Sculptor crafting 3D replicas of your Mii

I'm no fan of lawsuits, etc, but wouldn't this be in violation of a trademark, copyright or something?

I've got a friend and former professor who's doing this already. Taking orders for 6" Mii figurines at $50 a pop. Check him out here if you don't want to wait and if you want something bigger than 3.5".

Since a Mii is more or less a style I don't think you can copyright that.
That would be like.. copyrighting a font.. oh wait.
