Don't forget that to make the original suit go away Apple Computer signed an agreement to never enter into the music distribution business. They may have won in the recent suit but does that really sound like they lived up to their agreement?
They never said that they wouldn't distribute music. The original agreement was that they would never PUBLISH/PRODUCE any music. Apple doesn't make the music they just help sell it for the music companies. So Apple did follow the agreement.
