Creative could pay class-action settlement over exaggerated MP3 capacities
Couldn't fit those last two Oingo Boingo albums on your Zen when you thought you had enough space? Get ready for payback, because if you own a Creative Labs MP3 player made between May 5, 2001 and April 30, 2008, you could be entitled to a class-action settlement over this very issue. The proposed settlement -- not the first of its kind -- will force Creative to "make certain disclosures regarding the storage capacity of its hard disc drive MP3 players" and give a 50% discount on a new 1GB player or 20% off any item purchased at Creative's online store, if it's approved by the court. For its part, Creative denies any wrongdoing, but it looks like it's offering up the settlement to smooth thing over with consumers -- but you know it's going to fight the $900,000 requested by plaintiffs' attorneys in fees. Applications are due by August 7, 2008, so start digging up those serial numbers.

I, for one, am quite happy with my Creative Zen Stone, it's nice to have an mp3 player that your not out $200 if you drop.

you've got to love the non-tech world... binary math is great.... 1024.... you'd think by now the world would just no this difference.... oh well, that all said, I just got a Zen last March.... looking forward to my reward...

Creative is right. Let's see...class action, we need to 'reward' the consumers who are affected...I know, let's give them a 'discount' so they can give us more money to get their 'reward'...very Creative!

It really is about time the PMP and Hard drive manufacturers (and all the laptop and desktops as well) stopped lying about hard drive capacity. Just use proper GB and not this rounded to the nearest factor of 10 rubbish.
I bought a 40G Creative Nomad Zen Xtra in 2004. Like its name, it's big and clunky; it's also ugly, and it has a crappy LCD display. And I love it. It cost half of what an iPod (with half the capacity) was going for back then, the battery still works like it did on day one, and I don't have to deal with frickin iTunes DRM nonsense. With 438 entire albums, it's barely over half full.
I'm disappointed in Creative's "competitive" marketing, but I am immensely satisfied with the product. Because I have been around a couple of computers in my lifetime, I also knew that "40GB" meant capacity, not actual usable storage space (and I realized that the OS's simplicity meant a light footprint, which in turn meant more available storage space).
So I won't be participating in this BS lawsuit. Creative deserves better.
And no, you can't have my serial number.

My Zen Vision W is a great video player, espec. after I swapped the 30GB drive out for an 80GB.
The new Zens are a step down from the HDD-based players IMO.
That's right, I did get what I paid for--an awesome PMP in the Zen Vision:M. Not an overpriced item from another manufacturer that limits the formats I can play, makes me a target of thieves that know people will pay a premium for their limited product and doesn't think people would like things like a radio included in a media player. Yup, you sure taught me, Creative, by giving me an excellent product for my money....pure evil!
I'm taking the 20% discount coupon and I'm using it to buy another player from Creative, giving them even more of my money. I'm just crazy enough to do it!
it makes me sad to see companies getting their pants sued off for using SI prefixes properly by describing a base 10 number rather than a base 2 number.
having what Creative charge for players on its own site, 20% off is not really a good deal!
I have 3 Creative players, but no receipts for them. Even if I wanted to get my discount I don't qualify for it,
