    Eminem’s publisher sues Spotify for unlicensed streaming

    Eminem's publisher Eight Mile Style filed a suit in federal court Wednesday alleging that Spotify has streamed the artist's songs without having properly licensed them. "Spotify has not accounted to Eight Mile or paid Eight Mile for these streams but instead remitted random payments of some sort, which only purport to account for a fraction of those streams," states the complaint obtained by The Hollywood Reporter.

    Earlier this year, YouTube snagged the rights to Bodied, an Eminem-produced satirical film that premiered at the Toronto International Film Festival and took home the Grolsch People's Choice Midnight Madness award. Now, ahead of its November release, YouTube has shared a new trailer for the film.

    YouTube has acquired the rights to Eminem-produced Bodied, a satirical film that takes place within the Oakland hip-hop scene. It's co-written and directed by Joseph Kahn -- director of 2004's Torque as well as music videos for everyone from Taylor Swift to Eminem -- and follows a grad student who decides to jump into the rap battle scene. The student, played by Calum Worthy (Austin & Ally, American Vandal), is successful, which doesn't sit well with others in Oakland's underground hip-hop world.

    While many in the US are relaxing for the July 4th holiday, the folks at Apple Music and Tidal are hard at work trying to push their respective subscription music services. Apple has already announced plans for a Dr. Dre radio show on Beats 1 that will debut Saturday night, after airing shows hosted by artists Q-Tip and Run the Jewels on Friday. Just to add on, Apple Music revealed it nabbed the exclusive for Eminem's "music film" Phenomenal. Not to be outdone, Tidal came through with a surprise exclusive drop of Lil Wayne's new album, FWA, aka the Free Weezy Album. Whether or not those match your personal taste, it's evident both are gunning hard for the current subscription streaming leader, Spotify, to power the playlist at your barbecue this weekend. As far as Spotify and the rest, well, at least they have AC/DC too.

    The Real Slim Shady's back with another album, titled The Marshall Mathers LP2. And if you're a fan of Eminem and have iTunes Radio, then there's a way to listen to his latest work in full without going the, well, shady way. Starting today in the US, Eminem's MMLP2 (as it's known for short) can be streamed on the "First Play" station of Apple's newfangled music service, allowing users to tune in to the set of tracks ahead of next Tuesday's scheduled release. As 9to5Mac notes, this marks the first time that an entire album is being given early access to exclusively on iTunes Radio, and it could certainly pave the way for more artists to follow suit. Above all, it is another example of how the music industry is adjusting itself as new services become available -- even if it might not be too excited about it.

    With both game and album debuting on November 5, Activision and Aftermath/Interscope Records have joined forces to offer a discount on Eminem's upcoming album The Marshall Mathers LP 2 to anyone who pre-orders Call of Duty: Ghosts. From now until launch, those who pre-order Call of Duty: Ghosts from GameStop will find a code on their receipt when they come in to pick up the game. This code entitles buyers to download a special version of The Marshall Mathers LP 2 which features "an exclusive, bonus studio track" for $9. Furthering this joint marketing effort is an upcoming trailer for Call of Duty: Ghosts, which will feature "Survival," a track from The Marshall Mathers LP 2. "The energy and intensity of 'Survival' really matches Call of Duty: Ghosts," said the musician. "I'm excited to continue to be a part of the franchise." As we reported earlier, according to Gamestop, Call of Duty: Ghosts is currently on track to be the most pre-ordered game of 2013.

    A warning: The video after the break is one of the weirdest things we've ever seen promoting the Mac OS. Sure, it's from Parallels, and sure, the virtualization software guys know how to sell a switch over to the Mac. But here they've chosen to do it in an extremely weird way, by creating a parody version of an Eminem song (that's still SFW, as far as we can tell), and combining it with some strange references to the movie Avatar. We don't really get it (eventually, Steve Ballmer and Steve Jobs fight it out, and then there's some explosions?), but some of you might find it funny. Next time, Parallels, maybe choose just one parody and stick to that. This one is well done, but man it is just ... strange.

    Scr-scr-scratched through all of DJ Hero's tracks? Activision has announced a new DLC mix pack featuring Renegade Edition headliners Eminem and Jay-Z. The collection is scheduled to drop on Xbox Live, PSN and Wii this month and includes: "Shake That" by Eminem mixed with "Show Me What You Got" by Jay-Z "Without Me" by Eminem mixed with "Encore" by Jay-Z "Can I Get A..." by Jay-Z mixed with "Lose Yourself" by Eminem The new tracks will be available on March 18 on Xbox Live for 640 ($8) and March 25 on PSN for $7.99. The tracks will not be sold separately for Xbox 360 or PS3. Each track, however, will be available for the Wii version on March 25 as a downloadable single for 300 Wii Points ($3); $9 for all three.

We know the temptation to just unfold the case/table thing and start playing the game with that kind of irresistible-looking novelty controller will be overwhelming, but if you turn the package over and shake it, exclusive greatest-hits CDs from Jay-Z and Eminem will fall out.Rolling Stone got the full list of tracks on both sets. Jay-Z's disc sticks exclusively to past hits, but Eminem's includes a brand-new song, "Taking My Ball." That's right, the "unreleased tracks" mentioned on the box is really unreleased track.     Eminem's publisher, Eight Mile Style LLC, is preparing to go to trial against Apple this week over the rapper's iTunes sales, Reuters reports. This comes just months after Eminem's production company, FBT Productions, lost its royalties case against Apple. This is an on-going battle since 2007, when Eminem sued Apple claiming that his music was being sold through iTunes without his consent. Apple claims that the deal, done through Aftermath Entertainment with distributes Eminem's music, is not only legal, but Eminem is making money off of it. Aftermath Entertainment is also being included in the lawsuit. Reuters says that if the two sides do not reach a deal, the trial will start on Thursday. Eminem has also previously sued Apple over its use of "Lose Yourself" in an iTunes Store ad that aired in 2003. [Via Apple Insider]

    Late last week, Adam 'DJ AM' Goldstein tragically and suddenly passed away. He was known in the world of gaming for his work on DJ Hero, contributing both music and ideas to the upcoming music/rhythm project. We watched as he and Travis Barker warmed up the crowd for Eminem and Jay-Z just a few short months ago at E3 2009. Having worked with Goldstein so closely as of late, we asked Activision for comment. VP of music affairs Tim Riley told us over the weekend:We are deeply saddened by the loss of DJ AM, who was a tremendous talent, a trusted partner and friend to DJ Hero. Our thoughts and prayers are with his friends and family. AM was instrumental in the making of DJ Hero and we hope that his work on the game will be a fitting tribute to his creative spirit and musical talent.Joystiq would like to offer our condolences to DJ AM's family, friends, and anyone else effected by his passing.

When the game launches, you'll have the option of picking up the "Renegade Edition" of the game, which includes a special turntable, a hardshell case that converts into a stand and a two-disc CD set of Jay-Z and Eminem music that features some previously unreleased tracks. Not that this comes as a complete surprise. Now, we could take or leave the CDs (Music that you don't pretend to play? What, is it for babies?) but the case/stand actually sounds pretty slick.     Though our invites to tonight's Activision-sponsored party touted Guitar Hero 5 as the rhythm game to-be-previewed, the marquee in front of the Wiltern Theatre testified otherwise -- the real star of the evening will apparently be DJ Hero.Oh, and the "secret guest appearances" Activision teased in the invitation are a tad different than we expected as well -- we'll apparently be laying eyes and ears on the musical talents of Eminem, Jay-Z and noted plane crash survivors Travis Barker and DJ AM. Fairly appropriate, considering the night's DJ Hero branding, no? Like, one of the performers has "DJ" in his name.We'll let you know if we get to lay eyes on Activision's record spinning title.     Bedroom DJs who can't actually be bothered to, you know, mix records and such: You're gonna be thrilled by this next bit of news. According to USA Today, Jay-Z and Eminem have joined our man DJ Shadow in attaching their names (and beats) to Activision's latest. The special-edition release of DJ Hero will reportedly bundle greatest hits CDs from both artists, a limited edition controller, a "DJ stand" (whatever that is -- perhaps a gilded pedestal like the one Sven Vath performs on?) and a metal traveling case.     According to a USA Today article, Activision has turned to Jay-Z and Eminem to provide some added value to a special edition release of DJ Hero. In addition to the game, the bundle reportedly includes greatest-hits CDs from both rappers, possibly with new tracks; an "advanced version of the controller;" a DJ stand and a metal traveling case. The two musicians will serve as "consultants" to Activision, and will, of course, contribute tracks to the game. Another collaborator, DJ Shadow, put four screenshots of DJ Hero up on his website that finally show some gameplay. It appears to be very similar to Guitar Hero, except sometimes the note line moves a bit, which we believe indicates switching tracks on the crossfader.[Via NeoGAF]%Gallery-51799%

    Eminem's production company, FBT Productions, has been arguing that their artist is entitled to half of all royalties generated by sales of his music in the iTunes Store. Of course, Apple takes a commission before the artist receives their compensation. FBT's argument hinged upon whether the arrangement constitutes a licensing agreement.MacNN reports that a Los Angeles jury decided no, iTunes is simply another distribution channel, so Em will not be receiving the $1.47 million he was after. Bummer, dude.This certainly isn't the first time Eminem's legal team has clashed with Apple's. Back in May of 2005, Apple was forced to pull an iPod ad that featured a young user singing (Rapping? Speaking?) the lyrics to "Lose Yourself." The story at the time was that Eminem refused to give Apple permission to use the song, but they did anyway.Later that same year, the folks at Lugz footwear had Apple pull an Eminem-approved TV ad that looked a lot like their own. Oops.

    It looks like Apple has more than just 3 billion songs sold to celebrate, as it's now managed to bring longtime hold-outs Led Zepplin into the iTunes fold. The band isn't quite going all out, however, with it instead simply offering greatest hits of sorts called "Mothership," which will include 'Stairway to Heaven', 'Whole Lotta Love,' 'Dazed and Confused' and other songs personally selected Jimmy Page, Robert Plant and John Paul Jones. Look for it to be available on November 12th. In other iTunes news, Apple appears to have found itself on Eminem's bad side (again), with the rapper and his music publisher now suing the company over, you guessed it, alleged copyright violations. As The Detroit News reports, Eminem's music publisher and copyright manager are claiming that they never actually authorized Universal to offer Eminem's music on iTunes in the first place, and they're now asking Apple to cease and desist its reproduction and distribution.
