iPod battery settlement sorted
It's
been quite some time since the iPod battery
class-action lawsuit was brought to the attention of the San Mateo County court system, but the wait is finally
over. Apparently the appeals have ended, and according to the website, "the Settlement is now Final" for 1,
2, and 3G iPod users to get their due. However, none of this is going to help you much if you had a 1G or 2G iPod and
haven't already submitted your claim, being that even though the claims appeal process was still raging at the time,
your deadline was September 30th. Still, you have up to two years to collect your claim on a 3G iPod, which is either a
replacement battery or iPod (though we wouldn't get our hopes up on the latter), or a $50 Apple store credit.[Via iLounge]

So is this just in the US? I don't really understand the implications, but I have a 3G iPod and would gladly get a new one/battery?

finally!

What I want to know is when everyone who submitted a claim gets their settlement. My 3G's battery last for 3 1/2 hours now, I'd like to use my 50 dollar gift voucher for some remedy or possibly a new iPod.
Dominic Cordisco @ Dec 27th 2005 9:58AM
Yay hay! My fifty bucks should soon be on it's way to compensate me for my long ago first gen iPod with its failed battery. Now with that $50 store credit I can finally afford ... new iPod socks and not much else...
Off topic alert: When oh when will the iBooks go on sale? I mean, isn't Apple gonna release the new macintel iBooks in two weeks? I for one would be seriously bummed to buy a new apple lappy at full price only to have the new models come out in two weeks. Guess I'll have to refrain from spending that $50 store credit that I haven't even received yet...
Mike @ Dec 27th 2005 10:02AM
I got my battery replaced under my Best Buy extended warranty. Apple had sent me some paperwork for the $50 store credit, though it has since gone missing.
Does anyone know how to get the store credit without the paperwork? Is there a website that might help? I'd gladly use the $50 to buy some overpriced accessories from apple. ;)

How are you supposed to submit a proof of purchase if you got it as a gift?
Dan K. @ Dec 27th 2005 12:05PM
I submitted my claim well before the September 30th deadline and haven't heard a single thing. Has anyone recieved any kind of notice?

for the claim form and more information.

Where do I go to make my 3G claim?
zillionaire @ Dec 27th 2005 2:01PM
yeah, I second the gift question. I looked on the site and didn't see anything about this. I guess I could just put some random purchase down and promise it was my ipod purchase, but my girlfriend and I both have 3gs that hold a charge for about 2 minutes at this point.
Virtuous @ Dec 27th 2005 2:31PM
Now the Microsoft California settlement needs to pay out. There should be a time limit to force court settlements to pay out.
games @ Dec 27th 2005 2:48PM
I guess I'm lucky, my 3G iPod still holds a 6 to 7 hour charge. But I would be mad if after only 2 years my battery lasted an hour. I don't usually get extended warranties, but on this one I got the Best Buy 4 year warranty. A good $40 investment.
G Money @ Dec 27th 2005 3:37PM
I got the claim letter over the summer. BUT I HAVE NO PROOF OF PURCHASE, I bought the 3G when it first came out almost 2 years ago. What can i do without a reciept???
And yes my POS IPOD holds about a 2.0 hour of playtime on a whole nights carge.
Onibox @ Dec 27th 2005 4:05PM
I completed the form and checked the option for my IPOD to be sent in, I completed the form in summer of this year, and still haven't received anything, anyone know when will they ask for it or when should we send in our ipod (My one is 3rd gen).
Nate MC @ Dec 27th 2005 4:09PM
Bring on the store credit for my 2G, Poppa wants a universal dock & remote.
zed @ Dec 27th 2005 5:39PM
i bought my 3G june 2003. i only heard about this today does that mean i dont get any compesation.. wtf..
patrick @ Dec 27th 2005 5:46PM
Hm... My g3 ipod has about 3 hours of battery life, but I bought it in december a year ago. Do i get any compensation?
Ry @ Dec 27th 2005 10:36PM
I submitted claims for both a 2G and a 3G that have battery issues. I haven't heard anything back yet on either. Hopefully this will mean that the two $50 credits will show up.
Jason @ Dec 28th 2005 12:54PM
I submitted my claim back in July, hadn't heard a peep since. Perhaps I can look forward to something before the 27G iPod comes out. Yeesh.
Vaughn @ Dec 28th 2005 3:03PM
I submitted my claim awhile ago and requested that the battery be replaced. I'm under the impression that Apple will contact us via mail within the next 2 months or so now that the settlement is over.
Leway @ Dec 29th 2005 3:49AM
i submitted my claim form completed on time and i still haven't heard anything yet. i'd rather have my battery replaced with one that lasts more than 8 hrs. mine only lasts like 4 hrs if i'm lucky. $50 apple in store credit does me no good.
3G Ipod owner @ Dec 29th 2005 4:05PM
Anyone know when we will receive the benefits?
Vlad @ Jan 11th 2006 6:00PM
I also submitted a claim last summer and haven't heard anything back. So after some research here's some info.
The case is handled by Girard Gibbs & De Bartolomeo LLP (and they got $2,768,000.00 for it), and they have some details on their web site (http://www.girardgibbs.com/ipodsettlementfaqs.asp )
1. The benefits are expected to be received by the end of February 2006.
2. If you would like to verify that the Claims Administrator received your claim, you can call 1-888-385-3085 and select option 4 (FAQs) and then option 19 (followed by the pound key). Option 19 is for people who need help filling out the claims form or who would like to verify the receipt of their claim. If all personnel are busy you can leave a message to have someone call you back.
Who is going to be the first to call?
Vlad @ Jan 11th 2006 6:26PM
I just called. I was asked for the claim number, which I never had assigned. So the guy asked my for my name, and he read me back my mailing address to confirm that my claim has been received. He also confirmed that they expect the benefits in the late February.
Scott @ Jan 14th 2006 12:07AM
In my opinion, I imagine most 3g owners who opted for repair/replacement will most likely get a replacement. I think it would be cheaper, when you take in the cost of shipping, receiving, removing, installing, testing, sending back.....Chinese labor is alot cheaper than american labor. I don't expect a new ipod video rather a like kind 4th gen. Can't wait, and really I see a $50 credit as a slap in the face.
jack @ Jan 25th 2006 3:15PM
yea, i just called that number and the guy confirmed my claim by name and also informed me that they are expecting to give the benefits in late february but he said it might be moved back as it usually is.
