If they were in fact using the trademark iPhone, their attorneys would have made sure that they had the correct indicator on the package. If touch-screens were so great we would have been using them for decades now to input text into home computers and such. Battery life will suck also and since it`s NOT user replaceable you can go pay Steve to get another iPhone when this one dies. And NO third-party apps. They way they fight legally is very instructive. They try to bully. All that came undone when they thought that Creative and the Court would roll over because it was Apple. Well their arrogance then cost them $100mm paid to tiny Creative.<br><br>I had hoped that that would be a lesson to Apple to change their behavior (like spurious suits against use of "POD" which Apple didn't invent).<br><br>Then came the arrogance of the cheating/fraud on Options. Now being investigated.<br><br>Now we have two companies, Apple and Cisco, fighting each other over a name and the validity of a patent. Apple should have reeached out to Cisco years ago, because they (Apple) knew for sure the direction of their product roll out and the approximate schedule. I therefore have little sympathy for Apple entering into discussions with Cisco so late in the game. Only this time it's not a Mom & Pop Store or a small Creative it's huge Cisco. We have two giant egos involved here.<br><br>All in ALL, IMHO, it's time that Apple changed behavior and started acting more responsibly. I couldn't say who will win this latest suit as new "information" comes out daily. Apple is a hugely innovative and technically brilliant company, with terrific marketing. Just tone it down guys a bit and stick to doing business the old fashioned way. The right way, instead of trying to use Apple "might" to roll everyone over. If you don't the inevitable WILL happen. It may even be happening already unfortunately.<br><br>Am I anti Apple? Not really, many in my family have bought iPods for themselves and for others as presents. When filing a renewal, a declaration of use is required.  But not all companies have their mark in commerce at the time of renewal.  Within the Trademark Law Rules of Practice, they do allow for excusable nonuse if the applicant has valid reason.  They do have to stipulate when the mark will be in commerce.  It is not clear if Cisco renewed under excusable nonuse, or tried to pretend that the mark was in commerce (active use).  Since only Cisco and the Trademark office know, anything we say is speculation.  This chapter is far from closed.
