@Nick Brown - Return to the store and tell them about it. It's been my personal experience that Apple will often give in to such demands. I bought a MacBook Pro 15" two years ago and had several issues. Well past my 30-day return period I walked into an Apple store with another problem. The new unibodies had just released and I told them I had too many problems with the Macbook Pro I bought and that I'd like a replacement - knowing the unibodies were the only option. I spoke with the manager and he told me he'd get back to me that day. I received a call several hours later and was told I could come by the store and get a brand new MacBook Pro 15" unibody. It was that easy. No yelling - in fact, the manager practically took the reigns to make sure that it happened.
@gllopc wow, awesome. thanks for the tip! i actually bought this one from best buy but it is still within the 14 day return period so i will probably just go return it and then buy a refreshed model. :)
@gllopc Talk about backing their products: Through absolutely no fault of my own, I have received no less than 6 free Macs from Apple: I had two identical 1400c PowerBooks with identical cracks near a hinge. Two years later Apple gave us two G3 iBooks - faster more RAM, bigger HDs plus Airport. Two years later they developed identical display issues. Apple gave us two G4 iBooks - faster, more RAM, bigger HDs plus AP extreme. I had a problematic G5 dual 1.8 - after multiple repair attempts (and 42 MONTHS after purchase - way out of warranty) they gave me an 8-core Mac Pro (astronomically better). A year later I had the Apple Store install a WiFi circuit board and they scratched the case. As a result, they gave me a brand new 8-core Nehalem. My experience with flawed machines is extremely rare. Even so , show me one other computer manufacturer who could come even close to Apple in backing up its products. I haven't had to buy a new Mac in twelve years!
@J Fairweather 12 years!? That's why all macs are so expensive. Because all our money goes to these kind of crazy after support. I will definitely not buy a new mac anymore. Just make up excuses and get it replaced.
I bought a 13" MBP ($1499 model) back on March 14th and I just exchanged it tonight at my local Apple store. I knew full well that there was a refresh lingering but could not wait any longer. It was also a bit easier to pull the trigger because the sales rep. told me that within 30 days if there was a refresh, they would exchange it no questions asked. I guess I just barely made the mark! I was a bit bummed that it was still a core 2 duo but compared to my 9 year old Sony Vaio desktop this is like a Ferrari! At least Now I have the latest model for my $$$:-)
While its tablet world topping pixel density, Tegra 2 silicon, and fresh to death OS certainly sound awesome, we had to get our grubby mitts on one to see if it's as good as its spec sheet would have us believe.

That's because we MBP users are paying like 2 times what it costed Apple. It would be dumb not to get a replace. Just make up whatever excuse.
@Nick Brown You DEF should go to Best Buy and return it, tell them you didn't like and ask for a refund or grab a new one!

@Nick Brown... LOL craigslist? I did that a few years ago. The rule with Apple is NEVER buy a new computer until May 1st.
