AT&T loses request for injunction against Verizon's Map for That ads
Looks like AT&T's not getting its holiday wish after all -- a federal judge just ruled against Ma Bell's request to have Verizon's Map For That ads pulled off the air. That doesn't mean that this whole thing is over, though: the judge called the ads "sneaky" and said that it was possible people might misunderstand them because "most people who are watching TV are semi-catatonic." Whether or not that's enough to support a legal conclusion that the ads are misleading is a fight for another day -- specifically December 16th, when AT&T will have a second chance to argue its case. Still, this is a big win for Verizon -- everyone ready to be inundated with these ads for the next month?

3 cheers for the American judiciary and legal system. In any other country this laughable claim would have been thrown out without so much as a glance. Only we would consider viewers so stupid, I mean catatonic that they need to be told what to believe because they 'might misunderstand'. I guess we can thank our lucky stars AT&T didn't win this time.

Rather that sue, AT&T should of ran an ad that shows a guy at his desktop PC on a call with two potential vendors. The guy hits send on the PC and then asks both guys "Did you get the e-mail I just sent?", the guy on AT&T's network says "Yes, and I can meet that price.", while the other guy says "I can't fetch mail while I'm on the phone". The guy asks "why not?", announcer flashes a blank map, and says "There's no map for that."
Then Cathrine Zeta Jones from T-Mobile shows up, and say we can do that do.
And then Verizon can respond by doing the same thing, but having the guy represent them say "Let me check and I'll call you back" and then the guy who sent the message talking to the guy on AT&T say "Okay, well we can talk about the deal I guess" AT&T guy "..." PC Guy "Are you there?" AT&T Guy "... BEEP BEEP BEEP BEEP..."
And again I point out the hypocritical nature of AT&T accusing Verizon of having misleading ads. They are the ones who go around advertising about roll-over minutes and the old minutes being as good as the new, and don't point out that the old minutes can't be accessed until the new minutes are all used, so fighting over and identifying old vs new minutes is mute, because you can't use the old minute anyway.

Sure the iPhone can surf the web while being on the phone...but only if you have a 3g connection. Hmm, wait I thought edge did everything just great so who needs that 3g map!
If you don't believe me, go ahead and try it with just an EDGE connection (ie no wifi, or 3g turned on). It will give you a nice little note telling you that it can't do that.
So guess that 3g thing is pretty important huh? Oh same things goes the other way around, if you are on EDGE and surfing the web and someone calls you...no go.
Want simultaneous voice AND data? There's a map for that, and Verizon's is completely blank.

Just because YOU don't care doesn't mean other people don't or that its not a deal breaker for them. For me the ability to use both at the same time has come in handy on any number of occasions. Everyone has tradeoffs and its fair to point them out. If Verizon wants to reassure me that I can get 3G coverage in rural Montana (even though I'll probably never need it) thats cool too, because for someone else it might be important.

The semi-catatonic statement is a pretty dumb one. If that's the case, you should be able to say anything on TV, because one-way or another, the semi-catatonic viewer is likely to misinterpret the commercial truthful or not. You could argue it either way. I think after mindless bickering between attorneys, judges can be lulled into a semi-catatonic state.
I think the semicatatonic thing was in context with another statement he made. The judge basically said people might not understand it, but it is not misleading. He then said after all most people watching tv are practically catatonic.
In other words, if people are phasing out so much you could be as detailed and direct as you want, and they will still not understand.

I looked at my iPhone outside the glass cube Apple Store in NY. I got 5 bars of reception when standing one way, then zero when moving another.
I live in a suburb of Des Moines -there is one AT&T tower and we are blocked by a hill leaving a dead zone that they refuse to address. I get 2-3 bars and frequently none in my new construction house.
I am seriously thinking about leaving AT&T for a Droid until Apple releases on other networks.
haha. I so saw this coming. Those ads are just to good. I'm sorry ATT, but the truth hurts. I think that verizon's network is better, but it is soooo expensive. Im un-biased because i have a CLIQ on T-Mobile
