An actor hired by Nintendo to wear a Donkey Kong suit at a Los Angeles Zoo event last year is suing the publisher over a heart condition he claims was caused while working in the southern California heat. Attorneys for the actor tell the LA Times that he was denied breaks and not provided with a required ice pack, which led to a tearing of his aortic wall, which required surgery and implantation of a heart defibrillator. The actor was hired to wear the suit on May 24, 2013, for the launch of Donkey Kong Country Returns 3D. Attorneys for the actor also say a company ambassador hired to escort him and control activities did not provide proper oversight. On a lighter note, both the Donkey Kong Country Returns and its 3D remake were pretty good.

  • This year's Club Nintendo elite rewards are all downloadable games

Marking a change from the calendars, posters and other Nintendoodads, the 2014 Club Nintendo elite rewards for North America are all downloadable games. While that'll disappoint some of you, as a European I have to note on our side of the ocean it's all physical - and personally, not the most appealing selection either. So if you want to swap places... well, we can't, but you get the drift. As before, qualifying Platinum members can have their pick of one Gold or one Platinum gift, while Gold members have to make do with the golden selection. If I were so lucky, I'd pick one of Game & Wario, Donkey Kong Country Returns 3D, Dr. Luigi and Earthbound from the Platinum games. On the Gold side, I'm totally in the mood for some Zelda 2. Sigh.

  • Five 3DS games shifted millions in the last six months

Animal Crossing: New Leaf and Luigi's Mansion: Dark Moon are among five 3DS games that each shipped more than a million copies between April and September. The three other members of Nintendo's million-high club are Tomodachi Collection, Mario & Luigi: Dream Team, and Donkey Kong Country Returns 3D. It's New Leaf that led the way over the last six months, shipping 2.49 million worldwide and just over 2 million in the West; it came to Japan back in November 2012, before heading West in June. The cutesy sim's life-to-date figures are an impressive 6.35 million. Meanwhile, despite being released at the end of March and just before the start of Nintendo's fiscal year, Dark Moon came in second with 1.91 million. More significantly, its life-to-date total is 3.13 million. The remaining three all came in beneath the 2 million mark: the Japan-only Tomodachi Collection at 1.63 million, Dream Team at 1.37 million, and Country Returns 3D at 1.19 million. Together, the five 3DS games shipped 8.59 million units in those six months, contributing 31 percent of the system's total software shipments. If you're not all statted-out by that, here's a final bit of info for you: New Leaf's figures would put it fourth on the handheld's all-time list, behind the plumber triforce of Super Mario 3D Land, Mario Kart 7, and New Super Mario Bros. 2. That's based on figures from March 2013, though, and the new Poke-games must be closing in after selling a crazy 4 million worldwide in just two days.

  • May NPD: 3DS steals top console spot

The Nintendo 3DS finally edged out the Xbox 360 in May 2013 as the best selling console across hardware and portables, according to the NPD's monthly report on the retail sector. In what the NPD claims was a slow month overall, the 3DS landed three different games on the top 10 (including Donkey Kong Country Returns at number three, Luigi's Mansion: Dark Moon at number five, and Lego Batman 2: DC Super Heroes at number 10), and saw a sixty percent growth in software sales overall since last May. 3DS hardware sales were only even year-over-year, but that was enough to finally supplant the Xbox 360 as the top-selling platform. The other consoles didn't fare quite so well, with Injustice: Gods Among Us keeping the top spot for video game sales. Call of Duty: Black Ops 2 jumped back up into the number two spot, and Battlefield 3 reappeared at number nine. Metro: Last Light had a relatively successful showing in the number six spot, while Trion's Defiance MMO fell right off the list, after starting off at number five in April. Accessories saw a six-percent drop to $115.3 million, according to the NPD, with most of that money coming from Skylanders.

In our 2010 review of Donkey Kong Country Returns for the Wii, our own JC Fletcher admitted a terrible truth: He had used the Super Guide. Nintendo gave us the nefarious innovation a few years ago, ostensibly a tool to help less experienced players navigate the trickier parts of its games. Seasoned players recognized it for what it really was: A taunt, a gently whispering devil on your shoulder. Resisting the shiny, candy-like allure of the Super Guide is still a major component of Donkey Kong Country Returns 3D, Monster Games' 3DS rendition of Retro Studios' Wii platformer. A new difficulty setting tries to soften the Wii version's sharp edges, but the brutal structure of its levels remains intact, and no amount of extra health is going to change that.%Gallery-184939%

Donkey Kong Country Returns 3D will include an easier mode that will grant the chimp duo Donkey and Diddy Kong three hearts instead of two, as revealed in an update on Nintendo's UK site. The 3DS remake will also feature local co-op, though Nintendo didn't specify whether the multiplayer facets of the game were restricted to multi-cart play as opposed to download/single cart play. The game is slated to include content exclusive to the 3DS version, such as challenging "trophy levels" that are unlocked by collecting puzzle pieces in the platformer's original levels. Donkey Kong Country Returns 3D is due out May 24. %Gallery-184939%

The 3DS remake of Donkey Kong Country Returns will launch on May 24 in North America, according to the weirdest press release we've ever received. The news comes via a one-line press release, topped by a photograph of a gorilla. To see more of the actual game, you can check out a 3D video on the 3DS eShop. You can also refer to our review of the Wii original. We'll reiterate here: there's no shame in the occasional cry for Super Kong's help.

  • Donkey Kong Country Returns 3D being developed by Monster Games, not Retro Studios

It looks like Donkey Kong Country Returns developer Retro Studios isn't returning for the 3DS remake, Donkey Kong Country Returns 3D. According to the Australian Classification Board, the game is being developed by Monster Games, the studio behind 3DS launch title Pilotwings Resort. That leaves us with the question of what exactly Retro Studios is up to these days. Last year, Zelda creator Shigeru Miyamoto sparked interest in the possibility of Retro handling a new Zelda game, though he later said that the studio is "too busy for that sort of thing." Apparently, it's also too busy to port Donkey Kong Country Returns to 3DS. So, in the hope that we can just will it into existence, we're going to assume Retro is hard at work on Metroid Dread for the Wii U.
