nice, but for everyone else it re-enables media sync with iTunes 9.0.1, with or <a href="http://www.engadget.com/2009/09/22/apple-palm-hear-privately-from-usb-if-on-itunes-spat-involveme/">without the USB-IF</a>'s support. In fact, Palm has signaled its commitment to its rogue approach by improving synchronization with the Photos app to keep the album structure in tact while allowing lower-resolution images to be synced to the Pre. The very public fight between Palm and Apple to allow the Pre to sync directly to iTunes (without just... you know, <a href="http://www.engadget.com/2009/07/30/editorial-palm-itunes-and-the-ties-that-dont-bind/">doing it the same way as everyone else</a>) is showing no signs of slowing down, with Palm continuing to pursue every angle it can to rile up Cupertino -- most recently <a href="http://www.engadget.com/2009/07/24/palm-complains-about-apple-to-usb-governing-body-while-pre-it/">taking the battle up to the USB Implementers' Forum</a> in an effort to stop Apple from restricting iTunes usage by the hardware's Vendor ID. Hard to say what ended up going down behind closed doors, but on an official level, the USB-IF is issuing a terse statement that it "communicated its position on the matter to both companies" and won't be speaking further on the issue "at this time." We'll see if anything ends up changing on the software side from the conversation, but separately, the Forum has mentioned to us that it considers this a member-to-member concern -- so in all likelihood, they're taking a hands-off approach.<br />

<strong>Update:</strong> <em><a href="http://digitaldaily.allthingsd.com/20090922/usb-if-slaps-palm/">Digital Daily</a></em> has come away with a very, very different story from the actual leaked communication, and it turns out that the USB-IF has actually sided against Palm on two different fronts. First, the Forum has told Palm that it doesn't see how blocking Palm's Vendor ID from accessing iTunes violates its policies; and second -- this might be the big one -- Palm's actually riled up the Forum by saying that it'll be using Apple's Vendor ID on the Pre going forward. It wants a clarification of Palm's "intent" within a week, saying such a move would be contrary to the rules and regs set out for the proper use of USB. Here we go again: round umpteen of the fight to <a href="http://www.engadgetmobile.com/tag/itunes,pre">break and re-enable Pre syncing with iTunes</a> is now underway thanks to the release of <a href="http://www.engadget.com/tag/iTunes9/">iTunes 9</a>, and we're sure there's plenty more where this came from. Endlessly amusing to casual observers, yes, but Pre customers are the ones losing out -- sure, Palm might be able fix this in a jiffy (especially since they <a href="http://www.engadget.com/2009/09/09/the-palm-pixi-is-official-headed-to-sprint-this-holiday-season/">continue to tout compatibility with the Pixi</a>), but meanwhile, media sync's out of the picture once more. So I was out of town last week when Apple and Palm got into it over the Pre syncing with iTunes, and the more I think about it, the more ridiculous the situation has become. If you'll remember, the Pre shipped with a hack that <a href="http://www.engadget.com/2009/06/04/confirmed-palm-pres-itunes-support-is-very-very-hacky/">allowed it to appear as an iPod</a>, which was <a href="http://www.engadget.com/2009/07/15/itunes-8-2-1-brings-pres-music-syncing-capability-to-a-halt/">inevitably blocked by Apple</a>, and Palm's latest move was to <a href="http://www.engadget.com/2009/07/23/palm-webos-1-1-now-available-fixes-itunes-sync/">spoof the Pre's USB Vendor ID</a> to make it look like an Apple product while <a href="http://www.engadget.com/2009/07/24/palm-complains-about-apple-to-usb-governing-body-while-pre-it/">simultaneously complaining</a> to the USB Implementor's Forum that Apple improperly uses the field. While we thought the next round of the <a href="http://www.engadget.com/2009/07/23/palm-webos-1-1-now-available-fixes-itunes-sync/">Pre / iTunes syncing fiasco</a> would probably be something simple like Apple <a href="http://www.engadget.com/2009/07/15/itunes-8-2-1-brings-pres-music-syncing-capability-to-a-halt/">releasing another quick patch</a>, Palm has stepped it up a notch by complaining to the USB Implementers Forum over what it sees is "improper use of the Vendor ID number" by the gang at Cupertino. What the company means is that when an ID is applied for, a form is signed that states:<blockquote>"Unauthorized use of assigned or unassigned USB Vendor ID Numbers and associated Product ID Numbers are strictly prohibited." </blockquote>The implication here is that Palm believes Apple is violating this stature by disallowing certain Vendor IDs -- namely, Palm's -- from using iTunes. So how'd Palm manage to "fix" that syncing hole Apple managed to fill? From the looks of it, by misrepresenting its own Vendor ID, so that the Pre now shows up as a <a href="http://www.engadget.com/tag/iPod/">iPod</a> / mass storage device made by <a href="http://www.engadget.com/tag/Apple/">Apple</a> (ID 0x05ac) as opposed to one by <a href="http://www.engadget.com/tag/Palm/">Palm</a> (ID 0x083) -- hence the complaint. Of course, lying about your own ID would seem to break with the aforementioned rule, too, so what we're left here is some muddled grey area and Palm apparently being okay with fudging some data to correct what it sees is an injustice. If anyone's curious, <em>DVD Jon</em> points out that the root USB Node is still identified as "Pre," so we very likely could see another round of these shenanigans in the not-too-distant future.<br /><br />Finally, now's as good of a time as any to take a look at some of the peripheral casualties from this war of attrition. In an essay on his personal site that's been circulating the interwebs, Marc Deslauriers outlines the pangs he and the Linux community have felt over the years trying to use iPods on the open source platform, surmising that Apple is intentionally and repeatedly seeking ways to block non-iTunes programs from syncing in any way with its devices. Palm itself had warned that the <a href="http://www.engadget.com/tag/pre,itunes">Pre's iTunes sync functionality</a> could be broken at a moment's notice (and at Apple's whim), but we're pretty sure no one expected it'd happen <em>this</em> quickly. We've been able to confirm that version 8.2.1 of the software prevents the sync from working, meaning that you've got to add music the old-fashioned way -- the Pre functions as a USB drive, too -- until Palm gets around to patching the hack (if they decide to patch it, that is). This could end up being a protracted game of cat-and-mouse, which is entertaining to watch but nightmarish for the consumers down in the trenches actually trying to use this stuff. Funny thing is, Apple's straight up saying in its release notes that the update "addresses an issue with verification of Apple devices" -- in other words, they weren't being verified before, and now they are, thank goodness. Peaceful sleep is once again within our reach.<br /><br /><strong>Update:</strong> Apple's now gone beyond the "verification of Apple devices" phrase, calling out the Pre by name in a statement <a href="http://www.businessweek.com/technology/ByteOfTheApple/blog/archives/2009/07/apple_to_palm_i.html">issued to <em>BusinessWeek</em></a>: "It also disables devices falsely pretending to be iPods, including the Palm Pre. As we've said before, newer versions of Apple's iTunes software may no longer provide syncing functionality with unsupported digital media players." In other words, "we told you this was going to happen, and it did." For its part, Palm appears to have re-issued the same statement it made <a href="http://www.engadget.com/2009/06/17/palm-responds-to-itunes-pre-statement-defiant-and-unfazed/">a while back</a>, saying that Apple's move is a "direct blow" to its users. This could end up being a protracted game of cat-and-mouse, which is entertaining to watch but nightmarish for the consumers down in the trenches actually trying to use this stuff. Funny thing is, Apple's straight up saying in its release notes that the update "addresses an issue with verification of Apple devices" -- in other words, they weren't being verified before, and now they are, thank goodness. Peaceful sleep is once again within our reach.<br /><br /><strong>Update:</strong> Apple's now gone beyond the "verification of Apple devices" phrase, calling out the Pre by name in a statement <a href="http://www.businessweek.com/technology/ByteOfTheApple/blog/archives/2009/07/apple_to_palm_i.html">issued to <em>BusinessWeek</em></a>: "It also disables devices falsely pretending to be iPods, including the Palm Pre. As we've said before, newer versions of Apple's iTunes software may no longer provide syncing functionality with unsupported digital media players." In other words, "we told you this was going to happen, and it did." For its part, Palm appears to have re-issued the same statement it made <a href="http://www.engadgetmobile.com/2009/06/17/palm-responds-to-itunes-pre-statement-defiant-and-unfazed/">a while back</a>, saying that Apple's move is a "direct blow" to its users. Despite Cupertino's update to its support site last night, Palm seems unconcerned, as relayed by a spokesperson to <em>Digital Daily</em>. In a statement, the company said disabling the sync "will be a direct blow to their users who will be deprived of a seamless synchronization experience" and that "there are other third-party applications we could consider." In other word, it'd be Apple's loss. We're not quite sure we agree there, nor would we really think "stay with the iTunes version that works to sync their music on their Pre" method is really the best suggestion, but hey, we're not the multimillion dollar phone manufacturer here. Careful analysis of a Pre's identity to its host system when connected via USB has now confirmed what's been suspected for a few days now -- the way it <a href="http://www.engadgetmobile.com/2009/05/28/itunes-support-confirmed-for-palm-pre/">hooks to iTunes</a> is very shady indeed. Turns out that the Pre identifies itself as an iPod when it's in Media Sync mode, but <em>only</em> on the system's mass storage interface; the root USB node still comes through as a Palm Pre, which Apple could easily tease out and block if it so chose. We'd <a href="http://www.engadget.com/2009/05/28/palm-pre-said-to-sync-up-nicely-with-apples-itunes/">already heard</a> through the gravevine that iTunes support would be baked into Palm's forthcoming <a href="http://www.engadget.com/tag/Pre/">Pre</a>, but now it's official. During Palm's D7 keynote today in Carlsbad, Paul Cousino showed attendees that non-DRM music, photos and videos could be synced with the Pre via iTunes (on Mac and Windows, naturally). In his words: "It shows up in iTunes just like a regular device." <br /><br /> <strong>Update</strong>: So, Palm has <a href="http://investor.palm.com/releasedetail.cfm?ReleaseID=386488">issued an official press release</a> detailing the new webOS features shown today at All Things Digital. The so-called media sync feature is straight up designed to "synchronize seamlessly with iTunes," giving users the ability to use Apple's media management software for transferring all non-DRM media. There's been no direct confirmation just yet, but <em>Fortune</em> has it that Palm's hotly anticipated <a href="http://www.engadget.com/hub/palm-pre">Pre</a> actually syncs with iTunes. Yeah, <a href="http://www.engadget.com/tag/iTunes/">iTunes</a>. According to the report, the Pre works "seamlessly" with iTunes on a Mac, with the only notable limitation being that it can't handle older <a href="http://www.engadget.com/2009/01/06/itunes-going-primarily-drm-free/">DRM-laced files</a> from the sad, sad days of our past. Even wilder, we're told that the iTunes Store "treats the Pre just as it would an iPod or an iPhone" save for the aforesaid exception, which leads us to wonder how Apple will react. There's little doubt that this factoid sweetens the Pre value proposition for diligent Mac users, but is this functionality kosher with the software's creator? We already saw Tim Cook glance sternly at Palm while uttering that if anyone else "<a href="http://www.engadget.com/2009/01/21/apple-on-smartphone-competition-if-others-rip-off-our-intellec/">ripped off its intellectual property, it would go after them</a>," and we highly doubt he plans on backing down if push comes to shove.
