Gibson fires Guitar Hero lawsuit at Wal-Mart, other retailers

Last we checked we actually weren't in the Twilight Zone, but quite frankly, the bigwigs at Gibson just might be. Seemingly out of nowhere, the famed guitar manufacturer sparked up a lawsuit against Activision claiming that Guitar Hero titles violate one of its patents. Now the company appears to be on the warpath, suing Wal-Mart, Target, GameStop, Amazon, Toys 'R' Us and Kmart in an attempt to get the game off of store shelves. Reportedly, Gibson took "this action reluctantly, but is required to protect its intellectual property." For the retailers that did comment, they chimed in only to say "we aren't commenting," and judging by the looks of things, the games are still widely available -- for now.

If there's a patent probem why are they suing the stores who are selling the product who got it FROM the manufacturer? Are stores required to look up every freaking patent of every damn item they sell? Which I'm still trying to figure out how they can sue the stores (unless they have given them fair warning that this is a patent infringment product). Wouldn't it just be easier and more cost efficent(but i guess less profitable to Grabsome if they win opps I mean Gibson)to send out letters saying take this off your shelves now? And hummmm they're going after so many BIG companies, who will probably ban together both lawyers and money and well, Grabsome, (darn it I mean Gibson, I keep thinking of the money they're trying to grab), can you patent the cry you'll give when you lose? That way no one can say whaaaaaa anymore (even with your permission!). Sure am glad my first guitar was a Kay! (yep I guess I just dated myself!)

Between reading this article and being able to afford a P.R.S. i'd rather put strings on a canoe paddle and strum it than touch another Gibson.
