Apple uses a jailbroken iPhone in patent application
Uh oh Apple -- it looks like even your attorneys are dirty, thieving jailbreakers. Tipster a|e§ was poring through that iPhone biometric security patent application we posted earlier and noticed that the images show a jailbroken phone, complete with Installer.app, SMBPrefs, and the iWood Realize theme from the iSpazio repository. We're guessing the fine folks at Kramer, Levin Naftalis & Frankel are going to have some 'splainin to do on Monday morning -- but at least they get to run apps in the background.
Update: To those of you saying that this is in reference to one of the claims of the patent, we're not so sure -- there's no reason for Apple to use images of a jailbroken phone to make that specific point. Remember, somebody drew this picture, they didn't have to use these specific icons or this theme to illustrate Springboard variations.

I noticed the Terminal App earlier, I thought 'that's odd'...
Me 2, I wondered why no one had mentioned it.
Me 3. I just assumed that the people at apple might have access to it or something.
Me 4. I just thought may be Apple itself is secretly releasing these jail-breaking apps and tools under public groups. Just like i'm 90% sure 90% of the viruses are built inside Norton, McAfee and AVG's buildings. Then they sell anti-viruses for taht sh1t.

Actually, Nilay, everyone with an iPhone gets to run apps in the background, so the ability to do so is not at all distinguishing. Now if you'd said "3rd party apps in the background," well, then you'd have one less criticism.
Listening to music while surfing the web is not the same thing as running background applications.

he's referring to the image on the right. notice no signal bars, no phone icon, no sms icon, etc etc.
and yes, the iPod Touch would have a compass icon on it for safari. why else would they put wifi in it?
FIG 5B is an iphone however fig 5c is a touch you can tell this because it has dedicated buttons for both music and video where the iphone just has a single button.
No. the figure 5C shows carrier and Wi-Fi. The Touch would not display carrier. Regardless, this is all moot because these are drawings, not actual images - they just screwed up on 5C. They have "Carrier" but left off the bars. Presumably the biometric security would not be that useful on the Touch, though I don't have one. Can you specify an unlock code for the Touch like you can the iPhone?

There is a jailbreak app that seperates music and video like on the touch. There has been since 1.1.x
there isn't a row of dots under the 4 rows of icons on 5c, suggesting that all home screen icons are on that specific screen. still no sms or phone icons. i'm pretty sure if it was an iPhone image, they would remember the most important part: the phone.
you would hope they would remember not to use a jailbroken iphone too, but we cant all get what we want :D
The patent application is titled "EMBEDDED AUTHENTICATION SYSTEMS IN AN ELECTRONIC DEVICE". Do you think they really care whether they're drawing an iPhone or an iPod Touch to illustrate these authentication systems? Also, there seems to be a reasonable explanation for the illustration of an obviously jailbroken device. They're basically saying that the patent still applies if there are different apps displayed, even ones not covered by any agreements with Apple.
I'm not sure what's funnier, the fact that Apple didn't catch this or that even their own people don't believe in a closed platform.
