Oracle sues Google over Java patent infringement in Android
It's no secret that Android and the Dalvik virtual machine it uses are heavily based on Java, and it looks like Oracle isn't so happy about it: the database giant (which acquired Java when it bought Sun) just announced that it's suing Google for copyright and patent infringement. The suit alleges Android violates some seven patents and contains copies of Sun's original Java code -- a damning accusation given that Google CEO Eric Schmidt once led the Java team before leaving Sun and eventually arriving in Mountain View. Oracle says Google's known about these issues for around five years now, so it's clear that whatever licensing negotiations these two were having have broken down -- we've got a feeling this case will drag on for years to come, but we'll definitely keep an eye on it.

Java is in everything - Oracle was aware of this when it bought Sun, pretty obvious they want a piece of that everything that everybody else is dieing to get into - the smartphone market or the internet business.
I'm sure people/lawyers will spend hours looking over the original licences from Sun covering the open source/free versions of Java both for private and commercial release, including how the rights to those licences changed when Sun was bought by Oracle.
And what about everybody else who uses Java - such as M$ and Apple$, IBM, possibly the entire Software industry on a global level is using a variant of Java - originally developed by Sun.
I just hope the courts throw it out.

WP7 and Android will have to compete for the limited resources of 3rd party hardware phone builders. Including HTC, Motorola, Sony, and the like.

IPhone has twice the market share of Android. Q2 2010 only means Android sold more in Q2, that's it.

Just like outselling the iPhone by 2 million phones last quarter (including the iPhones 3 weeks of pre-sale/opening weekend)...Android will keep eating that iPhone installed-based lead. That's just the way it is. Anbody can see that.
It's all about page views. ..lets give them controversy and generate more page views.

Time for android to ditch java. Since android apps do not really run anywhere but in the walled garden of anroid, the choice of Java, which is meant for portability across OS and platforms, is totally pointless.

I am afraid that Oracle is not going to win here. Google is using the Dalvik JVM. And they haven't claimed to be Java compliant anywhere. So Oracle's argument won't fly. I wish they did they. It would shut up the annoying Android haters. Alas it won't.

Oracle hasn`t a leg to stand on...
The Dalvik virtual machine is a register-based virtual machine, designed and written by Dan Bornstein with contributions from other Google engineers as part of the Android mobile phone platform.
It is optimized for low memory requirements, and is designed to allow multiple VM instances to run at once, relying on the underlying operating system for process isolation, memory management and threading support. Dalvik is often referred to as a Java Virtual Machine, but this is not strictly accurate, as the bytecode on which it operates is not Java bytecode. Instead, a tool named dx, included in the Android SDK, transforms the Java Class files of Java classes compiled by a regular Java compiler into another class file format (the .dex format).
Google never said Android was a "Java compliant" platform.
Android does not use Java bytecode.
Oracle is grasping at straws here.

Years ago to sidestep Sun , MSFT developed it`s own JVM...
Sun was not able to sue them for that , though MSFT later developed it`s own .NET language.
What Android does essentially is use a VM , which transforms code.
Just like MSFT JVM of the past.
Oracle has no recourse here.

The bytecode on which it (Android) operates is not Java bytecode.

Google it's a robber, Google between 10 years is the specialist for stolen content : newspapers, books, archive torrent vidéo, music....Android is same, stole your content, GPS localisation, read your mail, contact, ...propose contextual advertising..
If you like that choose Android.
