It's called intellectual property. There is nothing wrong with the patent system. There are things that were patented int he 1800's that still the technical how to has not been invented. Apple is one of the biggest to patent things that they have no intent on producing. Once the technology to manufacture something has been invented it's easy to make it. The hard part is thinking up exactly how it will work. The people claiming the patent system is failed need to try dreaming up something and then making it, especially if it involves technologies that haven't been perfected or even thought up yet. All patents must include a precise technical drawing at least, and better to have a working prototype, but the prototype is not required if the technical drawings are up to par. In 2002 the hardware for an iPhone or comparable device was not available. Don't bring up Palm Treo or Newton and try to compare them to the iPhone. We are talking light years apart. Now as for Star Trek dreaming up all these devices, Gene Roddenberry wanted Star Trek to inspire people to bring the future into the present.
Don't get me wrong I am not saying that this companies patent has any validity for a law suit, but like I said before Apple is probably the worlds biggest patent things we have no intention of manufacturing ever culprits. If Steve Jobs blows his nose and whats in the napkin looks like it could be patented he does it. I for one am glad someone had the jewels to finally bring the fact that Apple is actively seeking a Monopoly! They are their business model has them controling every aspect of any of their devices. I have a simple example that proves it. They are in a suit with Psystar because Apple violently holds the view that no one what so ever should make any device to run their software, but they in turn make hardware and software to allow the end user of their computers to run Windows. This is hypocritical! This proves Apples intentions on muscling out all competition at all costs. They underhandedly paid a little more to buy up a certain manufactures stock of memory chips. There's a reason Apple die hards have a rep for being well snobbish (to remain noninflammatory). It's because Steve Jobs has that attitude it's the fundamental reason behind the split up way back when between him and you know who. Steve Jobs did not think everyone deserved a computer. This isn't a new idea to try and keep others from attaining the knowledge that only they and a select few hold. It is exampled by the fact that China had production line style factories centuries ago, but all the technology was lost until dug up recently. They did not want to share their intellectual property. Too many people do it everyday. One guy doesn't tell anyone how he always manages to own everyone in a halo free for all. Why? because he feels if he shares his secrete techniques that he won't own everyone all the time, but he fails to realize that sharing said knowledge will make is competition better and thus make him better by having to work a little harder.
Apple wants everyone to use their products because "They just work" and that is a lie. The iPhone is still very buggy. Don't get me wrong I love my 3G, but it doesn't "Just work" I understand the view point that Jailbreaking makes pirating more available, but One does not need to jailbreak to take advantage of pirated apps. If you manually add them to iTunes, iTunes will sync them to your device. Yet Apple wants Jailbreaking to be illegal. When it's the only way to get what other smart phones have and every iPhone owner wants. Hence the new 3.0 firmware to be released. I used to lose a lot of data when my iPhone would just spaz out as they are prone to do needing a restore. Well there went all my app data. No I put an end to that by jailbreaking my device and being able to not only back up all my data on the device, but I could then get into my device and manually back up all my data. I believe all devs should be paid for their work, and even deserve to set a price they feel the application is worth. I do not prescribe to the whack ideology that pirated apps are so people can try them out before they buy, or that the app was overpriced and therefore deserved to be pirated. That is a juvenile and entitlement (With NO bounds for deserving the entitlement) attitude. Which is a huge reason for the poor state of the world today, because it is the result of poor upbringing and a lack of instilled values, but I digress.
Stop defending Apple for something that they in turn do everyday, just because you love them and admire their flashy presentation. Step back and take a real hard look, because when and if Apple is successful in their ultimate business model we will all be paying a HE double hockey stick lot more for their products, because there will be no one else to get any such hardware from. Saying the patent system is failed and undermines creativity pales in comparison with what a MONOPOLY does for creativity and diversity. If you took the time to write out an idea in depth, and then produce detailed drawings of what ever would carry out those ideas, and someone came along and made that product you would feel that you deserved to be compensated for it. How come people are so quick to defend one entity over another, just because they own a device or product manufactured by that entity. People today are so hypocritical in that they just can't step out of their own skin for half a second to think about the other guy.
I wish Psystar all the best and that they finally out the fact that Apple is most definitely seeking a MONOPOLY. They are taking it to the extent of saying what you can and can not do with your property. In Apples view even though you paid for your iPhone you do not have the right to do with it as you please. That mentality is akin to a dictatorship. Do you all really want someone else making all your decisions for you? Granted 93% of the world population really truly honestly do not need to be making any decisions at all, but it's their right to make decisions be they good or bad. So really people stop being so quick to stone anyone that brings suit against Apple. They make good products, but they do not deserve your worship. I mean really they make iPod Touch user pay for firmware upgrades! How screwed up is that. Hey we neglected to add these features or fix these bugs and close these security holes, but you should pay us to take advantage of the fact that we finally got off our duffs and implemented the necessary codes to rectify the situation, but we don't feel you deserve it. Unless you fork over some more cash. That's akin to being charged for the air you breath, or charging a baby to learn things as is explores it's world.
Wake up people you are being used and misstreated, and the sad part is that you are begging for more. If your wives were charging you for affection you would be outraged. If your husbands were nice to everyone but you unless you paid him to be, you would be outraged. It's called Stockholm syndrome people!
