  • Apple patents iTMS transaction service for iPhone

    Joining Sony Ericsson in the growing list of cellphone-related patents unearthed today, it appears that Apple is doing a good bit of work behind the scenes to ensure that future iPhone users will be able to access and purchase tunes (and video?) from the iTunes Store. Apple's recently filed "Configuration of a computing device in a secure manner" patent lays out in a good bit of detail how users of a mobile device (wireless iPod?) could access the iTMS and perform "transactions." It goes on to speak of "digital signatures" that would presumably have to be validated before any unexpected downloads took place, and it also pictures a handset (props to Nokia candybars of days past) communicating with an actual PC, which then contacts the "content and commerce" servers on the other side of the wire. In other details, there's photo evidence that some sort of downloadable upgrades / expansions could be available, probably referring to future firmware updates that could be initiated through the iTunes application. Granted, the whole mess of legal jargon is a bit hard for the layman to truly grasp, and it seems that Apple was simply throwing out as many vague words and possibilities to encompass anything that actually gets decided, but be sure to hit the read link anyway for more textual confusion and pictorial delight.

  • VirginMega France to sell DRM-free MP3s in March

    What do you do when a judge slaps down your case and leaves you no hope whatsoever? Apparently, you just do whatever the heck you want, including ditching that whole "DRM" idea altogether. Yep, as shocking as this may sound to we Americans who are essentially forced to juggle some sort of DRM on a daily basis, the French VirginMega store is planning to offer up quite a few (200,000 to be exact) tunes directly through its online music that are devoid of any DRM whatsoever, and moreover, are encoded as 256kbps MP3 files. Of course, we aren't certain if these tracks are on major or indie record labels (aside from V2Music, who has already signed on), but regardless, this is certainly a move that will elicit smiles on those fed up with proprietary formats not playing nice with a wide variety of DAPs. So if you're not too picky on what tunes you listen to, and you're down with supporting DRM-free music regardless of genre, keep an eye out for the new catalog opening up to French users this March.[Via DJing]

  • Rumors: Amazon to offer DRM-free Music Store?

    One of latest big buzz items concerns whether Amazon is courting the digital download market. Apparently, it has started talks with the major music labels. The Register talked to an Amazon spokesman who confirmed that the company was looking specifically into digital downloads. Less clear is the rumor that Amazon may be considering DRM-free offerings, a move that the RIAA is hardly likely to cheer about but one which would give Amazon a strong fighting chance in a market dominated by iTunes.

    It wasn't too long ago that ole Steve opened a few of his famed keynotes boasting about just how much money was flowing into the iTunes Music Store, and now we've even got the option to snag feature films and TV shows if our wallet so desires, but it appears that even the streamlined, previously trendy iTMS may be on the decline. It's no secret that folks looking to pick up some new tunes would like to avoid DRM at all costs, but instead of seeing CD sales skyrocket, there's simply been a general decrease across the board in the whole "music buying scene." While digital downloads initially looked to fill the void, that theory seems to have been short lived; since January, the monthly revenue going into Apple's iTMS has fallen by "65-percent," with the average transaction size falling "17-percent." Notably, it's not just Apple suffering the cashflow drought, as Nielsen Soundscan reports that the digital download "industry as a whole" is steadily declining. Additionally, research has shown that the "median household" spent just "three dollars" about six times per year, showing that digital downloads aren't exactly "replacing the CD," but rather complimenting hardcopy sales at best. Interestingly, analysts are theorizing that the DRM-era may actually be winding down in favor of "blanket licensing," which was cast aside just years ago in favor of the "per purchase" approach. Discussions are already taking place in the UK to test the waters of such a bundle package, but we don't realistically expect the business model here to change overnight -- but considering the duties the RIAA wants to toss on anything digital, we wonder just how attractive a new plan will be.UPDATE: Based on Forrester's reports, the data cited was from the first six months from the previous year, which leaves open the possibility of seasonal swings skewing sales.

  • Universal Music looking to extract royalties on every iPod sold?

    We aren't exactly sure who's getting the shorter end of the stick in Universal Music's "deal" with Microsoft to extract a set fee from every Zune sold, but now its oh-so-mettlesome CEO is thinking of putting the same pressure on ole Steve. While Jobs has certainly had a rather sour relationship with the labels over the years, and has flat our refused to boost music prices (twice) at the iTMS, this predicament could be a fair bit stickier. Doug Morris is reportedly considering asking demanding a royalty fee from every iPod sold now that he's already won the war over at Microsoft, touting Universal's massive music collection on iTMS as something fairly essential to the program's continued success. But things aren't as clear cut as the previous deal, as the Zune Marketplace was (and still is) in a position trying to grab any sliver of market share it possibly can, while Apple's rendition basically owns the digital download realm already. While it's easy to assume that both companies will agree on a ridiculously small fee just to save face, it begs the question of other labels trying to cash in at Jobs' expense if this deal goes down -- but hey, what goes around, comes around, right?

  • Rumor: iTunes Store could get flexible album pricing

    Certainly one of the drawbacks to buying music on the iTS is the single vs. album purchase: sure you can buy a song or two from an album, or maybe the hot pre-release single, but what happens if you want the rest of the album later, or when it's completely released? This has been a catch with traditional music distribution methds as well - you can either buy that $3-5 CD single release, or pony up the ridiculous price of $15-20 (and more) for the entire album. I've been hoping someone would devise a digital solution to this conundrum since I bought my first album off the store the day it launched, and Ina Fried CNET has a rumor stating that a solution could see the light of day soon. The idea is that if you've bought a track or two from an album, you can receive credit for those purchased tracks in the form of a lower total album price, should you decide you want the entire thing at a later date.If this is true, I would hope it could debut as early as January's Macworld '07 event. Ina's right - they're leaving a ton of money on the table without something like this in place, and they have the opportunity of solving an age-old conundrum in offering an appealing and fundamental advantage over the traditional brick-and-mortar method of buying music.

    Now that Microsoft has semi-abandoned PlaysForSure for their new closed Zune system in a bid to dethrone the iPod, all those puny device manufacturers, music store operators, and retail chains are starting to look rather silly for their commitment to "open standards" and "interoperability." So now SanDisk and Real are teaming up to integrate a special Sansa e200R Rhapsody-edition lineup of the #2 DAP manufacturer's popular Sansa line with the new version 4.0 of the Rhapsody music store, one of the more popular subscription-based services. The respective market shares of both companies pales in comparison to the complete dominance of Apple's iPod/iTunes combo, but the team-up might be necessary to survive in the current market climate. Having Best Buy's weight behind the partnership shouldn't hurt either. They'll be offering their own "Best Buy Digital Music Store," which will be powered by Rhapsody, and will be offering a free two-month unlimited subscription to purchasers of a SanDisk Sansa player, after which users can continue with the service for the same $14.99 Rhapsody To Go price currently charged.   • TUAW "It's Showtime!" predictions

    It's that time ladies and gentlemen: the pre-event post where the TUAW team put it all on the line and offer up their predictions on what we'll be throwing down our credit cards for after tomorrow's It's Showtime special event. In all actuality, there isn't much on the line for us, but it's still fun to see how close we can come to predicting Apple's product roadmap. Without further adieu, here are our predictions, in no particular order:Scott McNulty plays it safe with predictions that echo the rest of the Apple-anxious internets: New iPod Movies in the iTunes Music Store iTunes 7 Dan Pourhadi is as excited for iPods as the rest of us, but is also hoping for something new along the lines of other video devices, including even some sort of an Apple TV: Movie download service Video streaming device (and possibly TVs to go with it) Some kind of new iPod (leaning towards metal nano) Dave Caolo is keeping it conservative as well: Movies in iTunes Updated iPod David Chartier (yours truly) - I don't feel the need to echo what's already been said, but I am also tossing my bet in with Dan Pourhadi on a video streaming device in the specific form of an updated AirPort Express, as it is probably the Apple product of all the potential new gadgets tomorrow that hasn't been touched, updated or so much as sneezed at for the longest time. Also, along with Scott's prediction of iTunes 7, I think the new version will usher in a new name for the store.I'll also take the liberty to throw down some non-predictions: I don't think tomorrow will have anything to do with Macs whatsoever, including these new rumors of a sub-Mac Pro tower and new chips in MacBook Pros. I think tomorrow is all about the entertainment, iPods and any related gadgets, baby!But don't take our word for it - we'll find out in about 16 hours whether we're one step closer to gaining 'magic 8-ball' status.   • A list of potential movies and a name change for the iTMS

    DVguru, a sister blog, is just as excited for an iTunes Music Movie Store as we are, and they've been doing their own digging into what Apple's September 12th "It's Showtime" special event could bring. The gurus of all things DV found a post at iPodHub.net containing a supposed list of movies that will be released from Disney and their subsidiaries in the iTMS over the next year, though a source isn't cited, nor is a reason given for the one year rollout. Movies both old and new are apparently lined up from Disney, Pixar, Mirimax, Touchstone Pictures and Lion's Gate Entertainment. However, since Lion's Gate's CEO already dropped a few of his own hints, iPodHub.net might be on to something here.Also on iPodHub.net's list of source-less rumoring is (finally) a name change coming to the iTunes Music Store. Apple has stocked their digital shelves with a lot more content than simply music for quite some time now, and some kind of a name alteration is long overdue. Either way, stay tuned for our September 12th coverage to find out the juicy details on exactly what you'll be whipping out your credit cards for next week.

  • That awesome OK Go video is in the iTMS

    OK Go is a pretty rocking little band signed to a major label, but they release their videos using the grassroots goodness of the internets like YouTube and Google Video. Their latest craze is the video for a song called Here It Goes Again, and it's the work of pure genius.While the video is of course available in crummy Flash quality for free, I just noticed today that it appeared in the iTMS (link) for $1.99, and I'm having a hard time thinking of many other bands who deserve a purchase as much as OK Go for such hard and creative work - no matter how measly their cut may be.

  • myTunes brings a GUI to stripping iTMS DRM

    These crazy hackers are moving fast these days, but Engadget has stayed in stride by providing a walk-through of myTunes, a GUI front-end to QTFairUse (sadly, Windows only - for now), that python code they mentioned earlier this week (not to be confused with any other products by the name of 'myTunes').A big downer for this app, however, is the way it works its DRM-be-gone magic: it can only work on tracks as they're played in real time. Even then, you're left with a file (sans any metadata like ratings or ID3 tags) which needs to be re-constructed into a playable AAC file with a second tool, though that process seems to take mere seconds per track. Engadget recommends letting the stripping process run overnight, so you can get a good 8 hours or so of unshackled music from each batch. Check out their walk-through for more instructions and ideas on how to optimize this process.myTunes might not be pretty yet, but it sounds like the developer(s) have a polishing roadmap in place, including simplifying this to a one-step process. For now, it still is the only method we know of for setting your iTMS purchases free.

  • iTMS offers cultural explorations through music with new Back to School section

    Just in time for a new fall semester, the iTMS has introduced a Back to School (iTMS link) section, offering playlists based on the many cultures, cliques and stereotypes that (love it or hate it) exist and collide on so many college campuses across our great planet. Groups like Hipsters, Hippies, Greeks, the Honor Roll, Club Kids, The Faithful and even Cowboys (and more) all are represented, with playlists ranging in price from around $25-$45 USD.If you ever needed a stereotyping microscope to peer into what these hooligan cliques are into these days, or if you're looking for a way into said cliques, these Back to School lists might just be the ticket.

  • Use iMovie to remove iTMS DRM

    This tip has apparently been around for quite a while, but the indispensable macosxhints just discovered it today, and I thought I'd share the love. It turns out that, using iMovie and at least one picture/video file, you can chose a couple of specific export options to crank out a DRM-free AIFF file from any of your iTMS songs. Bringing this file back into iTunes, of course, re-converts and compresses it to your bidding. It might be a roundabout solution, but if you can export more than one song per iMovie project (anyone care to try?), I bet this could turn out to be a bit easier than burning all those CDs.Check out macosxhints for the full instructions on using iMovie to de-DRM your tracks.

  • iTunes to allow video burning soon?

    I used the question mark because nothing is set in stone here, but TUAW reader Ann-CA tipped us off to a report at the DVD Newsroom that Hollywood might actually be close to lifting some of their over-the-top restrictions on DVD burning. This slightly loosened grip on their content could allow for things like DVD burning kiosks (it better be a darn fast burner), and it could also give the green light to vendors like the iTunes Music Store to allow burning of purchased videos.The panel in charge of making and (finally) rewriting these rules is called the DVD Copy Control Association, according to DVD Newsroom. This DVDCCA is currently working on licensing the encryption technology (Content Scrambling System, or: CSS - nothing to do with web design) to digital distribution services, which is the key to allowing video burning.No ETA is offered on when these rewritten rules could see the light of day, or when video burning could arrive in the iTMS. If Hollywood's reaction times of the past are any indication (and I genuinely hope they aren't), however, we might all be using 7th or 8th gen iPods before we can watch iTMS video on something besides Apple-branded devices.

  • Columbia Records & Apple offer exclusive pre-order of Bob Dylan's new album, ticket promo

    I guess the times certainly are a changin', as the man Bob Dylan himself has hopped on board with Apple and the iTunes Music Store to offer an exclusive pre-order ($13.99) of his upcoming new album, Modern Times, which lands on August 29th. Ticketmaster has even tossed their hat in, just like with the Red Hot Chili Peppers promo back in April, and is offering a pre-sale ticket opportunity for select dates on Mr. Dylan's tour to fans who pre-order the album.Now if that isn't enough Bob for you, Apple has also created a digital box set simply called 'The Collection' which boasts 800 songs, but be careful using that one-click purchase option: it's $199, and also lands on the 29th. "Bob Dylan is one of the most respected poets and musicians of our time, and he is a personal hero of mine," said Steve Jobs, Apple's CEO, calling this opportunity a "a real thrill for us."Modern Times (iTMS link) is available for pre-order today, and fans who purchase it will receive a Ticketmaster code by email which can be used to get in on that pre-sale at Ticketmaster.com starting August 30th, while the tickets go on sale to the public September 9th.   • Google will not compete with iTunes

    For a while now, it's been an unspoken assumption that, with the introduction of a video service (that really hasn't gone anywhere), Google might try to step on Apple's toes and take on the iTMS. However, at the NARM (National Association of Recording Merchandisers) conference this year Chris Sacca, head of Google's business development, confirmed exactly the opposite; that the company is not going to take on the 800 pound gorilla that is the iTMS. Chris then went on to make a call for the existing stores to come together, create a unified format, shake hands and sing kumbaya. A move that other notable folks, such as Cory Doctorow, have been calling for, while others respond with reality-checking prowess. Ultimately, it's probably a good thing Google isn't trying to move in on the digital music turf. It seems that some of their service offerings, such as Google Video, still need a bit of polish if they're really going to make a splash.[via Engadget]

  • Charles Wiltgen responds to Cory Doctorow's 'DRM is bad for business'

    Cory Doctorow, well known for his work at BoingBoing and other projects, wrote an article titled Apple's Copy Protection Isn't Just Bad For Consumers, It's Bad For Business. If you've been following anything this guy's written, this isn't the first time he's spoken out about DRM in general, as well as Apple's market-leading role in its use. If you haven't been following his work - that linked article is a great introductory read into Cory's very vocal disapproval of the current state of legitimate media distribution systems (almost all of them use DRM).John Gruber recently linked a response to Cory's article from Charles Wiltgen titled OMG DRM is r33ly bad!, and quite the response it is. Whether you're a stark advocate of either side of the DRM debate or you're just getting your feet wet with all this 'Digital Rights Management' stuff, I think both of these articles are interesting reads in their own right. Cory can be somewhat of a dramatic voice for the anti-DRM movement, and Charles' response is an interesting reality check for a situation that might not be as bad as some think. DRM always heats up the comment threads here at TUAW though, so for now I'll leave you to read Cory's article and Charles' response and form your own conclusions.

  • Apple and Coke team up for European iTMS promotion

    That Apple + Coca Cola promo we mentioned in June has been made a reality, but only in Europe - at least for now. MSNBC is reporting that iTunes has launched "the deepest alliance of its kind" to promote the iTMS on Coke's website in the UK and Germany, as the company will also be giving away 70 million songs on its products in a promo that sounds just like the Pepsi partnership of a year or so ago. Interestingly, Apple declined to comment on whether shaking hands with Coke meant that they had to stop drinking from the Pepsi fountain.It sounds like all you TUAW readers in the UK and Germany can keep your eyes out for the promotion to hit Coke's website and products sometime this month.   • Rest of industry slowly catching on to Apple's music integration approach

    RealNetwork's CEO Rob Glaser, always one to fire off a comment when he tricks himself into thinking the industry is listening, might be one of the first major partners of Microsoft to publicly express, erm, 'disappointment' with the Redmond company's all-in-one approach with their Zune music player and service, slated to be delivered... oh I dunno, some day: "We think this a case where our technology competitors, in this case specifically Microsoft, have literally thrown the baby out with the bath water." This might also be the first time Microsoft has been accused of literally throwing out a baby, along with other features and products, such as most of Vista WinFS.But here's the interesting part: Rob then goes on to threaten (hehe, isn't he cute?) that this gives RealNetworks the opportunity to go find other hardware companies who are "open to integrating tightly with our Rhapsody software platform". Discussion as to whether RealNetworks has even 1 full percentage point of the digital music market aside, it sounds like, after four years, supposed competitors to the iPod + iTunes platform (since when was Microsoft a hardware company?*) are catching on to the possibility that the whole 'integration' strategy Apple uses might actually be a good idea. However, time will have to tell whether this 9th inning enlightenment will pay off for any of these companies.[* - Microsoft's mice and keyboards (and possibly other peripherals) don't count. Last I heard, they're designed and built by HP.]

  • Facebook begins iTunes promotion, giving away 10 million samplers

    Facebook, the MySpace of the EDU world (and the 7th most trafficked site in the US), has announced a back-to-school promotion involving the iTMS and 10 million music samplers. They will be giving away 1 million 25-song samplers each week for the next 10 weeks, with genres including Alternative, Rock, Hip-Hop and Electronica. It appears that one only needs to visit Facebook to see banners like this, which are linked to the download at Apple's site, so go forth and download, iTunes and Facebook users.[via iLounge]
