Asking permission from Palm is the biggest wuss move ever. Why on earth would we need permission from Palm to do something the device is clearly capable of without hacking? Look at the licensing for the phone - it's all open - you can do what you want.
If it was me I would ask Palm only to see if they're as awesome as they claim they are. Then I would release it regardless of what they said, and let their answer stand as proof of how stupid/awesome they are.
